Bir fiilin yargılanmasına başlanabilmesi için kural olarak o fiilin suç teşkil ettiğinin ve failin cezalandırılması gerektiğinin ileri sürülmesini ifade eden ilkeye davasız yargılama olmaz ilkesi denmektedir.
