I was also baffled, and then thought that it must refer to both sides of the coin. What happens legally if there is a claim for sexual harassment? Well, on the one hand the claims of harassment may be 'thrown out' and on the other, the victim may claim compensation. I don´t know, it's pretty odd. Maybe the 'y' should be 'o'?

Anyway, here's the text before that part, in case it helps:

En su título I, la ley establece definiciones generales de comportamientos relacionados con la igualdad de género, y establece consecuencias legales para conductas discriminatorias. Es aquí donde de manera explícita se refiere a:
• El acoso sexual, como cualquier comportamiento, verbal o físico, de naturaleza sexual que tenga el propósito o produzca el efecto de atentar contra la dignidad de una persona, en particular cuando se crea un entorno intimidatorio, degradante u ofensivo
• El acoso por razón de sexo, como cualquier comportamiento realizado en función del sexo de una persona, con el propósito o el efecto de atentar contra su dignidad y de crear un entorno intimidatorio, degradante u ofensivo

I am having the greatest difficulty in understanding this phrase given the little bit of context. It almost sounds like the first thing someone should do if WRONGLY accused of sexual harassment. Is that the case? Why else would you invalidate or nullify the behaviour? Something seems to be missing here.
