In the Criminal Procedure Law and criminal procedural laws, several criminal proceeding systems are established including: jurisdiction; withdrawal; defence representation; evidence; compulsory measures; and incidental civil actions.
i. Jurisdiction
The jurisdiction of criminal proceeding means, in accordance with the law, the division of workload and competence among the People’s Courts, the People’s Procuratorates and the public security organs in criminal process, and also the division of workload and competence of different levels of the People’s Courts for the first instance of criminal case within the judicial system. And the division of competence to accept criminal cases among the People’s Courts, the People’s Procuratorates and the public security organs is called filing case jurisdiction or authoritative jurisdiction, while the division of competence of the first instance over criminal cases among the different levels of the People’s Courts is called the trial jurisdiction.
Regarding the filing case jurisdiction, the majority criminal cases are directly filed and accepted by the public security organs, except certain types of cases directly filed to the people’s court or directly investigated by the People’s Procuratorates. Cases directly filed to the People’s Procuratorates are called prosecutor-self-investigating cases including crimes of embezzlement and bribery, crimes of dereliction of duty committed by State functionaries, and crimes involving violations of a citizen’s personal rights such as illegal detention, extortion of confessions by torture, retaliation, frame-up and illegal search and crimes involving infringement of a citizen’s democratic rights -- committed by State functionaries by taking advantage of their functions and powers, all those cases shall be placed on file for investigation by the People’s Procuratorates. If cases involving other grave crimes committed by State functionaries by taking advantage of their functions and powers need be handled directly by the People’s Procuratorates, they may be placed on file for investigation by the People’s Procuratorates upon decision by the People’s Procuratorates at or above the provincial level. Cases of private prosecution shall be handled directly by the People’s Courts which include: (1) cases to be handled only upon complaint; (2) cases for which the victims have evidence to prove that those are minor criminal cases; and (3) cases for which the victims have evidence to prove that the defendants should be investigated for criminal responsibility according to law because their acts have infringed upon the victims’ personal or property rights, whereas, the public security organs or the People’s Procuratorates do not investigate the criminal responsibility of the accused.

En el Código de Procedimientos Penales y la legislación procesal penal, se establecen diversos sistemas de procedimientos penales, que incluyen: jurisdicción, retiro, representación de la defensa, pruebas, medidas obligatorias y acciones civiles incidentales del proceso.
i. Jurisdicción
La jurisdicción del procedimiento penal significa, conforme a derecho, la división de la carga de trabajo y la competencia entre los tribunales populares, las fiscalías populares y los órganos de seguridad pública en el proceso penal, así como la división de la carga de trabajo y la competencia de los diferentes niveles de los tribunales populares para la primera instancia del caso penal dentro del sistema judicial. A la división de la competencia para aceptar casos penales entre los tribunales populares, las fiscalías populares y los órganos de seguridad pública se le llama jurisdicción de presentación de causa o autoritativa, mientras que a la división de la competencia de la primera instancia sobre los casos penales entre los diferentes niveles de los tribunales populares se le llama jurisdicción de enjuiciamiento.
Respecto a la jurisdicción de presentación de causa, la mayoría de los casos penales se presentan directamente ante los órganos de seguridad pública, que las aceptan, salvo ciertos tipos de casos que se presentan directamente ante el tribunal popular o que investigan directamente las fiscalías populares. Los casos que se presentan directamente ante las fiscalías populares se llaman casos de investigación autónoma de la fiscalía e incluyen los delitos de malversación y soborno, los delitos de abandono de deberes cometidos por funcionarios estatales y los delitos que involucren la violación de los derechos personales del ciudadano tales como la detención ilegal, la obtención de confesiones mediante tortura, venganza, tender trampas o hacer cateos ilegales, así como los delitos que involucren la infracción de los derechos democráticos del ciudadano, cometidos por funcionarios estatales que se aprovechan de sus funciones y poderes. Todos estos casos se deberán referir a las fiscalías populares para que los investiguen. En los casos que involucren otros delitos graves cometidos por funcionarios estatales que se aprovechen de sus funciones y poderes, será necesario que los manejen directamente las fiscalías populares, y se los puede referir a estas para su investigación conforme lo decida la fiscalía popular de la provincia o una autoridad de nivel superior. Los casos privados que deberán manejar directamente los tribunales populares incluyen: (1) los casos que se manejan únicamente si existe una denuncia; (2) los casos en que las víctimas tengan pruebas que demuestren que se trata de delitos menores; y (3) las causas en que las víctimas tengan pruebas que demuestren que los demandados debieran ser investigados por su responsabilidad penal conforme a derecho porque sus actos han infringido los derechos personales o de propiedad de las víctimas, cuando los órganos de seguridad pública o las fiscalías populares no investiguen la responsabilidad penal del acusado.
