De rechtsgeldigheid van de elektronische handtekening
Op grond van Europese Richtlijn 99/93/EG is de Nederlandse ‘Wet elektronische handtekeningen’ van kracht. Met deze wet worden betrouwbare digitale handtekeningen nu veronderstelt even rechtsgeldig te zijn als papieren handtekeningen.
Artikel 3:15a lid 1 BW: Een elektronische handtekening heeft dezelfde rechtsgevolgen als een handgeschreven handtekening indien de methode die daarbij is gebruikt voor authentificatie voldoende betrouwbaar is, indien de toegepaste methode voor elektronische authenticatie voldoende betrouwbaar is met het oog op het doel waarvoor de elektronische gegevens werden gebruikt en op alle overige omstandigheden van het geval. De context is dus mede bepalend voor bewijskracht.
Artikel 3:15 a lid 2 van dit artikel zegt dat een elektronische handtekening betrouwbaar genoeg wordt verondersteld wanneer de handtekening op unieke wijze aan de ondertekenaar verbonden is, dat de ondertekenaar kan worden geïdentificeerd, dat de ondertekenaar de middelen waarmee hij de handtekening zet onder zijn controle heeft, en dat de handtekening zodanig is gekoppeld aan het getekende bestand dat elke wijziging achteraf kan worden opgespoord. Ook moet er gebruik zijn gemaakt van een betrouwbaar certificaat. Hierbij worden de ‘geavanceerde’ elektronische handtekeningen dus rechtsgeldig.

The legality of the electronic signature
On the basis of the European directive 99/93/EC, the Dutch ‘Law Electronic Signatures’ is in effect. With this law, reliable digital signatures are now assumed to be just as valid as signatures on paper.
Article 3:15a paragraph 1 BW: An electronic signature has the same legal consequence as a handwritten signature if the method which has been used for electronic authentication, is sufficiently reliable with regard to the goal for which the electronic data were used and in regard to all remaining circumstances of the case. Thus, the context is determinative for strength of proof as well.
Article 3:15 a paragraph 2 of this article states that an electronic signature is assumed sufficiently reliable when the signature is linked to the signatory in an unique way, that the signatory can be identified, that the signatory has the resources under his control with which he places the signature, and that the signature has been linked to the signed file in such a way that each modification can be traced afterwards. A reliable certificate must also have been used. Hereby, the ‘advanced’ electronic signatures become valid.
