La problématique de la violence dans le monde d’aujourd’hui amène à des questions multiples dans le contexte des droits de l’enfant. En République du Bénin, dans la pensée traditionnelle, l’enfant est un être de soumission, pour lequel on ne conçoit pas comme dans le contexte des droits de l’enfant créé par la Convention relative des droits de l’enfant, la Charte africaine des droits et du bien-être de l’enfant, un droit réel à la participation. Etre de soumission, mais également un être de besoins, un être à qui doit être accordé une attention spéciale pour sa protection, en famille, par la communauté et dans la toute société entière L’enfant, c’est le « Vignon [1] », le « Vignilé [2] », le « Vi-Utu [3] » ! C’est l’enfant trésor à qui on doit protection et qui ne fait ses pas que très progressivement ses pas vers l’âge adulte à la faveur des fois, de rites initiatiques très étudiés en fonction de son âge et de son degré de maturité. Il n’était pas question de livrer à l’enfant des violences inutiles, car les parents risquaient la sanction de la communauté. A titre d’exemple, la communauté n’admet pas qu’une mère laisse, même par mégarde, un enfant tomber de son dos. Elle courait, selon les milieux, le risque d’être elle-même soumise, en guise de correction, à des châtiments corporels. Aussi l’éducation était-elle communautaire et l’enfant était considérée comme devant être éduqué par toute la communauté. La situation aujourd’hui, l’état des lieux : Les coutumes ont évolué. Les temps ont changé. La désagrégation des mœurs, la désintégration des familles, la monétarisation de la société, l’économie de marché, l’urbanisation et l’industrialisation croissantes ont amené à une évolution dans les mentalités face à des besoins nouveaux à couvrir pour survivre. Bien que des droits soient reconnus aujourd’hui aux enfants, il n’est point de jour où par voie de presse ne soient présentées au Bénin des scènes horribles de violences sur les enfants, de toute nature, auxquels semblent s’habituer tout le monde, y compris les enfants. Des enfants sont victimes de violences exercées par leurs propres parents, par leurs tuteurs, les personnes ayant leur garde généralement de manière informelle. Ces violences ont également lieu surtout sur les enfants placés et les enfants victimes de traite. Quelques exemples en ce qui concerne les enfants placés et victimes de trafic ou de traite : • Une fille placée auprès d’une famille a été « repassée » avec un fer électrique parce soupçonnée par sa tutrice d’entretenir des rapports sexuels avec son mari. • Une fille pesant 58 kilos a été chargée de bagages pesant plus de 60 kilogrammes et surpassant réellement ses capacités physiques. • Pour un retard de quelques minutes dans l’exercice d’une commission, un père pour punir son enfant d’un larcin lui a brûlé les deux mains en les enfonçant dans du sable préalablement chauffé, cet enfant perd ainsi, et à vie l’usage normal de ses mains. En la República de Benin, en el marco del pensamiento tradicional, el niño es un ser de sumisión para el cual no se concibe como en el contexto de derechos del niño creado por la Convención para los derechos del niño, la Declaración africana de derechos y de bien estar del niño, un derecho real de participación. Se trata de un ser de sumisión pero ciertamente un ser de necesidades, un ser a quien debe darse una atención especial para su protección, en la familia, por la comunidad y en la sociedad entera. El niño, es el “Vignon [1]”, el “Vignilé [2]”, le “Vi-Utu [3]” ! Se trata del niño valioso a quien se le debe protección y quien sólo avanza gradualmente hacia la adultez en ocasiones mediante ritos iniciáticos muy estudiados en función de su edad y de su grado de madurez. No se trataba de evitar al niño la violencia inútil, ya que los padres se arriesgaban a la sanción por parte de la comunidad. Por ejemplo, la comunidad no acepta que una madre deje caer de su espalda a un niño aún si fuese por descuido. Dependiendo el entorno, ella correría el riesgo de verse sometida a castigos corporales con fines correctivos. Así mismo, la educación era comunitaria y como ya se mencionó, se consideraba que el niño era educado por toda la comunidad. La situación actual, el status quo: Las costumbres han evolucionado ; los tiempos han cambiado. La erosión de las costumbres, la desintegración familiar, la monetarización de la sociedad, la economía de mercado, la urbanización y la industrialización crecientes han llevado a una evolución de las mentalidades frente a las nuevas necesidades que deben cubrirse para sobrevivir. Aun cuando algunos derechos de los niños se reconocen en la actualidad, no es novedad que aparezcan en la prensa horribles escenas de violencia contra los niños en Benin. Esta violencia es de todo tipo y todo el mundo, incluso los niños, parece estar acostumbrados. Algunos niños son víctimas de violencia a manos de sus propios padres, sus tutores, las personas que generalmente cuidan de ellos de manera informal. Esta violencia tiene lugar de la misma manera sobretodo en los niños adoptados y los niños victimas de trata. Is it really impossible in the ‘bestest’ country in the world? It is therefore on this basis that the Report from the soliciting laws examination subcommittee, mainly in favor of the legalization of prostitution is articulated. It could have been titled: A trip into the Absurd. I’ll never be able to express the demoralization and immense disgust I experienced when I read this report, particularly when I respect so much the role of the members of the parliament. My first reaction would be to put the work of Jacques Grand’Maison, titled Quand le jugement fout le camp! (When judgment falls apart!) at the disposition of the representatives of NPD, BQ and PLC; but would they read it? How can they claim on this subject that « prostitution is, above all, a public health issue »! That the members of the parliament refuse to see the evidence indicating prostitution as one of the worst manifestations of the domination of one group over the other, an extreme proof of the inequality between women and men, that’s what goes well beyond comprehension!
