”Cuando los acuerdos sociales deben inscribirse en el Registro Mercantil, el Reglamento de dicho Registro establece con carácter general que tales acuerdos deben constar en escritura pública otorgada ante Notario, salvo en aquellos casos concretos en los que el propio Reglamento permite que se inscriban mediante documento privado. La elevación a escritura pública de los acuerdos sociales es la constancia de tales acuerdos en escritura pública otorgada ante un Notario.”
