El tipo queda consumado con la acción, pero el sujeto tiene como objetivo (como ultrafinalidad que va más allá de la realización de ese tipo objetivo) otro hecho (típico o no) que se debería producir después de realizar el tipo pero ya "sin" su intervención[124]. Ello ocurre en el cohecho activo (C.P. 258), donde por ejemplo un detenido ofrece dinero al efectivo policial "para" obtener su libertad. En estos supuestos la conducta es típica aunque no se concrete el resultado esperado como ultraintención. Where an offence has been committed in the course of undertaking some other action, it can be difficult to state for certain that the defendant intended to commit the offence.
