RENTAL AGREEMENT

Herein called “Landlord” and __________________________
(Passport number: __________________) herein called “Tenant”.
Landlord hereby agrees to rent to Tenant the real property located in the city of Ibiza, commencing on the ______________ until the
________________, at which time this agreement is terminated.
The price will be: _____________€ per week.
Landlord rents the above mentioned premises to Tenant on the following terms and conditions:
1. PAYMENT OF RENT
To book the property during the specified week/s a 30% of the whole amount must be paid in advance. Debit balance and security deposit shall be paid on the first day of rental. (Deposit will be reimbursed to Tenant on the last day, once the flat is checked and no damages are found, otherwise this amount shall be used to pay for any repair needed).
During July and August rental agreements will not be shorter than one week.
Prices are per-week, electricity, water, community and sewer service are included.
2. CANCELLING
If the booking was cancelled, the 30% paid in advance, would not be reimbursed.
3. APPLIANCES
The flat is rented with the following appliances: refrigerator, stove, cutlery, crockery, furnishings, sheets and towels.
4. NON-ASSIGNMENT OF RENTAL AGREEMENT
Resident agrees not to assign this agreement, nor to sub-let any part of the property, nor to do any works or changes of any kind in the building, nor to use the flat for business purposes.
Further, that covenants contained in this Rental Agreement, once breached, cannot afterward be performed; and that unlawful detainer proceedings may be commenced.
5. REPAIR POLICY
The Tenant shall use customary diligence in care of the Premises. The Tenant is encouraged to treat this as respectfully as their home. Tenant acknowledges responsibility for any damages caused by their negligence and that of their guests or invitees.
Tenant is expected to leave the flat in the very same conditions and cleanliness they found it the first day, if not, 100€ (one hundred Euros) will be deduced of the security deposit.
6. PETS
No pet shall be brought onto the Premises.
7. INVENTORY
An inventory has been provided for the Tenants use. Tenant is encouraged to report any necessary repairs or disagreements within the first 24 hours of the stay.
8. CECK IN AND CHECK OUT
Checking in will be on the first day stated on this Rental Agreement. The check out will be at the same time of the last day specified so.
9. LANDLORD AND REPRESENTATIVE
Neither the Landlord, nor his representative will have any responsibilities derived from irregularities in the electricity or water supply by the respective companies.
They will not be responsible, under any circumstances, of the discomfort due to public works or shows of any kind (public or private)
10. ACCESS TO PREMISES
The owner reserves the right to visit the Premises accompanied by another person (e.g. following Tenant). These visits may take place between 3p.m. and 4p.m.
11. FULL DISCLOSURE
The Tenant signing this Rental Contract hereby state that all questions about this Rental Agreement have been answered, that they fully understand all the provisions of the agreement and the obligations and responsibilities of each party, both of them resigning to their own codes, as spelled out herein. They further state that they agree to fulfill their obligations in every respect or suffer the full legal and financial consequences
of their actions or lack of action in violation of this agreement within Ibiza’s Court jurisdiction.

CONTRATO DE ARRENDAMIENTO
Reunidos, con fecha _____ de ___________ de 200_, los abajo firmantes: XXXX (DNI: ______ ) en concepto de arrendador, y por otra parte YYYY (PASAPORTE: _____) en concepto de arrendatario, lo hacen en su propio nombre y derecho.
El arrendador se compromete a alquilar al arrendatario su propiedad cita en ……… en la ciudad de Ibiza, comenzando dicho arrendamiento en fecha …/…/200_ y hasta el día …/…/200_, fecha en la cual este contrato expira.
El precio del arrendamiento será de _____ € por semana.
El arrendador XXXX se compromete a alquilar su propiedad a YYYY de conformidad con las siguientes cláusulas:
1_ PAGO DEL ALQUILER
Para hacer efectiva la reserva de la propiedad durante la/s semana/s especificadas, se deberá abonar un 30% del total del alquiler por adelantado. El saldo restante y la fianza serán hechas efectivas el primer día del período de arrendamiento acordado.
La fianza podrá ser devuelta al arrendatario, el último día del presente contrato, una vez verificado el buen estado de la propiedad en el momento que el arrendatario la entregue. En el caso de que la propiedad hubiera sufrido desperfectos o daños durante el tiempo de arrendamiento, el importe de las reparaciones pertinentes será descontado de dicha fianza.
Durante los meses de Julio y Agosto, los contratos de alquiler no tendrán una duración inferior a una semana.
Los precios son semanales. El consumo de agua, electricidad y alcantarillado, están incluidos en este precio.
2_ ANULACIÓN DE RESERVAS
Si la reserva fuese anulada, el pago del 30% de la reserva hecho previamente, no será reembolsado,
3_EQUIPAMIENTO
La propiedad es arrendada con el siguiente equipamiento: nevera, cocina, cubertería, vajilla, mobiliario, sábanas y toallas.
4_NO CESIÓN O TRASPASO DEL CONTRATO
La parte arrendadora acuerda no ceder, traspasar o subarrendar la propiedad, ni hacer obra de ningún tipo, ni tampoco usar la propiedad con fines comerciales.
Cualquier incumplimiento de las cláusulas de este contrato, podrán dar lugar a acciones legales por parte del arrendador.
5_POLÍTICA DE REPARACIONES
La parte arrendataria se compromete al uso diligente y respetuoso de los bienes arrendados, responsabilizándose de cualquier daño a la propiedad derivado de su propia negligencia o de la de sus invitados y/o huéspedes.
El arrendatario entregará la propiedad al final de este contrato en las mismas condiciones en que lo recibió el primer día de arrendamiento; en caso contrario, serán descontados 100€ (cien Euros) del depósito hecho por concepto de fianza.
6_MASCOTAS Y ANIMALES
No está permitido tener animales ni mascotas en la vivienda.
7_INVENTARIO
Se ha facilitado a la parte arrendataria un inventario de los contenidos de la propiedad y se alienta al arrendatario a que reporte al arrendador cualquier desperfecto o desacuerdo dentro de las primeras 24 horas de la estadía.
8_REGISTRO Y SALIDA
El registro de entrada será el primer día acordado en el presente contrato y la fecha de salida será a la misma hora, en la fecha especificada como tal en este acuerdo.
9_EL ARRENDADOR Y SU REPRESENTANTE
Ni la parte arrendadora, ni ninguno de sus representantes tendrán responsabilidad alguna derivada de irregularidades en el suministro de electricidad y/o agua por parte de las correspondientes compañías.
Tampoco serán responsables, bajo ninguna circunstancia, de incomodidades y molestias derivadas de obras o espectáculos de ningún tipo, ya sea público o privado.
10_ ACCESO A LA PROPIEDAD
El propietario se reserva el derecho a visitar la propiedad acompañado por otra persona (por ejemplo, el siguiente arrendatario). Estas visitas serán entre las 15:00 y las 16:00 horas.
11_DECLARACIÓN FINAL
La parte arrendataria abajo firmante, declara haber leído, entendido y aclarado las dudas con respecto a este contrato y declara que entiende completamente las previsiones, obligaciones y responsabilidades de cada una de las partes firmantes de este acuerdo.
De conformidad, ambas partes se comprometen a cumplir con lo acordado y a responsabilizarse tanto legal como financieramente de las consecuencias derivadas del incumplimiento o violación de lo antes especificado, ante los Juzgados de la ciudad de Ibiza.
