Source text - Japanese 日本政府の知的財産を重視した取組は、2002年2月の小泉総理施政方針演説から始まる。「研究活動や創造活動の成果を、知的財産として、戦略的に保護・活用し、我が国産業の国際競争力を強化することを国家の目標とする。」との表明がなされ、これにより明治以来初めて「知的財産立国」が国家目標となったのである。
この表明を受け、同年11月に知的財産基本法が制定され、同基本法に基づき2003年3月には総理を本部長とし、全閣僚と民間有識者をメンバーとする知的財産戦略本部が内閣に設置された。知的財産戦略本部では、政府が取り組むべき知的財産に関する施策を網羅し、「知的財産立国」の実現に向けた工程表と位置付けられる「知的財産推進計画」を毎年度作成することとしている。この推進計画は、毎年度着実に成果を上げ、同時に情勢の変化に機敏に対応するため、民間企業で広く行われているローリング・プラン方式(中期計画を毎年点検し、見直しする方式)を採用し、これまで2003年、2004年と策定してきた。これまでに、紛争のスピード処理、判決の予見可能性(事実上の判断の早期統一)と技術等の知的財産に関する専門性への対応を高めることを目的とした知的財産高等裁判所の設置や、欧米に比べて長期化する特許審査の順番待ち期間を最終的にはゼロにするという最終目標を目指した特許審査迅速化法の制定といった大きな成果をあげている。そして、2005年6月10日には3度目の推進計画となる「知的財産推進計画2005」が策定され、「世界特許の実現」、「日本ブランドの発信」、「模倣品・海賊版拡散防止条約の提唱」など新たな課題への取組を盛り込み、実施すべき施策は約450項目となっている。
Translation - English The government's decision to tackle the issue of intellectual property started after Prime Minister Koizumi's policy speech in February of 2002. Koizumi stated, "We intend to make the issue of intellectual property a focus in the Diet, creating strategies to maintain and stimulate the growth of intellectual property through research and creativity, thus strengthening our country's global competitiveness." The last time the focus on forging a nation built on intellectual property became a focus for the Diet was the Meiji Era.
During November of the same year Koizumi made this pledge, the Intellectual Property Principal Law was enacted, with the formation of the Intellectual Property Strategic Committee the following March, based on this new law and headed by Koizumi himself. This responsibilities of this committee, comprised of all the cabinet ministers as well as knowledgeable citizens, included creating policies concerning intellectual property to guide the government, as well as fixing an annual timeline ensuring the realization of a country well endowed with intellectual property. This action plan is to be continually revisited each fiscal year, scrutinizing the results achieved, making revisions quickly in response to current conditions. The government decided to adopt this "rolling plan", which relies on annual evaluation and subsequent adjustments and is gaining more usage within the private sector, using it during 2003 and 2004.
Since its implementation, this strategy has yielded great results, including the ability to swiftly deal with disputes, the ability to foresee judicial decisions (rapid standardization of virtual decisions) and the establishment of the Intellectual Property High Court, specializing in technical and other intellectual property cases. Furthermore, compared with long waits for patent rights in North America and Europe, the enactment of the Rapid Patent Evaluation Law has successfully achieved the ultimate goal of decreasing the patents awaiting evaluation to zero.
Therefore, the "Intellectual Property Strategy 2005, drawn up on June 10th, 2005, will see the third revision to the strategy, listing about 450 items to consider policies for, including tackling current problems such as "Realizing Global Patents", "Devising a 'Japan Brand'," and "Advocating for a Treaty for Preventing the Proliferation of Forgeries and Pirating".
