English to Italian: XXXX PROFITS FROM TAX PROVISIONS
Source text - English Profits equivalent to up to half the earnings growth of XXXX, the drugs giant, in the two years to June XXX were generated from complex tax accounting, according to inquiries into XXXX's multi-billion pound network of subsidiaries in Singapore, Bermuda and Switzerland.
The inquiries have revealed the huge benefit XXXX has enjoyed from tax accounting over a period that included the XXXX takeover.
Accounts recently filed in Singapore show how tax provisions have been released and have boosted the group's post-tax profits by £132m.
The release of provisions is legitimate and in line with current accounting standards.
A spokesman for XXXX said: "It is widely known that XXXX has derived legitimate tax benefits from its Singapore operations."
"The company accounts have consistently stated that adequate provision has been made for taxation liabilities."
The Singapore subsidiaries are also thought to have played a significant role in the £9.1bn acquisition of XXXXX, the largest takeover in United Kingdom corporate history.
A British company called XXXXX, formed in October XXX, played a key role in
channelling funds from the Singapore companies into the UK.
Documents show that £2bn, equivalent to one third of the cash which XXXX paid for XXXXX, was injected into XXXXX by the Singapore operation three months after the takeover.
In unrelated operations, the Singapore companies are embroiled in an Inland Revenue High Court action which could involve hundreds of millions of pounds.
XXXX announced a £92m increase in attributable profits on continuing operations in the year to June 1994 and £163m the following year. The release of tax deferrals on foreign investment income realised £42m in 1994 and £90m in the next 18 months.
Provisions and releases for deferred tax are a notoriously arcane area of financial reporting and their impact can be difficult for analysts and investors to predict. This is because they do not necessarily follow the profit trends of the pharmaceutical industry.
The boost to XXXX's profits arose because of the huge sums of cash that are accumulated and invested by the Singapore subsidiaries.
In particular they lent substantial sums to XXXX's treasury company which used to be based in Bermuda. In XXX XXXX announced a loss on its bond investment portfolio which eventually reached £115m.
This was followed by a refinancing from XXXX's Swiss and Singaporean companies. After this the Bermuda treasury company switched its activity to the UK where any future interest costs and losses could be tax deductible.
The Singapore companies are paid interest on the money they lend to other parts of the XXXX group. However, according to the accounts of the Singapore companies they do not have to pay Singapore tax on the interest income if they never bring the income onshore.

Si pensa inoltre che le compagnie controllate basate a Singapore abbiamo ricoperto un ruolo centrale nell’acquisizione della compagnia XXXXX per il valore di 9.1 miliardi di sterline; il rilevamento più impegnativo nella storia aziendale della Gran Bretagna.
Una compagnia britannica, XXX , costituita nell’ottobre del XXXX, ha svolto un ruolo chiave nel canalizzare i fondi dalle compagnie a Singapore verso il Regno Unito.
I documenti mostrano che 2 miliardi di sterline, l’equivalente di un terzo della somma versata da XXXX per la compagnia XXXX, furono versati tre mesi dopo l’acquisizione di quest’ultima nei conti di XXXXX in seguito all’operazione contabile realizzata a Singapore.
Relativamente ad altre operazioni non correlate con l’acquisizione di XXXX, le compagnie di Singapore sono coinvolte in un procedimento da parte del Inland Revenue High Court (del Fisco) che potrebbe riguardare centinaia di milioni di sterline.
XXXXX ha annunciato un incremento di 92 milioni dei profitti attribuibili alle operazioni correnti dal giugno 1993 fino al giugno 1994 e di 163 milioni di sterline nell’anno seguente. A chief constable was not entitled to make a blanket order banning a probationary solicitor’s representative from attending police stations within the force’s area to advise persons in custody.
However, he could advise his officers that a particular representative was likely to hinder an investigation and the appropriate officer in a specific case could then decide whether he should be excluded.
The Court of Appeal so held in a reserved judgment allowing an appeal by the applicant, XXXXX, against the refusal of Mr Justice XXX in the Queen’s Bench Division on July XXX to quash the decision of the Deputy Chief constable of XXXX Police, taken on behalf of the chief constable on September XX, XXXX, to ban the applicant from attending as a probationary solicitor’s representative at any police station within the force’s area.
Mr XXXXX, QC and Mr XXX for Mr XXXX; Mr XXXX, QC and Mr XXXX for the chief constable.
The Lord Chief Justice said that the applicant was a former officer of the XXX Police.
In August XXX he was dismissed following allegations of sexually discriminatory comments. He had consistently denied the allegations and was pursuing an appeal to the Home Office.
The applicant had obtained employment with a firm of solicitors as a probationary solicitor’s representative.
The deputy chief constable had decided that the applicant was not to be admitted to any police station in XXXXX to act as a solicitor’s representative pending determination of his appeal.
