there isn't really a context with this as this is the whole quote. previously, what has been discussed is that that evidence is free, but that is contradicted when it is subjected to the strict rules of law. After the quote by Carnelutti, the author then goes on to say that "en otros terminos, la medida del limite es indiferente para la naturaleza del proceso".

What we really need is the preceding sentence or two. Two answers have been given but neither one addresses the main question here: what is the "degeneration" (or perhaps breakdown, or deterioration) being spoken of? This verb in the text suggests an entirely different (possibly colloquial or slang-like) meaning of "fijación" -- and militates against taking it to mean "fixation (of the truth)"

Perhaps some kind of obsession, of single-minded search is the subject, a search that tramples on someone's rights - hence "para que...degenere"
