Udjeli u otvorenom investicijskom fondu s javnom ponudom smatraju se vrijednosnim papirima i slobodno su prenosivi bez ikakvog ograničenja.
Sredstva otvorenog investicijskog fonda s javnom ponudom prikupljena izdavanjem i javnom prodajom udjela u fondu, te imovina stečena ulaganjem uplaćenih novčanih sredstava, uključujući prihode i prava proizašla iz imovine fonda, čine otvoreni investicijski fond s javnom ponudom, odnosno zasebnu imovinu u zajedničkom vlasništvu svih imatelja udjela u fondu. Imatelji udjela (dalje u tekstu: Ulagatelji) odgovaraju za obveze otvorenoga investicijskog fonda s javnom ponudom do visine iznosa svojega udjela u fondu.
U Republici Hrvatskoj rad investicijskih fondova i društava za upravljanje investicijskim fondovima reguliran je Zakonom o investicijskim fondovima ("Narodne novine" broj 150/2005, dalje u tekstu: Zakon), a njihovo je osnivanje i poslovanje pod nadzorom Hrvatske agencije za nadzor financijskih usluga (dalje u tekstu: Agencija).

Units in the open-end investment fund with a public offering are considered to be securities and are freely transferrable without any restrictions.
The assets of the open-end investment fund with a public offering collected via the issue of units in the fund and their sale to the public as well as the assets acquired by investing paid-in pecuniary assets, including any income and the rights arising from the assets in the fund, form the open-end investment fund with a public offering, that is to say separate assets which are owned collectively by the holders of units in the fund. Unitholders (hereinafter: Investors) are responsible for any liabilities of the open-end investment fund with a public offering in proportion to the size of their interest in the Fund.
The operations of investment funds and investment fund management companies in the Republic of Croatia are regulated by the Investment Fund Act (Official Gazette, No. 150/2005, hereinafter: Act) and their establishment and operations are supervised by the Croatian Financial Services Supervisory Agency (hereinafter: Agency).

Visto il Regolamento per la fabbricazione metrica, approvato con R.D. 12/6/1902, n. 226, modificato con D.P.R. 12/11/1958, n. 1215, e con D.P.R. 22/8/1972, n. 622;
Visto il Regolamento (CE) n. 2135/98 del 24 settembre 1998 del Consiglio che modifica ili regolament (CEE) n. 3821/85 relatativo all'appareccio di controllo nel settore dei trasporti su strada;
Visto il Regolamento (CE) n. 1360/2002 del 13 giugno 2002 della Commissione, che adequa per la settima volta al progresso techico ili regolamento (CEE) n. 3821/85 relativo all'appareccio di controllo nel settore dei trasporti su strada;
Visto ili decreto ministeriale 31 ottobre 2003, n. 361, conteente disposizioni attuative del regolamento (CE) n. 2135/98 del 24 settembre 1998 del Consiglio che modifica ili regolamento (CEE) n. 3821/85 relativo all'appareccio di controllo nel settore dei trasporti su strada;
Visto ili decreto ministeriale 10 agosto 2007 concernennte le modalita' per il rilasio delle omogolgazioni dell'apparecchio di controllo e delle carte tachigrafiche, nonche' delle autorizzazioni per le operazioni di primo montaggio e di intervento tecnico ed in particolare l'art. 3 relativo alle omologazioni;
Visto la domanda in data 11 ottobre 2007 dell aditta Pacart di Carmignano di Brenta (PD) rivolta ad ottenere il certificato di omologazione della carta termica denominata "KANZAN KLR 44";
Visto il Decreto Legislativo 30 marzo 2001, n. 165 con cui sono emanate "Norme generali sull'ordinamento del lavoro alle dipendenze delle amministrazioni pubbliche";
Visto il parere favorevole di massima espresso dal Comitato Centrale MEtrico nella riunione del 26 maggio 1992 in ordine a varianti di limitata rilevanza metrologica relativamente a strumenti metrici regolarmente ammessi alla verifcazione metrica,
DECRETA:
Articolo 1
1. Ai sensi dell'articolo 3 del decreto ministeriale 10 agosto 2007 si approva ili certificato di omologazione della carta termica denominata "KANZAN KLR 44" riportato in allegato.

