Ich würde den spanischen Begriff ggf. in Klammern dahinter angeben.

"Objektiv" deshalb, weil die Entscheidung, wer in einem Verfahren als Unterlegener gilt, nach objektiven Kriterien (Art. 394) und nicht nach billigem Ermessen festgelegt werden soll.
(Das ist besonders in den Fällen wichtig, wenn der Hauptantrag abgewiesen wurde, der Hilfsantrag jedoch erfolgreich war.)
