daƱos means Harm..but here you gain nothing but keeping it..

and I meant: e-mail virus and not e-virus..that was a lapsus graficus..perhaps a new find?? :)

What court decides about compensation for damages?
Persons who have sustained damages (e.g. damage to property, mental distress) may claim compensation from the perpetrator either in the framework of criminal proceedings (whereby the victim sues for damages) or through separate civil action. Persons suing for damages in criminal proceedings may access related enquiry evidence. In this case, the procedural costs to be borne by the parties are lower than in case of separate civil action, since these costs are partly included in those of the criminal proceedings (to be borne by the State).

Basically, you can claim damages based on an act punishable under criminal law or under civil law. Both are possible.

I think it is important here not to confuse "delito de daƱos" with damages in a civil liability (tort) context. The "Delito de DaƱos" defined in Articles 263-267 of the Spanish Criminal Code (and exisiting in other Spanish-speaking jurisdictions) is equivalent to what is defined in many common law jurisdictions as "criminal damage". Depending on the jurisdiction, criminal damage encompasses many types of damage to property (criminal mischief, criminal tampering, criminal use and possession of a noxious substance, defacement, desecration, criminal littering, etc.) and includes propagating computer viruses in the cases shown below.

  -> Yes, thanks, "criminal damage" is indeed used in the US on the Federal Department of Justice website and in the penal/criminal codes of Arizona, Ilinois, Kansas, Wisconsin, etc.

  -> Yes, thanks, and in this case the word daƱos does not refer to compensation for damages, but rather physical damage done to property termed "criminal damage" in penal codes of many common law jurisdictions, corresponding to the Spanish "delito de daƱos"
