Source text - Russian Компания [...] (далее – истец) обратилась в Арбитражный суд города Москвы с иском к обществу с ограниченной ответственностью [...] (далее, ответчик) о взыскании 120 000 руб. Компенсации за нарушение исключительных имущественных авторских прав истца на программу для электронно-вычислительных машин компьютерной игры «Cribbage Quest». К участию в деле в качестве третьих лиц, не заявляющих самостоятельных требований относительно предмета спора, привлечены [...]. Решением суда первой инстанции от 25.10.2010 по делу [...] в удовлетворении исковых требований отказано.
Не согласившись с принятым решением, истец подал апелляционную жалобу, в которой просит состоявшийся по делу судебный акт отменить и принять новый судебный акт об удовлетворении исковых требований.
Представитель истца, явившийся в судебное заседание, поддержал доводы апелляционной жалобы, просил ее удовлетворить.
Представитель ООО [...] и [...] возражал против доводов апелляционной жалобы, просил оставить решение суда без изменения.

Девятый арбитражный апелляционный суд, проверив в судебном заседании в соответствии со статьями 266, 268 Арбитражного процессуального кодекса Российской Федерации законность и обоснованность принятого по делу решения, обсудив доводы апелляционной жалобы, выслушав представителей лиц, участвующих в деле, исследовав материалы дела, пришел к выводу о том, что оснований для отмены решения Арбитражного суда города Москвы от 15.10.2010 не имеется.
Согласно пункту 1 статьи 1229 Гражданского кодекса Российской Федерации гражданин или юридическое лицо, обладающее исключительным правом на результат интеллектуальной деятельности или на средство индивидуализации (правообладатель), вправе использовать такой результат или такое средство по своему усмотрению любым не противоречащим закому способом. Правообладатель может распоряжаться исключительным правом на ресультат интеллектуальной деятельности или на средство индивидуализации (статья 1233), если настоящим Кодексом не предусмотрено иное.
Как следует из материалов дела, 15.10.2004 между [...], подразделением [...] (компания) и [...] Лимитед (дистрибьютор) было заключено лицензионное и дистрибьюторское соглашение, согласно которому компания желает осуществлять сбыт определенных продуктов компьютерного программного обеспечения, а дистрибьютор выразил заинтересованность в осуществлении локализации и/или деятельности в качестве независимого дистрибьютора определенных продуктов компании в соответствии с условиями и положениями настоящего договора.
Согласно статье 1235 Гражданского кодекса Российской Федерации по лицензионному договору одна сторона – обладатель исключительного права на результат интеллектуальной деятельности или на средство индивидуализации (лицензиар) предоставляет или обязуется представить другой стороне (лицензиату) право использования такого результата или такого средства в предусмотренных договором пределах.

By a trial court decision issued on October 25, 2010 in Case No. А40-77365/08-5-742, the claim was denied. Disagreeing with the trial court, the Plaintiff appealed to this court asking to vacate the decision and issue another one to satisfy the claim.
The Plaintiff’s representative appeared before this court, supported the arguments of the claim, and requested a decision in favor of the Plaintiff. The representative of [...] objected to the claim and asked to leave the trial court decision intact.

Per Section 1229.1 of the Civil Code of the Russian Federation, a citizen or a legal person, who holds an exclusive right to intellectual property or to a means of identification (i.e., the rights holder), has the right to use such property or such means in any way which does not violate the law. A rights holder may dispose of an exclusive right for intellectual property or means of identification (Section 1233) unless otherwise prescribed by the Code.

To answer this question, the New Times looks at the life and death of Muslim Khamzaev.
Muslim Khamzaev, of Khasavyurt, Dagestan, died on December 2, 2009. The news reports were brief: After firing at officers, a 23-year old militant, Muslim Khamzaev, aka Khamza, was killed during an attempt to take him into custody. According to the press release by the Department of Internal Affairs’ Office in Dagestan, “During a standoff with officers of the Federal Security Service and the Department of Internal Affairs, Khamzaev was surrounded in his home on Korkomasov Street and ordered to surrender. Instead, he opened fire from an automatic rifle, threw a grenade towards the officers, and tried to escape. He was fatally shot on a construction site on Kandaurovskaya Street. At the scene they found an automatic rifle AK-74, a handgun made out of a pepper spray IZ-79 but capable of firing real ammunition, two grenades, and more than 300 rounds of various calibers.”
