2. Sono oggetto di brevettazione le invenzioni, i modelli di
utilita', le nuove varieta' vegetali.
3. Sono oggetto di registrazione i marchi, i disegni e modelli, le

4. Sono protetti, ricorrendone i presupposti di legge, i segni
distintivi diversi dal marchio registrato, le informazioni aziendali
riservate, le indicazioni geografiche e le denominazioni di origine.
5. L'attivita' amministrativa di brevettazione e di registrazione
ha natura di accertamento costitutivo e da' luogo a titoli soggetti
ad un regime speciale di nullita' e decadenza sulla base delle norme

| Translation - English Art. 1.
Rights in industrial property
1. For the purposes of the present code, the term industrial property includes marks and other distinctive signs, geographical indications, denominations of origin, designs and models, inventions,
utility models, topographies of semiconductor products,
trade secrets and new plant species.
Art. 2.
Creation and acquisition of rights
1. The rights in industrial property are acquired through
patenting, registration or in any other way provided for by the present code. Patenting and registration create title in industrial property.
2. Inventions, utility models or new plant species may be patented.
3. Marks, designs and models, and topographies of semiconductor products may be registered.
4. Distinctive signs other than registered marks, trade secrets, geographical indications and denominations of origin are protected according to the conditions stipulated by law.
5. The administrative activity of patenting and registration consists of constitutive assessment and creates titles that are subject to a special regime of nullity and expiry on the basis of the provisions contained in the present code.