S obzirom na Pravilnik o metričkoj proizvodnji, donesen 12. 6. 1902. pod br. 226, izmijenjen 12. 11. 1958. pod br. 1215 i 22. 8. 1972. pod br. 622;
S obzirom na Direktivu Vijeća 2135/98 (CE) od 24. rujna 1998. kojom se modificira Direktiva 3821/85 (CEE) o kontrolnim uređajima u sektoru cestovnog prijevoza;
S obzirom na Direktivu Komisije 1360/2002 (CE) od 13. lipnja 2002. kojom se po sedmi put u pogledu tehničkog napretka mijenja i nadopunjuje Direktiva 3821/85 (CEE) o kontrolnim uređajima u sektoru cestovnog prijevoza;
S obzirom na ministarsku uredbu br. 361 od 31. listopada 2003. koja sadrži provedbene propise vezane uz Direktivu Vijeća 2135/98 (CE) od 24. rujna 1998., a kojom se modificira Direktiva 3821/85 (CEE) o kontrolnim uređajima u sektoru cestovnog prijevoza;
S obzirom na ministarsku uredbu od 10. kolovoza 2007. kojom se regulira način izdavanja homologacija za kontrolne uređaje i papir za tahigrafe, kao i ovlaštenja za poslove prve montaže i tehničkih intervencija, posebice Čl. 3 koji se odnosi na homologaciju;
S obzirom na zamolbu od 11. listopada kojom je poduzeće Pacart iz mjesta Carmignano di Brenta (PD) zatražilo izdavanje certifikata za homologaciju termičkog papira pod nazivom „KANZAN KLR 44“;
S obzirom na zakonsku uredbu br. 185 od 30. ožujka 2001. kojom se izdaju „Općenite norme pravilnika o obavljanju poslova u okviru javne uprave“;
S obzirom na povoljno mišljenje koje je dao Središnji odbor za metrologiju na sastanku 26. svibnja 1992. u pogledu relativno ograničene metrološke važnosti metričkih instrumenata koji se redovito podvrgavaju provjeri,

Ovime ODLUČUJE:
Članak 1.
1. U smislu Čl. 3 ministarske uredbe od 10. kolovoza 2007. odobrava se izdavanje certifikata o homologaciji termičkog papira pod nazivom „KANZAN KLR 44“ koji se nalazi u prilogu.

1. The proposal for a Council Regulation on which the Court of Auditors’ opinion is requested aims to amend the Financial Regulation applicable to the 10th European Development Fund (hereinafter ‘EDF’) in order to adapt its rules to the specific nature of the European External Action Service whose existence is foreseen in Article 27(3) of the Treaty on the European Union, as modified by the Lisbon Treaty which entered into force on 1 December 2009.
2. While taking into account the specificity of the EDF, the changes proposed by the Commission are in line with the modifications brought to the Financial Regulation applicable to the general budget for the same purpose by Regulation (EU, Euratom) No 1081/2010 of the European Parliament and of the Council of 24 November 2010 amending Council Regulation (EC, Euratom) No 1605/2002 on the Financial Regulation applicable to the general budget of the European Communities, as regards the European External Action Service.
3. The new structure of the EEAS and the duties of the Head of Union Delegation will mean that he will report to two different bodies. As already mentioned in its Opinion No 4/2010, the Court notes that care will need to be taken in managing the new structure, inter alia, to avoid conflicts of priorities. The Court also has the same concerns as regards (a) the significant derogations to the Financial Regulation applicable to the 10th EDF, since subdelegations of the Commission powers of EDF implementation will be granted to authorising officers (Heads of Delegation) who will no longer belong to Commission departments; (b) the increased complexity in the financial management and reporting missions and operations of the Delegations; (c) the considerable uncertainty regarding the implementation by Union Delegations of the resources foreseen for support expenditure linked to the EDF under Article 6 of the Internal Agreement, an issue which is not clarified in the proposal.

1. Prijedlog Uredbe Vijeća za koji se traži mišljenje Revizorskoga suda ima za cilj izmijeniti i dopuniti Financijsku uredbu primjenjivu na 10. Europski razvojni fond (u nastavku teksta „EDF“) radi prilagođavanja njegovih pravila specifičnoj naravi Europske službe vanjskih poslova, postojanje koje se predviđa Člankom 27(3) Ugovora o Europskoj uniji, s preinakama koje uvodi Lisabonski ugovor, koji je stupio na snagu 1. prosinca 2009.
2. Uzimajući u obzir specifičnost EDF-a, promjene koje Komisija predlaže u skladu su s preinakama Financijske uredbe primjenjive na opći proračun koje u tu istu svrhu uvodi Uredba Europskog parlamenta i Vijeća (EU, Euratom) br. 1081/2010 od 24. studenog 2010., a kojom se izmjenjuje i dopunjuje Financijska uredba primjenjiva na opći proračun Europskih zajednica u pogledu Europske službe vanjskih poslova (engl. kratica EEAS).
3. Nova struktura EEAS-a te dužnosti šefa Delegacije značit će da će on biti odgovoran dvama različitim tijelima. Kao što je već spomenuo u svome Mišljenju br. 4/2010, Sud napominje da će trebati voditi brigu o upravljanju novom strukturom, između ostaloga radi izbjegavanja sukoba prioriteta. Sud je također zabrinut u pogledu: (a) značajnih izuzeća od Financijske uredbe primjenjive na 10. EDF, budući da se poddelegiranjem ovlasti Komisije za provođenju EDF-a dodjeljuju dužnosnicima za ovjeravanje (šefovima Delegacije), koji više neće pripadati pojedinim odjelima Komisije; (b) povećane složenosti misija financijskog upravljanja i izvještavanja te djelovanja Delegacija; (c) znatne nesigurnosti kad je riječ o uporabi resursa predviđenih za potporu izdacima povezanima s EDF-om prema Članku 6. Internog sporazuma od strane Delegacija EU-a, a to je pitanje koje se u prijedlogu ne pojašnjava.
