ADVANCE LETTER OF GUARANTEE SAMPLE

ANKARA
As our Bank guarantees the advance amount of (amount in numbers) (amount in letters) that the contractor is obliged to pay as per the related laws, specifications and contract provisions within the framework of the (contract name) contract made between your administration and the Contractor (contractor’s name), in the event that the aforementioned contractor does not fulfill its obligations in part or as in its entirety as required by the related laws, specifications and contract provisions, or in the event that this advance amount is required to be reclaimed for any reason, we, as the authorized representative and executive officer to execute on behalf and on the account of the Bank, guarantee and declare to pay the abovementioned amount to the Administration or to your name in cash and in sum within 3 days at the latest upon your first written demand, together with the LIBOR+2% (annual) interest rate that is applied on the date of request and for the period starting from the date of request until the date of payment, without the need for a protest, legal decisions, or written or verbal permission of the aforementioned, and without taking into consideration the disputes that may arise between the aforementioned and the administration, the outcomes and legal results of such disputes.
The letter of guarantee, hereby, is limited and shall be valid until …/…/….. .
In the event that this letter of guarantee is indemnified from its contents, the payment shall be made in US Dollars or in Turkish Liras based on the Effective Exchange Selling Rate of Central Bank of Republic of Turkey effective on the date of payment.

İdarenizle yüklenici (yüklenici adı) arasında yapılan (sözleşmenin adı) sözleşmesi çerçevesinde yüklenici (yüklenici adı)’ye kanun, şartname ve sözleşme hükümlerine göre avans olarak ödeyeceğiniz (rakamla miktar) (yazıyla miktar)ını Bankamız garanti ettiğinden, adı geçen yüklenici, sözleşme kapsamındaki taahhütlerini ilgili kanun, şartname ve sözleşme hükümlerine göre kısmen yada tamamen yerine getirmemesi veya, bu avansın her ne sebeple ve suretle olursa olsun geri alınmasının gerekmesi halinde, protesto çekmeye, hüküm ve adı geçenin yazılı yada sözlü iznini almaya gerek kalmaksızın ve adı geçen ile idareniz arasında ortaya çıkacak herhangi bir uyuşmazlık ve bunun akibet ve kanuni neticeleri nazarı itibare alınmaksızın, yukarıda yazılı tutarı, ilk yazılı talebinizden itibaren en geç 3 (üç) iş günü içerisinde idarenize veya emrinize nakten ve tamamen ve yükleniciye ödemenin yapıldığı tarihte geçerli olan ve yükleniciye ödeme yapılan tarih ile hesabınıza geri ödemenin yapılacağı tarih arasındaki süreye tekabül eden LİBOR+%2 (yıllık) faiz oranı üzerinden bu süre için hesaplanacak faizi ile birlikte ödeyeceğimizi, Bankanın imza atmaya yetkili temsilcisi ve sorumlusu sıfatıyla, Banka ad ve hesabına taahhüt ve beyan ederiz.
İşbu Teminat Mektubu limit içidir ve …./…../……. tarihine kadar geçerlidir.
İşbu teminat mektubu muhteviyatından tazmin halinde, ödeme ABD Doları cinsinden veya ödeme tarihinde geçerli olan TCMB efektif satış kuru üzerinden TL cinsinden yapılacaktır.
