1. Transparency
Improve transparency of rule-making activities to comply with World Trade Organisation (WTO) requirements.
• Provide a reasonable period for commentary and discussion before laws and regulations are implemented.
• Publish all laws and regulations prior to implementation and establish an official journal for recording all laws and regulations.
• Enforce only those laws and regulations that have been previously published.
• Cease applying unpublished instruments that predate the Legislation Law if they have not already been officially promulgated.
• Publish all court judgments on an official consolidated website.
Improve transparency of legal proceedings by abolishing the requirement for foreigners to obtain special permission to attend open court hearings.
2. Due Process
• Aim at finalising and promulgating the ‘Administrative Procedural Law’.
• Encourage relevant supervisory bodies to become more active in supervising administrative procedural irregularities.
• Incorporate due process into corruption case procedures. In particular, ensure open hearings and the publication of reasons for all such cases.
3. Inconsistency in Implementation
• Standardise implementation procedures at local levels.
• Institute concrete ‘top-down’ and ‘bottom-up’ mechanisms of supervision as a matter of priority.
• Give real power to supervisory and investigative authorities to investigate and overturn criminal or ultra vires actions by administrative bodies and ensure that the relevant officials in such bodies are not subject to threats or other influence from the bodies under investigation.
• Issue official interpretations of administrative regulations more actively and in a timelier manner, in order to determine public officials' scope of discretion and how such discretion should be exercised.
• Raise and clarify thresholds for prosecution in bribery cases.
