Pada April 1965, empat tahun sebelum Penentuan Pendapat Rakyat diselenggarakan, Freeport Momoran Gold and Copper, sebuah perusahaan tambang terbesar yang berpusat di Amerika Serikat, melalui anak perusahaannya Freeport Indonesia, menandatangani sebuah persetujuan awal dengan rezim Orde Baru Soeharto untuk memulai operasi di Timika, Papua Barat. Berdasarkan pada persetujuan awal ini, kontrak kerja pertama (COW-Contract of Work) ditandangani pada 1967, dua tahun sebelum penyelenggaraan penentuan pendapat dan hasilnya secara formal disetujui oleh PBB. Kontrak Kerja pada 1967 merupakan persetujuan pertama yang ditandatangani oleh rezim Orde Baru Soeharto dengan perusahaan multinasional asing. Kontrak ini diperpanjang untuk kedua kalinya, yang ditandatangani pada 1991. Banyak yang mengungkapkan bahwa karena Indonesia belum mendapatkan pengakuan secara formal kedaulatannya teritorial atas Papua Barat dari PBB, kontrak kerja pertama antara Freeport dan pemerintah Indonesia adalah ilegal. | Translation - English The Freeport Arrival in Timika, West Papua
In April 1965, four years before the People’s Opinion Determination was held, Freeport Momoran Gold and Copper, a biggest mining company centered in the United State, through its company branch coke, Freeport Indonesia, signed a preliminary agreement with Soeharto’s New Order regime to start the operation in Timika, West Papua. Based on this preliminary agreement, the first COW-Contract of Work was signed in 1967, two years before the implementation of the opinion determination and the result was formally approved by the UN. The Contract of Work in 1967 was the first agreement signed by Soeharto’s New Order regime with the foreign multinational company. This contract was extended for the second time, which was signed in 1991. Many told that because Indonesia had not achieve the formal acknowledgement of its territory sovereignty of West Papua yet from the UN, the first contract of work between Freeport and Indonesia government was illegal. NGO and the local people also stated that these two contracts of work should be cancelled or be amendment, mainly because the draft of the contract of work was not consulted to the local community.
