Los exhortos internacionales que se reciban sólo requerirán de homologación cuando impliquen ejecución coactiva sobre personas, bienes o derechos.

"Article 604.
International letters rogatory shall only need homologation (proceedings to provide a foreign judgment with executive force) when said letters rogatory require a coactive enforcement over people, assets or rights.
Letters rogatory regarding the serving of summonses, reception of evidence and other matters of mere procedural form, shall be conducted, where applicable, without initiating proceedings, and in accordance with the following rules:

COMPETENCIA DESLEAL REQUISITOS PARA QUE SE ACTUALICE LA INFRACCIÓN ADMINISTRATIVA PREVISTA EN LA LEY DE INVENCIONES Y MARCAS.
La Ley de Invenciones y Marcas en su artículo 210 señala de manera enunciativa doce actos que constituyen infracciones administrativas, por ser actos contrarios a los buenos usos y costumbres de la industria, comercio y servicios que impliquen competencia desleal, entre los que se encuentran, el efectuar en el ejercicio de actividades industriales o mercantiles, actos que causen o induzcan al público a confusión, error o engaño, por hacer creer o suponer infundadamente, la existencia de una relación o asociación entre dos establecimientos, que la fabricación de un producto se realiza bajo normas, licencia o autorización de un tercero o que se prestan un servicio o se vende un producto con autorización o licencia de un tercero (inciso b, fracción XI), de esta manera encontramos en el citado precepto dos elementos indispensables para que se actualice la infracción administrativa en él prevista, el primero se refiere a la existencia de una conducta contraria a los buenos usos y costumbres de la industria o comercio que implique competencia desleal y el segundo elemento consiste en que esa conducta cause o induzca al público a confusión, error o engaño en relación con el producto o servicio que requiere o con el establecimiento que lo ofrece:

The concept of unfair competition is extremely broad.
The distinct sections of article 213 of the Industrial Property Law contain distinct illustrative hypotheses of unfair competition, which may not be considered as limitative.
In effect, unfair competition, as regulated by said law, is not limited to the mere unauthorized imitation or use of a registered trademark.

La homologación de terminales físicos de carácter accesorio no es objeto de esta Disposición.
Asimismo esta Disposición desarrolla el procedimiento de gestión de cambios a que se refiere el artículo 8.4 del Real Decreto 1613/2011, de 14 de noviembre, por el que se desarrolla la Ley 13/2011, de 27 de mayo, regulación del juego, en lo relativo a los requisitos técnicos de las actividades de juego, complementando a lo ya dispuesto en apartado 4.13 de la Resolución de 16 de noviembre de 2011, de la Dirección General de Ordenación del Juego, por la que se aprueba la disposición por la que se desarrollan las especificaciones técnicas que deben cumplir los sistemas técnicos de juego.
Segundo.
Definiciones.

Two.
Definitions.

El procedimiento de rescisión administrativa se iniciará a partir de que XXX notifique al ARRENDADOR el incumplimiento en que éste haya incurrido, para que dentro del plazo de 5 (cinco) días hábiles contados a partir de la notificación, exponga lo que a su derecho convenga y aporte, en su caso, las pruebas que estime pertinentes.
La determinación de XXX de dar o no por rescindido el contrato deberá estar fundada y motivada; y se notificará al ARRENDADOR dentro de los 15 (quince) días hábiles siguientes a aquél en que se hubieren recibido los argumentos y pruebas o que se haya vencido el plazo estipulado en el párrafo anterior.

Rescisión por causas imputables a XXX
El ARRENDADOR solo podrá rescindir este contrato, previa declaración de la autoridad competente.
El ARRENDADOR sólo podrá demandar la rescisión, cuando por causas imputables a XXX se actualice alguno de los siguientes supuestos:
Por incumplimiento en las obligaciones de pago;
Por negligencia en el uso de los bienes arrendados;
Por no contar con los permisos, licencias o autorizaciones vigentes que estén a su cargo.
Modificación realizada en junta de aclaraciones
DÉCIMA SÉPTIMA.-
TERMINACIÓN ANTICIPADA
Ambas partes convienen en que XXX podrá dar por terminado anticipadamente el presente contrato en los siguientes supuestos: por caso fortuito o fuerza mayor;
cuando existan causas que impidan la ejecución del contrato;
y en los casos debidamente justificados, por XXX, entre los que se encuentran: cambios o cancelación del proyecto sustantivo;
insuficiencia presupuestaria;
condiciones inseguras de operación;
y falta de rentabilidad económica del proyecto al que se encuentra asignada la contratación.
En caso de que XXX determine la terminación anticipada del contrato, comunicará al ARRENDADOR la fecha en que pretenda darlo por terminado anticipadamente, por lo menos con 10 (diez) días naturales de anticipación, en el entendido de que los derechos y obligaciones de las partes se mantendrán en pleno vigor hasta que la terminación surta efectos jurídicos.
Modificación realizada en junta de aclaraciones
En caso de terminación anticipada, XXX pagará al ARRENDADOR únicamente el precio de la renta y demás conceptos erogados hasta la fecha en que sea determinada por XXX; y excepto en los casos en que la terminación anticipada derive de caso fortuito o fuerza mayor en los que no procederá pago adicional alguno, XXX pagará al ARRENDADOR los conceptos siguientes: gastos de liquidación de personal, penalizaciones por terminación anticipada de contrato(s) de renta de bodegas e instalaciones, y en su caso, la parte proporcional de la prima de seguros y/o fianzas correspondientes;
los gastos por dichos conceptos deberán ser razonables, estar debidamente comprobados y relacionados directamente con el contrato.

The administrative termination procedure shall commence with XXX notifying the LESSOR of the noncompliance incurred thereby, in order for the LESSOR to assert that in its best interests and to present, if applicable, the evidence deemed appropriate thereby, within 5 (five) working days.
The decision of XXX, whether or not to terminate the contract must be duly founded and warranted, and the LESSOR shall be informed of such decision, within 15 (fifteen) working days after the date on which the grounds and evidence were received or upon expiration of the term specified in the above paragraph.

Due to default of payment obligations;
Due to negligence in the use of the leased properties;
If XXX does not have the valid permits, licenses or authorizations for which it is responsible.

SEVENTEEN.
EARLY TERMINATION
Both parties agree that XXX may terminate this contract early in the following cases: due to acts of God or force majeure;
in case of causes impeding the execution of the contract;
in those cases, duly justified by XXX, including: change or cancellation of the principal project;
insufficient budget;
unsafe operating conditions;
and lack of financial profitability of the project to which the contract is assigned.
If XXX decides to terminate the contract early, it shall therefore inform the LESSOR of the date it intends to terminate the contract early, at least 10 (ten) calendar days in advance, in the understanding that the rights and obligations of the parties shall remain in full force until such time as the termination takes legal effect.
Amendment made at clarification meeting
In case of early termination XXX shall only pay the LESSOR the price of the rent and other items outlaid up until the termination date determined by XXX;
and, except for those cases where the early termination is due to acts of God or force majeure for which no additional payment shall ensue, XXX shall pay the following items to the LESSOR:
personnel layoff costs, penalties for early termination of warehouse and facility rental agreement(s), and, if applicable, the proportional part of the corresponding insurance and/or surety premiums;
the cost for such items must be reasonable, and duly evidenced and directly related to the contract.
