Предметом данной монографии является комплекс вопросов развития систем государственного управления в сфере обороны.
Это прежде всего работа звеньев государственной машины, в которых принимаются политические решения по вопросам «войны и мира», а также военно-стратегические решения, определяющие структуру и состав вооруженных сил, их техническую оснащенность, характер и уровень оперативной и боевой подготовки и конкретные направления и формы стратегических действий в случае войны и др.
Эти вопросы являются предметом того, что автор именует стратегическим управлением. Соответственно, те компоненты государственной машины, которые обеспечивают стратегическое управление, выступают в качестве его субъекта, являются в совокупности системой стратегического управления.
Мировая история полна примеров, прежде всего, ограниченных войн. Неограниченных войн, в которых не было бы ограничений в целях и используемых средствах, велось сравнительно немного.
К неограниченным войнам можно отнести, например, пунические войны между Римом и Карфагеном III-II вв. до н.э., которые велись под лозунгом «Карфаген должен быть разрушен» и закончились полной гибелью последнего, «вычеркиванием» Карфагена из последующей человеческой истории. Тотальный характер носили и войны Чингиз-хана в XIII в. против империй тангутов и каракитаев и великой Хорезмийской державы.
В соответствии с положением о Генеральном штабе Вооруженных сил РФ, утвержденным Указом Президента РФ от 11 ноября 1998 г. № 1357, Генштаб является «центральным органом военного управления» и «основным органом оперативного управления Вооруженными Силами Российской Федерации». В отличие, например, от ГШ НОАК, в российский Генштаб входят не только управления, но и главные управления – как и в Минобороны. Это само по себе уже ставит ГШ по статусу выше других основных подразделений Минобороны РФ.
Генштаб осуществляет координацию деятельности других «силовых структур», органов и войск «по выполнению задач в области обороны». Эта прерогатива Генштаба выводит его в определенной мере за пределы Минобороны, а в чем-то и ставит выше органа, неотъемлемой частью которого должен быть Генеральный штаб.

The subject of the present study is an array of issues on state management system development in the area of defense. Primarily this is the functioning of all the elements of the government machine, where political decisions on “war and peace” are made, along with military and strategic decisions that determine the structure and contingent of the armed forces, its technical base, principles and levels of operative and combat training, as well as specific directions and forms of strategic actions in case of war, etc. These issues constitute what the author calls strategic management. Accordingly, the government machine components that support strategic management become its subject, and, as a whole, represent the system of strategic management.
The world history is predominantly abundant with examples of limited wars. There were not so many unlimited wars that had no restrictions in aims and means. The Punic Wars between Rome and Carthage in the III-II centuries BC that were conducted under the slogan "Carthage must be destroyed", can be viewed as an example of unlimited wars where they ended up with complete destruction of Carthage that was deleted from the further history of mankind. Ghengis Khan’s wars in the XIII century against the Tanguts, the Kidan dynasty, and the great Kwarezm Empire also had a character of a total war.
In accordance with the Presidential Decree on Regulations on the General Staff of the Armed Forces of the Russian Federation of November 11, 1998 No 1357, the General Staff is the “central body of military management” and the “main body of operative management of the Armed Forces of the Russian Federation”. In comparison, for example, with the General Staff of the Chinese PLA, the Russian General Staff includes not only departments, but also chief departments, same as the Ministry of Defense. This by itself raises the status of the General Staff over other subdivisions of the Ministry of Defense of the Russian Federation. The General Staff coordinates the activity of other power structures, agencies and troops to “perform the tasks in the area of defense”. This authority positions General Staff to a certain degree outside of the Ministry of Defense, and in some ways places it above the body that has General Staff as its integral part.

1. DEFINITIONS
In this Agreement (unless defined elsewhere) the following words shall have the following meanings:
For the purposes hereof Receiving Party shall mean either party but shall be limited, as regards NNN, to NNN site permanent staff unless otherwise agreed in advance and in writing.
“Information” in relation to the Purpose means, without limitation, and as the case may be, information relating to the NNN processes, and in relation to either party all commercial, financial, scientific, technical, operational or other information, and samples of paints, physical matter in solid or liquid state, compounds, formulations, components, equipment and materials, composition of raw materials, safety notices and information, in whatever form and information derived therefrom including but not limited to, all software, source or other codes, data, know-how, calculations, design, drawings, methods, processes, systems, explanations and demonstrations disclosed or otherwise made available orally or in written electronic or any other form which a Disclosing Party may agree to disclose or discloses hereunder.
“Representatives” means as to any Party its directors, officers employees authorised under this agreement to receive the Information and who has signed before receiving such Information a written confidentiality agreement as indicated below.
5 PUBLICITY
Neither Party shall make or solicit the making of any announcement or disclosure to any person (other than as necessary to its Representatives in accordance with this Agreement) of its interest in or of the fact that discussions are taking place with respect to the Purpose or as to the status thereof or that Information has been made available to the Receiving Party or its Representatives.
7. SEVERABILITY
Each undertaking contained in this Agreement shall be construed as a separate and severable undertaking. Neither Party shall assign its right to enforce all or any of the provisions of this Agreement to any person.
10. EQUITABLE RELIEF
Without prejudice to any other rights and remedies each Party acknowledges and agrees that damages alone would not be an adequate remedy for any breach of the provisions of this Agreement; accordingly, each Party agrees that the other Party shall be entitled, without proof of special damage, to the remedies of injunction, specific performance and other equitable relief for any threatened or actual breach of the provisions of this Agreement by a Party or others for which such Party is responsible pursuant to clause 3 above.
12. LAW AND JURISDICTION
12.1 This Agreement shall be governed by and construed in accordance with NNN law and by signing the enclosed copy of it the Parties irrevocably and unconditionally submit to the non-exclusive jurisdiction of the NNN courts.
12.2 No term of this agreement shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a third party nor shall it be treated as a stipulation in favour of a third party under NNN law.

