MARCAS, APROVECHAMIENTO DEL CREDITO AJENO EN EL REGISTRO DE.
De acuerdo con el espíritu, sistema y propósitos de la Ley de la Propiedad Industrial, artículo 105, lo que ha querido el legislador es evitar que se engañe al público consumidor cuando se le induce a creer que compra algún artículo de una calidad acreditada, siendo que en realidad no corresponde a la del artículo amparado por la marca de que se trata, por lo que debe entenderse que el error o confusión a que alude el citado precepto legal es aquel en que el titular o usuario de alguna marca aprovecha para sí el crédito industrial o comercial no creado **ni originable exclusivamente por los méritos** de sus propias mercaderías, sino el logrado por otros factores a los que es ajeno.
