It defines military and dual use items as “items of strategic importance”. This term is used throughout the Act and leads to the conclusion that the procedure for obtaining the right to export under a general licence is the is the same for both military and dual-use items. Some provisions of the Act such as Articles 6(6), 9(4) and 10(1), which refer to items of strategic importance (military and dual-use items), impose an excessive burden for exporters of dual-use items. Such exporters have to make a thorough analysis of the end-user intentions to obtain to obtain a concession for trade in products and technologies used for military and police purposes and to establish an Internal Control System (ICS). These requirements contradict to the principle of proportionality.