В данном Договоре (если не оговаривается иначе) следующие слова будут иметь следующее значения:
Для целей настоящего Договора под Принимающей Стороной понимается любая сторона, но, в отношении NNN, ограничивается постоянным персоналом NNN, если иначе не оговорено заранее и в письменном виде.
«Информация» в отношении средств достижения Результата, без ограничений, и, сообразно обстоятельствам, информация, касающаяся процессов NNN, и, в отношении любой из сторон, вся коммерческая, научная, техническая, рабочая или другая информация, образцы красок, физические объекты в твердом или жидком состоянии, составы, рецептуры, компоненты, оборудование и материалы, состав сырья, предупреждающие надписи и информация по технике безопасности, независимо от формы и источника информации, включая, но не ограничиваясь, всем программным обеспечением, исходными или другими кодами, данными, ноу-хау, вычислениями, чертежами, рисунками, способами, процессами, системами, объяснениями и демонстрациями, переданная, или каким-либо другим образом ставшая доступной, в устной форме, или письменной электронной или какой-либо другой форме, которую Разглашающая Сторона может согласиться разгласить или разглашает в соответствии с настоящим Договором.
«Представители» означают, в отношении любой из сторон, ее директоров, должностных лиц и сотрудников, которые уполномочены, в соответствии с настоящим Договором, получать Информацию, и которые подписали, до получения такой Информации, письменное соглашение о неразглашении конфиденциальной информации, как указано ниже.
5 ПУБЛИЧНОЕ ИСПОЛЬЗОВАНИЕ ИНФОРМАЦИИ
Ни одна из Сторон не объявит или не будет способствовать какому-либо объявлению или разглашению какому-либо лицу (помимо тех случаев, когда это необходимо, своим Представителям в соответствии с настоящим Договором) своего интереса или того факта, что имеют место переговоры в отношении Задач, или в отношении их статуса, или в отношении того, что Информация была предоставлена Получающей Стороне или ее Представителям.
7. ДЕЛИМОСТЬ ДОГОВОРА
Каждое обязательство, содержащееся в настоящем Договоре, истолковывается как независимое и раздельное обязательство. Ни одна из Сторон не возьмет на себя право применить все или какие-либо отдельные положения данного Договора в отношении какого-либо лица.
10. СРЕДСТВО СУДЕБНОЙ ЗАЩИТЫ ПО ПРАВУ СПРАВЕДЛИВОСТИ
Не ущемляя какие-либо другие права и средства судебной защиты, каждая Сторона признает и соглашается, что возмещение убытков как таковых не будет адекватным средством судебной защиты в отношении какого-либо нарушения положений настоящего Договора, и, соответственно, каждая Сторона соглашается, что другая Сторона получит право, без предоставления доказательств фактических убытков, определяемых особыми обстоятельствами дела, на средство судебной защиты в виде судебного запрета, реального исполнения и других средств судебной защиты по праву справедливости в отношении любого потенциального или фактического нарушения положений настоящего Договора какой-либо из Сторон, или кем-либо другим, за которые данная Сторона несет ответственность в соответствии со статьей 3 выше.
12. ЗАКОНОДАТЕЛЬСТВО И ЮРИСДИКЦИЯ
12.1 Настоящий Договор регулируется и толкуется в соответствии с законодательством NNN и, подписывая прилагаемую копию Договора, Стороны безоговорочно и безусловно подпадают под неисключительную юрисдикцию судов NNN.
12.2 Ни одно из условий настоящего соглашения не может быть применено в соответствии с Законом о Контрактах (Права третьих сторон) от 1999 г. какой-либо третьей стороной и, в соответствии с законодательством NNN, не может рассматриваться как договор в пользу какой-либо третьей стороны.
