Source text - English The Client is the Principal of the works in the sense of CO Art. 363 et seq. 3.2 The Client shall appoint a Project Manager. The Client may designate a different person as Project Manager and, if it does so, shall notify the General Contractor of such. The Project Manager shall be the General Contractor’s primary point of contact for issues related to the Works to whom he shall confer all authority necessary to act on his behalf in connection with the Works. 3.3 The Project Manager is tasked with: a. Co-ordination of the Client's project organisation. b. Control and directive power with regard to the General Contractor. c. Co-ordination of the Client’s approval of drawings, materials and choice of colours. d. Co-ordination of the Client with respect to proposal and authorisation of modifications, including those which have an effect on costs and deadlines. e. Co-ordination of the Client with respect to the right for specification and refusal in the choice of subcontractors and suppliers. f. Co-ordination of the Client’s review, approval and clearance of payments according to contractual payment terms, authorisation to settle the final account. g. Co-ordination of the Client’s taking over of Works and enforcement of guarantees of quality. 3.4 Interested third parties associated to the Client (landlord, other tenants, bankers) shall have no representative rights with respect to the General Contractor.
