Here, the "no" particle, as used in conjunction with "hasta que," serves the same purpose as the subjunctive tense -- that is, to indicate that at the time the statement is being issued, the court has not yet ruled on the matter. (In other words, the ruling to be issued by the court is still in the future, and any assumption that the court has already ruled would be contrary to existing fact.)
A slightly wordier alternative: "...until the court has issued a decision in the case."
