El deber puede ser un deber genérico, que incumbe a cualquier persona por el hecho mismo de la convivencia (ayudar a alguien en peligro) o un deber específico que solo obliga a determinado círculo de personas (funcionarios, médicos, etc.) Pero aún cuando exista infracción de un deber, si la lesión del bien jurídico se produce por una acción habrá un delito comisivo o activo, no uno de omisión (así, por ejemplo, el cirujano opera con instrumental no desinfectado y el paciente muere por infección, habrá un delito de homicidio por imprudencia activo: Operar sin desinfectar el instrumento, no uno omisivo.)
