Court Allows Challenge to Arbitral Award for Failure to Adjudicate Claims. On May 6, 2004 the Schweizerisches Bundesgericht, I. Zivilabteilung (Swiss Federal Court, 1st Civil Chamber) held that under Article 190(2)(c) of the Swiss Private International Law Act (‘ PILA’ ), arbitral awards can be challenged with the Swiss Federal Court if the arbitral tribunal failed to adjudicate certain claims (infra petita). In a decision concerning the early termination of a professional football player contract, the Court of Arbitration (CAS), on appeal of a decision of the FIFA player-status commission, granted one of appellant's several prayers for relief in part and further held that ‘ any other or further claims of the Parties are dismissed.’ The Appellant challenged the award under Article 190(2)(c) of the Swiss Private International Law Act (‘ PILA’ ). Pursuant to this provision, arbitral awards can be challenged with the Swiss Federal Court if the arbitral tribunal ruled beyond the claims submitted to it (ultra petita), or granted relief different than what was sought (extra petita), or failed to adjudicate certain claims (infra petita). The Swiss Federal Court dismissed the challenge, holding that under Article 190(2)(c) only decisions can be challenged that do not address or encompass at all one (or several) prayer(s) for relief submitted to it. In contrast, according to the Federal Court, arbitral tribunals are not bound to deal comprehensively with all prayers for relief, but are free to dismiss ‘ any other or further claims of the Parties’ without giving specific reasons.
