“to be paid/provided by the person who invokes such ground for divorce” is how I'd normally put it, although I'm not sure why it must be paid by the person who "invokes" such ground for divorce (if, by "invoke", they mean the person filing for divorce (the petitioner) who bases his/her petition on such ground)), as opposed to the person who was at fault or who "committed" the act that led the petitioner to "invoke" such ground for divorce, which makes me wonder if it's a misuse of the word "invocar", in which case it could be something like, "to be paid/provided by the person against whom the divorce was pronounced, based on the invoked ground"? A bit long-winded but... |
