1. "Part förbinder sig att iaktta sekretess och att inte till tredje man utlämna konfidentiell information"
It is clear to me that the term refers to the parties of the agreement. I also think it's clear from context that this particular sentence applies to BOTH parties. But should it be translated as:

2. "Med konfidentiell information avses sådan information som part uttryckligen angett ska utgöra konfidentiell information"
