i understand that this means without a reply from the Customer Service Dpt or having a received a reply rejecting the reasons for the claim, but looking for a better way to state it and make it fit in the text below, thanks

Transcurridos 2 meses desde la fecha en que hubiere sido formulada por escrito reclamación a la sucursal en España de la Entidad Aseguradora sin que el Servicio de Atención al Cliente de aquella se hubiera pronunciado sobre la misma o lo hubiere hecho denegándola, el Tomador del seguro, el asegurado, el beneficiario o los derechohabientes de cualquiera de ellos podrán presentar reclamación ante el Comisionado para la defensa del Asegurado adscrito a la Dirección General de Seguros y Fondos de Pensiones, con domicilio en xxxx de Madrid, conforme a lo previsto en la Legislación vigente.