The reasons for the decision were:
(i) He had an outstanding Home Office appeal
(ii) If successful, he could be reinstated as a police officer. It was therefore inappropriate for him to be acting for suspects
(iii) He was dismissed on a serious charge of misconduct. The chief constable had preferred the evidence of the female officer to that of the applicant. There was serious question therefore as to his honesty and whether he was a suitable character to provide legal advice.
(iv) If admitted to police stations he would have access to witnesses who gave evidence against him. There was therefore a risk of prejudice to the appeal process.
(v) The applicant had indicated his personal feelings towards the force. There was a real risk of an investigation being prejudiced as a result.
(vi) As a man dismissed from the force for misconduct there was unlikely to be any trust or respect between investigating officers and the applicant in his capacity as a legal advisor.
(vii) The risk of prejudice was the greater where officers who gave evidence against him were the officers in charge of an investigation against the subject.
(viii) The decision to exclude the applicant was consistent with Code C 6.12 and 6.13 of the Police and Criminal Evidence Act 1984 (s.66) Codes of Practice.

Non è stata riconosciuta ad un capo di polizia l’autorità di emanare un ordine di interdizione per proibire ad un consigliere legale di frequentare le stazioni di polizia nell’area di giurisdizione della forza d’ordine, luogo in cui il consigliere si sarebbe dovuto recare al fine di fornire assistenza legale ai detenuti.
Il capo di polizia però, potrebbe avvertire i suoi agenti che un particolare consigliere legale avrebbe potuto intralciare un’investigazione e l’agente in carica di questa potrebbe poi decidere relativamente al caso specifico se escludere oppure no, tale consigliere.
Questo viene affermato nelle motivazioni della sentenza pronunciata dalla Corte d’Appello che accoglie l’appello del richiedente, XXXXX, contro la sentenza, pronunciata dal magistrato XXX nella Queen’s Bench Division nel giorno XXX Luglio XXXX. In tale sentenza, il magistrato XXXX rifiuta di annullare la decisione del vice capo della polizia di XXXX, presa a nome del capo di polizia il giorno XX Settembre XXXX, di vietare al richiedente la frequentazione di ogni stazione di polizia, nell’area di giurisdizione della forza d’ordine, nelle vesti di consigliere legale provvisorio.
Mr XXXXX, QC (avvocato presso la regina) e Mr XXXXX a rappresentanza di Mr XXXXX; Mr XXXXX, QC (avvocato presso la regina) e Mr XXXXXXXX a rappresentanza del capo della polizia.
Il magistrato ha affermato che il richiedente ha lavorato in precedenza come agente di polizia nella forza di polizia di XXXXXX.
Era stato licenziato dalla forza di polizia nell’agosto del XXXX, in seguito ad accuse rivoltegli in merito a commenti, pronunciati dal richiedente, discriminatori dal punto di vista sessuale. Egli aveva sempre negato le accuse e aveva fatto ricorso in appello alla Home Office (Distretto centrale di polizia).
Il richiedente era stato poi assunto da una compagnia di avvocati come consigliere legale provvisorio.
Il vice capo di polizia sulla base del fatto che la decisione relativa al suo ricorso in appello era ancora pendente aveva deciso che il richiedente non sarebbe stato ammesso in qualsiasi centrale di polizia in XXXXXX come consigliere legale.
Le motivazioni per tale decisione erano le seguenti:
(i) Egli aveva un ricorso in appello alla Home Office ancora pendente.
(ii) Se vincitore dell’appello, avrebbe potuto essere reinserito come agente di polizia. Non sarebbe quindi stato appropriato per lui fornire assistenza a sospetti.
(iii) Era stato licenziato in seguito ad una seria accusa di cattiva condotta. Il capo di polizia aveva accettato le evidenze presentate dall’agente di polizia donna contro quelle del richiedente. Si poneva quindi anche il problema di un precedente serio in merito alla discutibilità della sua onestà e se egli avesse una personalità adeguata per fornire assistenza legale.
(iv) Se ammesso nelle stazioni di polizia avrebbe potuto avere contatto con testimoni a lui contrari. C’era quindi il rischio di influenzare il processo d’appello.
(v) Il richiedente aveva espresso i suoi sentimenti personali a riguardo della forza di polizia. Come conseguenza, si riscontrava un rischio reale che un’investigazione ne potesse essere influenzata.
(vi) Sarebbe venuto a mancare ogni rapporto di fiducia o rispetto tra gli agenti responsabili delle investigazioni e l’applicante nelle vesti di consigliere legale, essendo questi stato licenziato dalla forza di polizia per cattiva condotta.
(vii)I casi investigativi maggiormente a rischio di essere influenzati dalla presenza del richiedente erano quelli in cui agenti, che avevano testimoniato contro di questi, erano in carica di un’indagine su tale soggetto.
(vii) La decisione di non ammettere il richiedente era stata presa in rispetto degli articoli del Codice C 6.12 e 6.13 del Police and Criminal Evidence Act 1984 (s.66)Codes of Practise. (Legge di Polizia e Prove criminali e codici di condotta).
