Artículo 238.- Son causas de divorcio:

1) La infidelidad manifiesta y pública de cualesquiera de los cónyuges;

2) Los malos tratos de obra, injurias graves, y trato cruel de uno de los Cónyuges contra el otro o contra los hijos, que hagan insoportable la vida en común;

3) El atentado de uno de los cónyuges contra la vida del otro o de los hijo;

4) El abandono manifiesto e injustificado de uno de los cónyuges por más de dos años sin comunicación con el otro.

5) Toda conducta de uno de los cónyuges tendente a corromper o pervertir al otro o a los descencientes;

6) El uso habitual de drogas heroicas y estupefacientes por parte de uno de los cónyuges, cuando amenazaren con causar la ruina de las familias o constituya un motivo de desavenencia conyugal;

7) La negativa injustificada de uno de los cónyuges a cumplir para con el otro con los hijos comunes, los deberes de asistencia, educación y alimentación a que éste legalmente obligado; y,

8) La separación de hecho de los cónyuges durante dos años consecutivos.

UN International Covenant on Civil and Political Rights - HONDURAS*

The grounds for divorce are set forth in article 238: (1) Open, public infidelity on the part of either spouse; (2) Physical abuse, severe injury and cruel treatment of one spouse and the children by the other spouse, making their life together intolerable; (3) Attempted murder of one spouse or of the children by the other spouse; (4) Open abandonment of one spouse without just cause, after more than two years with no communication from the other spouse; (5) Conduct on the part of one spouse likely to corrupt or pervert the other spouse or their children; (6) Habitual use of narcotics or other drugs by one of the spouses, where such use threatens to cause the ruin of the family or constitutes a source of conjugal discord; (7) Unjustifed refusal on the part of one of the spouses to fulfil vis-à-vis the other spouse or vis-à-vis the children the duties of assistance, education and support incumbent upon him or her by law; and (8) Separation from bed and board for a period of two consecutive years.
