1. BACKGROUND
1.1 General Agreement on Trade in Services, article XIX, §1
1."In pursuance of the objectives of this Agreement, Members shall enter into successive rounds of negotiations, beginning not later than five years from the date of entry into force of the WTO Agreement [1995] and periodically thereafter, with a view to achieving a progressively higher level of liberalization. Such negotiations shall be directed to the reduction or elimination of the adverse effects on trade in services of measures as a means of providing effective market access. This process shall take place with a view to promoting the interests of all participants on a mutually advantageous basis and to securing an overall balance of rights and obligations."
1.2 Guidelines and procedures for the negotiations on trade in services (adopted by the Special Session of the Council for Trade in Services on 28 March 2001)
a) objectives :
- the negotiations shall aim to achieve progressively higher levels of liberalization of trade in services through the reduction or elimination of the adverse effects on trade in services of measures (measures = laws and other legal provisions at national, regional and local levels)
- there shall be appropriate flexibility for individual developing country Members
b) scope :
- there shall be no a priori exclusion of any service sector or mode of supply
- in negotiations on Most-Favored-Nations exemptions, appropriate flexibility shall be accorded to individual developing country Members
c) procedures :
- liberalization shall be advances through bilateral, plurilateral (between interested governments) or multilateral (involving all the WTO Members States) negotiations
- the main method of negotiation shall be the request-offer approach
- there shall be appropriate flexibility for individual developing country Members for opening fewer sector, liberalizing fewer types of transactions, progressively extending market access in line with their development situation

1. HINTERGRUNDINFORMATIONEN
1.1 General Agreement on Trade in Services, Art. XIX, Abs. 1
1. Entsprechend den Zielen dieses Übereinkommens treten die Mitglieder in aufeinanderfolgende Verhandlungsrunden ein, die spätestens fünf Jahre nach Inkrafttreten des WTO-Übereinkommens beginnen und danach regelmässig stattfinden, um schrittweise einen höheren Stand der Liberalisierung zu erreichen. Die Verhandlungen zielen darauf ab, die nachteiligen Auswirkungen von Maßnahmen auf den Handel mit Dienstleistungen zu vermindern oder zu beseitigen, um dadurch einen effektiven Marktzugang zu erreichen. Dieser Prozeß findet mit dem Ziel statt, die Interessen aller Beteiligten auf der Grundlage des gemeinsamen Nutzens zu fördern und ein insgesamt ausgeglichenes Verhältnis von Rechten und Pflichten zu gewährleisten.
1.2 Verhandlungsrichtlinien und –verfahren für den Handel mit Dienstleistungen (übernommen in der Sondersitzung des Rates für den Handel mit Dienstleistungen am 28. März 2001)
a) Zielsetzungen:
- die Verhandlungen sollen darauf abzielen, schrittweise einen höheren Stand der Liberalisierung durch die Verminderung oder Beseitigung der nachteiligen Auswirkungen von Maßnahmen auf den Handel mit Dienstleistungen zu erreichen (Maßnahmen = Gesetze und sonstige gesetzliche Regelungen auf der nationalen, regionalen und lokalen Ebene)
- einzelnen Entwicklungsländern, die Mitglieder sind, soll hinreichende Flexibilität eingeräumt werden
b) Geltungsbereich:
- kein Dienstleistungssektor oder Erbringungsart soll a priori
- aus den Verhandlungen über Ausnahmen für Meistbegünstigte Nationen ausgeschlossen werden, Entwicklungsländern, die Mitglieder sind, soll hinreichende Flexibilität eingeräumt werden
c) Verfahrensweisen:
- die Liberalisierung soll durch Verhandlungen auf bilateraler, plurilateraler (zwischen interessierten Regierungen) oder multilateraler Basis (unter Einschluss alller Mitgliedsstaaten der Welthandelsorganisation) voran gebracht werden
- als Verhandlungsmethode ist hauptsächlich der Request-Offer-Verhandlungsansatz vorgesehen
- einzelne Entwicklungsländer, die Mitglieder sind, erhalten hinreichende Flexibilität, indem ihnen die Möglichkeit eingeräumt wird, eine geringere Zahl von Sektoren zu öffnen, weniger Arten von Transaktionen zu liberalisieren und schrittweise und in Abhängigkeit von ihrem Entwicklungsstand den Marktzugang zu erweitern
