There is no agreement on a definition of “technology”, its relation to science, physical artifacts, goals, social practices, discourses, power or techniques (if one definition is possible); and I will not attempt to define it here.46 For the purpose of this paper, and adapting Winner’s version,47 I talk about “copyright technologies” when
referring to tools, instruments, machines, appliances, gadgets—be they physical hardware (like ISPs, CPUs, mobile devices, wires, satellites, network routers) or software (operating systems, IP/TCP, applications)— which are employed in order to affect the use, distribution or reproduction of copyrighted content. More specifically framed within the arguments here made, I refer to those information technologies that have a role to play in the accommodation of copyright paradigms. Philosophers of technology also include within their conceptions of technology, not only artifacts, but also “social practices, social relationships, and systems of knowledge” since artifacts only have meaning in the context of social interaction.
Therefore, it is useful to think of copyright technologies as components of sociotechnical systems in order to capture institutions, organization and related practices (including trade organizations, NGOs and the law) and to highlight their social dimension as “they affect us not purely by dint of physical or material properties but by properties they acquire as systems and devices embedded in larger material and social networks and
webs of meaning.” And this is surely the case with copyright technologies: While digital technologies have unleashed unprecedented amounts of unauthorized creative uses and expressive activity, contemporary socio-technical systems that regulate information goods induce a sort of colonization of speech by property and incentives.

No existe entendimiento respecto a cómo definir la “tecnología” ni su relación a la ciencia, los artefactos materiales, los objetivos, las prácticas sociales, los discursos, el poder ni las técnicas (de ser posible una definición), y tampoco buscaré definirla hoy46. Junto con la versión de Winner y la que incluyo en esta investigación, al mencionar el “copyright y la tecnología”, haré referencia a herramientas, instrumentos, máquinas, dispositivos y artilugios, se trate de hardware concreto (como ISP, CPU, dispositivos móviles, conexiones, satélites y routers de red) o de software (sistemas operativos, IP/TCP y aplicaciones) que se emplean para influir en el uso, la distribución o la reproducción de contenido bajo copyright. Las tecnologías de la información a las que me refiero son aquellas que desempeñan un papel en los acuerdos en torno a los paradigmas del copyright y se formulan de manera más específica dentro de los argumentos que se hacen en este trabajo.
Los filósofos tecnológicos también incluyen entre sus nociones acerca de la tecnología, “las prácticas y relaciones sociales, y los sistemas de conocimiento”, no solo a los artefactos, debido a que los mismos solo retienen significado en el contexto de la interacción social. Por lo tanto, es provechoso considerar el copyright y las tecnologías como integrantes de sistemas socio-tecnológicos de forma que sea posible captar instituciones, organizaciones y organismos similares (incluso organizaciones comerciales, ONG y la ley) y resaltar su dimensión social “de la manera en que tienen un efecto sobre nosotros más allá de las propiedades físicas o materiales, sino las propiedades que adquieren como sistemas y dispositivos implícitos en redes materiales y sociales aún más grandes, y los entretejidos de significado”. Seguramente es este el caso del copyright y la tecnología: mientras las tecnologías digitales han desencadenado una cantidad sin precedentes de usos creativos y actividad expresiva no autorizados, los sistemas socio-tecnológicos contemporáneos que reglamentan los bienes informativos producen una suerte de colonización de la expresión mediante la propiedad y los incentivos.
