the counter-guarantor / the bonded party Explanation: According to the first web site below, "...Por "contragarantía" se entenderá una promesa dada al garante/emisor...; por "contragarante" se entenderá la persona que emita una contragarantía..." The second web site mentions a useful publication -- REGLAS Y USOS UNIFORMES RELATIVOS A LAS GARANTIAS A PRIMER REQUERIMIENTO (International Chamber of Commerce (ICC) Publication No. 458 (París, 1992) -- saying, "Estas reglas son de gran ayuda . . . Orientadas para ser aplicadas a las garantías, fianzas y otros compromisos de pago bajo cuyos términos la obligación de pagar del contragarante o garante . . ." contragarante= guarantee afianzado=bond Explanation: In English there is no distinction made between a guarantee freely given and a guarantee made in response to something, so contragarante is the same as garante. A bond is money posted and kept in a safe place (usually a bank account set up for the purpose) to satisfy possible future debts. |
