First, using the theory of public choice, he shows that in today's world there are possibilities of non-optimal legislation of too little or too much legislation. When the legislation of a statute brings in interests concentrated on a small number of groups, while the social costs of that legislation are diffused among many groups, it would be probably the case that the statute is enacted as a result of strong lobbying activities of interest groups which will get wind-fall interests after the enactment. The fact that they will only have to pay a small portion of diffused costs for big wind-fall gain will work as a strong incentive, and the result will be plethora of legislation with concentrated interests and diffused costs. Therefore there would be too much legislation. On the other hand, when legislation results in ***diffused interests*** to various groups, it would be hard to enact the legislation, even when the legislation is socially desirable. It would not matter whether the costs would be born by a specific group or diffused among various groups.
