see below Explanation: The translation of Y considerando - as whereas , may look very tempting,but it may be like taking too much of liberty with the import of the words that follow the two words. Similarly is the case with Y vistos. The whole thing depends on how much free styletranslation you want to do of legal documents. |

These are both "whereas", "considering" or "in view of" Explanation: There is a difference, though, in the way they are used in Legal Spanish. "Considerando" is the "Whereas" for the legal basis of the case. "Resultando" likewise for the factual issues, and "Vistos" for the DOCUMENTS entered into evidence (a way for the judge to acknowledge them, i.e., because he has "seen" them. In any event oral arguments are rare in the Spanish legal system. Most are presented in written form. The judge had better read them or else he/she is ruling in a vacuum). |
