Although At EU level a clear distinction is made between procedures for the export of military and dual-use items, Polish Export Controls Act does not make such distinction. It defines military and dual use items as “items of strategic importance”. This term is used throughout the Act and leads to the conclusion that the procedure for obtaining the right to export under a general licence is the is the same for both military and dual-use items. Some provisions of the Act such as Articles 6(6), 9(4) and 10(1), which refer to items of strategic importance (military and dual-use items), impose an excessive burden for exporters of dual-use items. Such exporters have to make a thorough analysis of the end-user intentions to obtain to obtain a concession for trade in products and technologies used for military and police purposes and to establish an Internal Control System (ICS). These requirements contradict to the principle of proportionality. They are not necessary for the effective control of the export of dual-use items. | Translation - Polish
Chociaż na poziomie UE istnieje wyraźne rozróżnienie między procedurami dotyczącymi eksportu towarów o przeznaczeniu wojskowym i towarów podwójnego zastosowania, polska ustawa o kontroli eksportu nie wprowadza takiego rozróżnienia. Definiuje ona zarówno towary o przeznaczeniu wojskowym jak i towary podwójnego zastosowania jako „towary o znaczeniu strategicznym”. Termin ten jest stosowany w całym akcie i prowadzi do wniosku, że procedura otrzymywania prawa eksportu w oparciu o zezwolenie generalne lub procedura uzyskania zezwolenia indywidualnego lub globalnego jest taka sama zarówno dla towarów o przeznaczeniu wojskowym jak i towarów podwójnego zastosowania. Niektóre założenia Ustawy, takie jak artykuły 6 ust. 6, 9 ust. 4 i 10 ust. 1, które odnoszą się do towarów o znaczeniu strategicznym (towarów o przeznaczeniu wojskowym i towarów podwójnego zastosowania) narzucają nadmierne obciążenie dla eksporterów towarów podwójnego zastosowania.
