(Can: divorce) final and binding decree absolute

Explanation:
Not very clear to me if 1. for Canadian consumption and 2. a divorce decree or is an *ancillary relief order* (containing arrangements for children) handed down by the Tribunal de Protección de Niños, Niñas y Adolescentes.

For UK enforcement , the word 'binding' must - according to the Supreme Court Rules - be used.

Otherwise, the spectre of professional negligence will hang over the unfortunate translator or interpreter, prayfully with a professional indemnity policy,

To Billh and doubting Thomases:

The judgment still needs to be 'final and conclusive' or 'final and binding'. http://www.lexology.com/library/detail.aspx?g=6c7646af-1733-...

Otherwise, CanE and UK/irish lawyers and courts wouldn't keep on being so insistent on inclusion of the word binding in translations:

agree  AllegroTrans: a decree absolute is, by definition, final and binding
8 hrs
-> Indeed. But, in my 'limited' experience, UK lawyers and the courts nonetheless want to see the word 'binding' in there.

neutral  Jennifer Levey: You (yet again...) overlook the fact that Asker is translating concepts from the ST jurisdiction, and must reflect that jurisdiction's rules, not those of an unspecified target jursdiction which may not even have an equivalent concept.
10 hrs
-> Yes. You're right. But, in practice, it may be crucial for US/UK recognition and enforcement purposes to add the word 'binding' that lawyers & courts - aware of the literal ST meaning - insist on for clients' benefit. NB the prof. neg. and ins. points.

neutral  Billh: Q. Just where does the word "binding" or "enforceable" appear in the Supreme Cout Rules??? Answer: nowhere https://www.supremecourt.uk/docs/uksc_rules_2009.pdf And I echo Robin's comment//can't find it. This pure obfuscation
19 hrs
-> RSC Rule 42(c) http://www.legislation.gov.uk/uksi/1998/3132/schedule/1/part... > but you and Robin pls. feel free to keep on criticising this 'otiose' turn of phrase' imposed by UK, Irish and US legal clients and London High Court Masters & Judges.
