ORDER GRANTING JOINT MOTION TO STAY CIVIL PROCEEDINGS PENDING CRIMINAL PROSECUTION
Before the Court is defendants’ Joint Motion to Stay Civil Proceedings Pending Criminal Prosecution, plaintiff’s opposition, and defendants’ reply. Defendants are seeking to stay the captioned matter pending resolution of related criminal proceedings ____ ___ _____, ____ ___ _____, and ____ ___ _____. The Court agrees that the stay should be granted.
In determining whether a stay is appropriate, the Court must balance the competing interests of all parties, as well as, the public interest. While the plaintiff has an interest in finding out the underlying facts of her husband’s death, even plaintiff’s proposed protective order shows the problem with letting discovery proceed – both sides will need discovery from the government and there is a public interest in the criminal prosecution proceeding without interference through discovery. A stay in its entirety is even more appropriate in this case because the defendants have already been indicted. Plaintiff’s argument that a stay is not supported by case law relies heavily on cases in which the parties had not yet been indicted. See SEC v. Dresser Indus., Inc., 202 U.S. App. D.C. 345, 628 F.2d 1368 (1980) (“the strongest case for deferring civil proceedings until after completion of criminal proceedings is where a party under indictment for a serious offense is required to defend a civil or administrative action involving the same 2 matter.” Id. at 1375-76). While recognizing the competing interests at issue, the defendants’ have an exceedingly compelling interest in preserving their constitutional rights which outweighs the prejudice asserted by the plaintiff in this case.
The stay only extends through the criminal trial court proceedings, not through appeals or post-judgment motions. This way a fair balance can be struck among the competing interests of the plaintiff, the public interest, and the defendants’ constitutional rights. ORDEN QUE OTORGA UNA PETICIÓN CONJUNTA PARA LA SUSPENSIÓN DE LOS PROCESOS CIVILES PENDIENTE AL ENJUICIAMIENTO CRIMINAL
Se presenta ante este tribunal una petición conjunta para la suspensión de los procesos civiles pendiente al enjuiciamiento criminal, la oposición de la demandante y la respuesta de los acusados. Los acusados solicitan la suspensión del presente asunto pendiente la resolución de los procesos criminales ___ ___ _____, ___ ___ _____ y ___ ___ _____ relacionados con el mismo. Este tribunal está de acuerdo que la suspensión debe otorgarse.
Para determinar si una suspensión es conveniente, el tribunal debe contrapesar los intereses opuestos de los interesados, a si como el interés público. Mientras que la demandante posee un interés de determinar los hechos fundamentales sobre la muerte de su esposo, aun la orden de protección que propone la demandante demuestra el problema sobresaliente si se permite la continuación del proceso de revelación—las dos partes necesitarán el proceso de revelación por medio del gobierno y hay un interés público de que el enjuiciamiento criminal proceda sin la interferencia que causare el proceso de revelación. Soluciones al problema de la resistencia
Como se esbozó al principio del tema, la resistencia en gérmenes que producen infecciones graves constituye un problema sanitario muy serio. No es extraño aislar cepas que son resistentes a todos los antibióticos generalmente en uso. Durante las últimas décadas se desarrollaron nuevos antibióticos, generalmente derivados de los primitivos, con actividad antibacteriana ampliada. A ello las bacterias han respondido generando nuevas versiones de los genes de resistencia. Si se tiene en cuenta que el problema de la resistencia es el resultado de la capacidad innata de las bacterias de adaptarse al medio, esto no debería extrañarnos y además permite predecir que, por muy ingeniosos que seamos diseñando nuevos antibióticos, existen pocas posibilidades de evitar la aparición de gérmenes resistentes.
El conocimiento de los mecanismos de resistencia sugirió el diseño de fármacos que inhibiesen esos mecanismos (p. ej., inhibidores de enzimas inactivantes de antibióticos). Las bacterias evolucionaron produciendo nuevas enzimas inactivantes que no eran inactivadas por los inhibidores. Se están investigando nuevas alternativas a los antibióticos para la terapia antiinfecciosa, pero es más que probable que las bacterias acaben ganando también esta batalla. Solutions to the Resistance Problem
As outlined at the beginning of this discussion, the resistance in germs that produce serious infections constitutes a very important sanitary problem. It is not unusual to isolate strains that are resistant to all antibiotics in general use. New antibiotics were developed during the last few decades, generally derived from the originals, with an increased antibacterial activity. Bacteria have responded by generating new versions of resistance genes. Keeping in mind that the resistance problem is the result of the innate capacity of bacteria to adapt to its environment, we should not find it strange, and indeed it should allows us to predict, that no matter how ingenious we are in the design of new antibiotics there are few possibilities in avoiding the emergence of resistant germs.
Knowledge of these resistance mechanisms suggested the design of drugs that inhibit such mechanisms (i.e. inactive enzyme inhibitors in antibiotics). Bacteria evolved by producing new inactive enzymes that were not inactivated by the inhibitors. New antibiotic alternatives are being investigated for anti-infective therapy, but it is more than likely that bacteria will once again win that battle. Therefore, it is more reasonable to act on the flip side of the problem – that is to say, to reduce the brutal pressure in the natural selection process that we introduce through the massive use of antibiotics. Massive and inappropriate use of antibiotics should be avoided; keeping in mind the best knowledge of the resistance mechanisms and their microbiological and genetic foundations. This should weigh heavily when determining the appropriate use of antibiotics in every case.
