responsabilidad en ..."homicidio por omision impropia" ... en calidad de garante liability as warrantor for (AE) negligent homicide; (BE) gross negligence manslaughter by omission Explanation: First of all, we need to extend the question to see whether the responsabilidad/accountability refers forward to the garante who is acting e.g. 1. (AmE) in the line of duty or 2. (BrE) in the course of (prison guarding etc.) employment. Second, we have to establish if US or UK etc. terminology is required as homicide is a substantive law category but not an indictable offence in England & Wales. Then see, if the UK, if the term gross neg. is enough or needs to be qualified as criminal negligence by (medical etc.) act or omission/ nonfeasance. Example sentence(s):

homicide by gross negligence by person/s failing to provide duty of care Explanation: I am attempting to provide a "country neutral" translation here, since in my view a translation of this kind is provided for the purpose of the reader being able to clearly understand what is meant. Providing a translation specifically for USA or UK (or any other English speaking country) does not strike me as necessary. Of course this is a synoptic definition, so I cannot back it up with references. -------------------------------------------------- Note added at 6 hrs (2010-08-26 01:30:58 GMT) -------------------------------------------------- for UK target you could say manslaughter in place of homicide |

homicide by accessory during the fact based on capacity (as public official) Explanation: The term "cómplice por omisión" translates as "accessory during the fact." The chief of state police acted as an accessory by way of his inaction in the face of the crimes committed by his subordinates. The clasification of the homicide (first degree murder, second degree murder, voluntary manslaughter, involuntary manslaughter, negligent homicide, etc, etc) is another story and it depends on the way in which the crimes were committed and the elements to be proven in court, which is not at play in this context. http://blogdecristianiglesias.blogspot.com/2010/07/callar-no... |

Reference: homicidio por omisión Reference information: Paraguayan judicial officials announced their intention of bringing charges of "negligent homicide" (homicidio por omisión) against the former president stemming from the deaths of the demonstrators. However, the newly appointed Interior Minister rejected a senior state prosecutor's request for the arrest of Cubas, on the grounds that he "cannot be arrested unless his immunity is revoked by the Senate". On Monday 29 March, Raúl Cubas fled to Brazil where he was granted political asylum. Senate leader Luis González Macchi was sworn in as head of state on Sunday as constitutional successor to Cubas. -------------------------------------------------- Note added at 4 hrs (2010-08-25 23:09:51 GMT) -------------------------------------------------- Gross Negligent Manslaughter: (UK) An individual who is said to be the controlling mind, and have a ‘duty of care’, under certain circumstance may be convicted of Criminal Gross Negligent Manslaughter. A company may in many ways can be likened to a human body. They have a brain and a nerve [center] which controls what they do. They also have hands which hold the tools and act in accordance with directions from the [Center]. Some of the people in the Company are mere servants and agents who are nothing more than hands to do the work and cannot be said to represent the mind or will. Others are Directors and Managers who represent the directing mind and will of the company, they control what they do. The state of mind of these Managers is the state of mind of the Company and is treated by the law as such. |
