B Tilbudsregler
B1.1. Alminnelige tilbudsregler
Lov om offentlige anskaffelser av 16. juli 1999, nr 69 med lov om endringer 30 juni 2006 nr. 41, samt forskrift om offentlige anskaffelser av 7. april 2006, nr 402 med senere endringer gjelder.
B1.2. Endringer og administrative bestemmelser
Følgende tekster tas inn som tillegg til de korresponderende bestemmelsene i forskrift om offentlige anskaffelser:
1. Endelig frist for mottak av tilbud, § 8-1 (1)c. (del II) / § 17-1 (1) c. (del Ill)
Tilbud er rettidig levert dersom det er kommet frem til innleveringsstedet før tilbudsfristens utløp.
2. Bruk av tekniske spesifikasjoner, § 8-3 (del II) / § 17-3 (del Ill):
Som teknisk beskrivelse gjelder "Prosesskode 1, Standard beskrivelsestekster for vegkontrakter" og "Prosesskode 2, Standard beskrivelsestekster for bruer og kaier", eventuelt spesiell teknisk beskrivelse. NS 3420 gjelder bare i den utstrekning dette fremgår av konkurransegrunnlaget.
3. Utlevering og tilbakelevering av konkurransegrunnlaget:
De som tilbudsinnbydelsen er rettet til, skal få utlevert det antall eksemplarer av konkurransegrunnlaget eller deler av dette som er nødvendig for å gi tilbud og innhente tilbud fra underentreprenører.
Når mengdeliste (prosess-element) utleveres på datadiskett eller elektronisk post med NS 3459 format, leveres normalt tilbake diskett med enhetspriser sammen med datautskrift.
Mengdefortegnelsen er skrevet i Gprog Beskrivelse. Den blir utlevert i sin helhet i filtypene NS3459 utg 3 (*.xml) / NS3459 utg 1 / Gprog Linker (*.gab) som en del av konkurransegrunnlaget.
*.gab-filen kan åpnes ved hjelp av programmet Gprog Linker som kan lastes ned i en gratisversjon fra http://www.nois.no/.
Ved innlevering av tilbud bør entreprenøren levere tilsvarende priset mengdefortegnelse på diskett/CD, som NS 3459 utg 3 fil, NS 3459 utg 1 fil eller som Gprog Linker (*.gap) fil, i tillegg til utfylt/utskrevet mengdefortegnelse på papir.
Ved uoverensstemmelse mellom konkurransegrunnlag og opplysninger på EDB-medium gjelder konkurransegrunnlaget.
4. Befaringer
Befaring kan avholdes for å gi nærmere opplysninger om oppdraget. Til slike befaringer innkalles samtlige som har mottatt konkurransegrunnlaget. Befaring skal holdes i tilstrekkelig tid før tilbudsfristens utløp. Referat fra befaringen sendes uten ugrunnet opphold til samtlige som har mottatt konkurransegrunnlaget.
5. Rettelse, supplering eller endring av konkurransegrunnlaget: § 8-2 (del II) / § 17-2 (del Ill):
Det forutsettes at tilbyderen setter seg inn i forhold som kan ha betydning for anlegget og den måte arbeidet tenkes gjennomført på. Han kan ikke senere gjøre gjeldende forhold han burde blitt oppmerksom på.
Dersom en tilbyder oppdager mangler eller uklarheter i konkurransegrunnlaget som har betydning for prissettingen eller ferdigstillelsesdatoen, plikter han umiddelbart å varsle byggherren om dette.
Alle skriftlige endringer av konkurransegrunnlaget skal det tas hensyn til i tilbudet. Melding skal være sendt i rimelig tid, og senest 1 uke, før tilbudsfristens utløp.

B TENDER REGULATIONS
B1.1. General tender regulations
The Public Procurements Act of 16 July 1999 no. 69, the Act modifying this of 30 June 2006 no. 41, as well as the Public Procurement Regulation of 7 April 2006 no. 402 with later amendments, are all applicable.
B1.2. Amendments and administrative stipulations
The following texts are included as an enclosure document to the corresponding provisions in the Public Procurement Regulation:
1. Final deadline for receiving tender bids, § 8-1 (1) c. (part II) / § 17-1 (1) c. (part Ill)
The bid is considered delivered on time if it arrives at the delivery location before the bidding deadline expires.
2. Use of technical specifications, § 8-3 (part II) / § 17-3 (part Ill):
"Process Code 1, Standard description text for roadway contracts" and "Process Code 2, Standard description texts for bridges and quays" are used for technical descriptions of the project, in addition to any other special technical descriptions. NS 3420 is only applicable to the extent stated by the Document for Competitive Dialogue, and information on which the bidding competition is based.
3. Distribution and return of the Document for Competitive Dialogue:
Companies which are to receive an invitation to tender shall be sent the number of copies of the Document for Competitive Dialogue or parts of this that are considered necessary to enter a bid and gather offers from sub-contractors.
When the List of Quantities (process elements) is distributed on a floppy disk or by electronic mail in NS3459 format, the disk is normally returned with unit prices, together with a computer printout.
The Bill of Quantities is written in Gprog Description. It is distributed in its entirety in file types NS3459 version 3 (*.xml), NS3459 version 1 or Gprog Linker (*.gab), as a part of the Document for Competitive Dialogue.
The *.gab file can be opened using Gprog Linker, which may be downloaded free-of-charge from http://www.nois.no/.
When returning the bidding offer, the contractor should include the corresponding Bill of Quantities with prices on a disk/CD, as NS3459 version 3 file, NS3459 version 1 file, or as a Gprog Linker (*.gap) file, in addition to the filled-in/printout of the Bill of Quantities in paper format.
In case of any discrepancies between the Document for Competitive Dialogue and information found on an EDB medium, the Document for Competitive Dialogue is given priority.
4. Inspections
Pre-bidding inspections may be held to give further information about the assignment. For such an inspection, all those who have received the Document for Competitive Dialogue will be invited. The inspection will be held in reasonable time before the bidding deadline expires. Minutes from the inspection will be sent without undue delay to all those who receive the Document for Competitive Dialogue.
5. Corrections, supplemental information or alterations to the Document for Competitive Dialogue: § 8-2 (part II) / § 17-2 (part Ill):
It is expected that the bidder understands any conditions that might be of consequence for construction works and operations and the manner in which these works are thought to be carried out. He may not assert conditions or terms at a later time which he should have been aware of.
If a bidder discovers lacks, deficiencies or ambiguities in the Document for Competitive Dialogue which might be significant to pricing or completion dates, he is then obligated to notify the developer about this immediately.
All written changes to the Document for Competitive Dialogue must be dealt with in the contractor's bidding offer. Notifications of this kind should be sent within a reasonable period of time no later than 1 week before the expiration of the bidding deadline.
