Circa trentacinque anni fa, al tempo dei fantasiosi amori per la Cina, un viaggio in quel paese forniva spunti per altri diari e racconti. Si partiva da occidente già innamorati: non prendendo distanza da una realtà che si diceva di voler studiare, ma abolendo le distanze, non proponendosi di analizzare e discutere, ma cercando conferme alle proprie rappresentazioni. Anche allora, per motivi diversi, era “difficile avere una voce propria”.
La Cina, però, anche spogliata di ogni idealizzazione, appariva un paese diverso. In quegli anni era in corso un processo di socializzazione in tutti i campi, tendente a rendere più ampia e articolata la partecipazione alla gestione del potere e a forme di autogoverno, a rafforzare la pratica egualitaria nella distribuzione della ricchezza prodotta, a combattere gli incentivi materiali in ogni ambito di vita. La coscienza politica e la solidarietà erano presenti e visibili, in opera e in simbolo. (a) the Builder releases and discharges the Existing Buyer from its covenants, undertakings, duties, obligations and liabilities to the Builder under the Contract whether arising on or after the Effective Date;
(b) the Existing Buyer releases and discharges the Builder from its covenants, undertakings, duties, obligations and liabilities to the Existing Buyer under the Contract whether arising on or after the Effective Date;
(c) subject to Clause 6, the New Buyer agrees with the Builder and the Existing Buyer to assume all rights, title, benefits, interests, covenants, undertakings, duties, liabilities and obligations, including without limitation to, in and under the Contract, the right to buy and to take title to the Yacht and the benefit of all warranties, conditions and guarantees with respect to the Yacht and all claims and rights to damages and indemnification of the Existing Buyer arising on or after the Delivery Date and hereby undertakes to pay the purchase price of the Yacht in accordance with Clause 3, previously given or assumed by the Existing Buyer under or pursuant to the Contract in each case as if the New Buyer were a party to the Contract in place of the Existing Buyer;
(d) the Builder acknowledges that all obligations and liabilities of the Existing Buyer under the Contract which have been performed or discharged by the Existing Buyer shall, to that extent, be treated by the Builder for the purpose of the Contract as having been performed by the New Buyer;
(e) the Builder undertakes to observe and perform in favour of the Existing Buyer all of the covenants, undertakings, duties, obligations and liabilities, including without limitation the obligation to deliver and transfer title to the Yacht, previously given or assumed by the Builder under or pursuant to the Contract whether arising on or after the Effective Date as if the New Buyer were a party to the Contract in place of the Existing Buyer.
3 PAYMENT
3.1 Each of the Builder and the Existing Buyer represent and warrant to the New Buyer that, at the date of this Agreement, the Existing Buyer has paid or caused to be paid to the Builder under the Contract an amount equal to the Payment Amount.
3.2 In further consideration of the novation created under Clause 2.1, the New Buyer agrees to pay to the Existing Buyer on the Delivery Date a sum equal to the Payment Amount.
3.3 As a result of this novation, and subject to the following:
(a) the New Buyer having received an invoice for the relevant instalment of the Contract Price;
(b) the representations and warranties contained in Clauses 5.2 and 5.3 being true and accurate as of the relevant payment date by reference to the facts and circumstances then existing; and
the New Buyer (or the Supervisor on its behalf) not having rescinded the Contract pursuant to any of the provisions of the Contract,

(e) il Costruttore si prende la responsabilità di rispettare e performare in favore dell' Acquirente Esistente tutti gli accordi, le imprese, le responsabilità, gli obblighi e le colpabilita, includendo senza limiti l'obbligo di consegnare e trasferire il titolo allo Yacht, dato o assunto anteriormente dal Costruttore secondo o in concordanza con il Contratto indifferentemente se apparso durante o dopo la Data Effettiva come se il Nuovo Acquirente fosse parte del Contratto al posto dell'Acquirente Esistente.
3 PAGAMENTO
3.1 Tanto il Costruttore quanto anche l'Acquirente Esistente rappresentano e garantiscono al Nuovo Acquirente che, alla data di questo Accordo, l'Acquirente Esistente ha pagato o causato il pagamento al Costruttore secondo il Contratto, uan somma uguale alla Somma del Pagamento.
3.2 Ad onere ulteriore della novazione creata secondo la Clausola 2.1, il Nuovo Acquirente accetta di pagare al Compratore Esistente alla Data di Consegna una somma uguale alla Somma di Pagamento.
3.3 Come risultato di questa novazione, e soggetto alle seguenti:
(a) il Nuovo Acquirente avendo ricevuto una fattura per la rata rilevante del Prezzo di Contratto;
(b) le rappresentazioni e le garanzie contenute nelle Clausole 5.2 e 5.3 essendo vere ed accurate come dalla data di pagamento importante per riferimento ai fatti ed alle circostanze allora esistenti; e
(c) il Nuovo Acquirente (o Supervisore su suo conto) non avendo revocato il Contratto in conformita con qualunque delle provvisioni del Contratto, il Nuovo Acquirente sara responsabile per il pagamento al Costruttore solamente della Rata (d), la Rata (e) e la Rata (f) del Prezzo di Contratto come provvisto in conformita con l'Articolo 2 (Prezzo di Contratto e Condizioni di Pagamento) del Contratto.

Given the fact that the Italian legal procedure provides that “technicians" should be called in order to evaluate the particularly “technical” aspects of the various legal controversies, it would appear to be improper, given the very short time available for the actual technical expert appointed by the court, to stop then in order to consider in which expressed terms have the various questions been put in the preliminary statements that have preceded the Technical expert.
