1. Albeit in the form of a single question, the national court has in fact requested a ruling on two separate points. In the first part of the question, the Austrian judge seeks to ascertain whether Article 18 of the Council Directive 93/37/EEC of 14 June 1993 concerning the coordination of procedures for the award of public works contracts (hereinafter “the Directive”) may have an impact on the outcome of the main proceedings. The latter, I repeat, concern the legality of the contracting authority’s decision not to complete a tendering procedure in view of the fact that only one tender has been admitted as valid.
2. The Community Directive at issue, like all the directives on contract procedures, which constitute a consistent body of legislation as regards the principles and purposes which they embody and the manner in which their text is drafted, does not give specific guidance on this point. The fact is not surprising, moreover, since the Directive merely seeks to coordinate national procedures and does not purport to lay down exhaustive rules intended to supplant entirely the various national legal systems for the award of contracts. That conclusion follows from the Directive itself: the third recital states that such coordination must “take into account as far as possible the procedures and administrative practices in force in each Member State”.
In the light of that fact, it is reasonable to entertain doubts as to whether the circumstances of this case might not fall outside the scope of the Directive, with the result that the answer to the question should remain within the purview of the Member State, by virtue of the principles just referred to whereby, “[a]s far as possible”, national procedures and practices should be respected.

1. Sąd krajowy faktycznie zwrócił się o rozstrzygnięcie dwóch różnych kwestii, chociaż w postaci jednego pytania. Za pomocą jego pierwszej części sąd austriacki pragnie ustalić, czy przepis art. 18 dyrektywy Rady 93/37/EWG z dnia 14 czerwca 1993 r. dotyczącej koordynacji procedur udzielania zamówień publicznych na roboty budowlane (zwanej dalej „dyrektywą”) może mieć znaczenie dla rozstrzygnięcia postępowania przed sądem krajowym. Powtórzę, że dotyczy ono zgodności z prawem decyzji instytucji zamawiającej o nierozstrzygnięciu procedury przetargowej ze względu na fakt, że tylko jedna oferta została dopuszczona jako ważna.
2. Sporna dyrektywa wspólnotowa, podobnie jak wszystkie dyrektywy dotyczące procedur udzielania zamówień publicznych, które stanowią zbiór przepisów spójny pod kątem zasad i celów, których stanowią wyraz, oraz brzmienia przepisów, nie daje konkretnych wskazówek na ten temat. Fakt ten nie powinien być jednak zaskoczeniem, ponieważ celem dyrektywy jest jedynie koordynacja procedur krajowych, a nie ustanowienie wyczerpujących zasad mających całkowicie zastąpić różnorodne krajowe systemy udzielania zamówień. Wniosek ten wynika z brzmienia dyrektywy – jej trzeci motyw stanowi, że koordynacja ta powinna „uwzględniać w możliwie największym zakresie procedury i praktyki administracyjne obowiązujące w państwie członkowskim”.
Biorąc pod uwagę ten fakt, można mieć uzasadnione wątpliwości co do tego, czy okoliczności niniejszej sprawy nie znajdują się poza zakresem stosowania dyrektywy, a wtedy odpowiedź na pytanie prejudycjalne powinna należeć do kompetencji państwa członkowskiego zgodnie z przywołaną wyżej zasadą, że „w możliwie największym zakresie” zachowane powinny zostać krajowe procedury i praktyki.

49 La Commission soutient principalement que le Tribunal de la fonction publique a commis une erreur de droit dans l’interprétation de la notion de « partenariat non matrimonial » ouvrant droit à une couverture du partenaire d’un fonctionnaire par le RCAM.
50 Elle lui reproche à cet égard d’avoir considéré, au point 29 de l’arrêt attaqué, que l’enregistrement du partenariat visé dans la phrase introductive de l’article 1er, paragraphe 2, sous c), de l’annexe VII du statut ne constituait pas une condition préalable. Elle précise que, en renvoyant à l’article 1er, paragraphe 2, sous c), de l’annexe VII du statut, plutôt que de prévoir une définition de la notion de « partenaire non marié » à l’article 72 du statut, le législateur communautaire s’est référé non pas à la formalité de l’enregistrement en tant que telle du partenariat, mais à l’influence de cette formalité sur le type de partenariat qui peut être pris en considération. Les conditions énoncées à l’article 1er, paragraphe 2, sous c), de l’annexe VII du statut ne pourraient dès lors pas être lues indépendamment de la phrase introductive de cette disposition.
51 Il en résulte, selon la Commission, que le seul « partenariat non matrimonial » visé à l’article 1er, paragraphe 2, de l’annexe VII du statut est celui qui, en vertu de la loi nationale, est conçu comme produisant des effets semblables à ceux du mariage. Le Tribunal de la fonction publique aurait ainsi commis une erreur de droit en interprétant la notion communautaire de « partenariat non matrimonial » comme pouvant inclure d’autres types de partenariats qui, en vertu de la loi nationale, ne sont pas conçus comme produisant de tels effets, mais qui peuvent néanmoins produire des « conséquences [qui] peuvent être [semblables] en de nombreux points [à celles du mariage, si] les partenaires l’organisent contractuellement » (point 46 de l’arrêt attaqué).

49 Komisja twierdzi zasadniczo, że Sąd do spraw Służby Publicznej naruszył prawo przy dokonywaniu wykładni pojęcia „związku nieformalnego”, które daje możliwość objęcia partnera urzędnika systemem RCAM.
50 Zarzuca mu w tym względzie, że w pkt 29 zaskarżonego wyroku uznał, że zarejestrowanie związku, o którym mowa jest w zdaniu wprowadzającym w art. 1 ust. 2 lit. c) załącznika VII do regulaminu pracowniczego, nie stanowi warunku koniecznego. Wyjaśnia, że odsyłając do art. 1 ust. 2 lit. c) załącznika VII do regulaminu pracowniczego, zamiast zamieścić definicję pojęcia „związku nieformalnego” w art. 72 regulaminu pracowniczego, ustawodawca wspólnotowy odniósł się nie do formalności rejestracji związku jako takiej, lecz do wpływu tej formalności na rodzaj związku, który może zostać uwzględniony. Zatem warunków ustanowionych w art. 1 ust. 2 lit. c) załącznika VII do regulaminu pracowniczego nie można rozpatrywać w oderwaniu od zdania wprowadzającego w rzeczonym przepisie.
51 Stąd wynika, zdaniem Komisji, że jedyny „związek nieformalny” właściwy w rozumieniu przepisów art. 1 ust. 2 lit. c) załącznika VII do regulaminu pracowniczego to taki, który na podstawie przepisów krajowych pociąga za sobą skutki podobne do skutków małżeństwa. Sąd do spraw Służby Publicznej naruszył zatem prawo dokonując wykładni, zgodnie z którą pojęcie wspólnotowe „związku nieformalnego” może obejmować inne typy związków, które na mocy prawa krajowego nie rodzą takich skutków, mogące jednak powodować „konsekwencje [które] w wielu kwestiach mogą być […] podobne, jeśli partnerzy tak skonstruują łączący ich stosunek umowny” (pkt 46 zaskarżonego wyroku).

Since 2003, I have been accredited with Service Commun Interprétation-Conférences (DG Interpretation of the European Union) as a booth interpreter and, at that time, I began working as a freelancer for the European Council. In 2004-2006, I was an in-house interpreter with the European Court of Justice in Luxembourg. Presently, I cooperate with this institution as a freelance booth interpreter and lawyer-linguist – I have interpreted at more than one hundred hearings at the Court, translated several opinions of Advocates General, judgments and decisions.
