The Emergence of the Post-Soviet World
The collapse of the USSR and the resulting creation of fifteen post-Soviet states were obvious consequences of the defeat of Moscow in the Cold War. At the same time, the continuing processes in the territory of the former Soviet empire have caused some significant changes in the foreign policy strategies of the Western democracies, particularly of the United States and Germany, which were the most active actors in Eastern European politics.
Over many decades of the twentieth century, the diplomatic strategy of Washington and the European capitals was focused on developing a meaningful interaction with Moscow. Moreover, all changes (even insignificant) of the political situation in the Kremlin were subject to careful and detailed analysis in the research and intelligence centers of Europe and America. Therefore, it is possible to say that the Soviet leaders were the usual and anticipated partners for the Western democracies until the collapse of the USSR.
But the process of perestroika initiated by Mikhail Gorbachev awakened powerful national-democratic movements in the Soviet republics, which came to power in 1989–90 in Lithuania, Latvia, Estonia, Armenia, Moldova, and Georgia. In addition to these independence movements, the increasing openness within the Soviet Union fostered the development of influential opposition movements that countered the communist governments of Ukraine, Belarus, Azerbaijan, and some of the republics of Central Asia.
The formation of such political movements represented a real challenge for the foreign policies of Western nations. On the one hand, the United States and European countries welcomed the growth of democracy on the periphery of the Soviet empire and established close contacts with these forces, which were striving without doubt for both economic and political independence from Moscow. But, on the other hand, obvious and permanent support for these opposition movements from Western states had the potential to cause problems personally for Mikhail Gorbachev, who faced a growing counteraction from the hard-liners in the Communist Party and the Soviet security and military structures.

Образование таких политических движений стало для западной внешней политики настоящей проблемой. С одной стороны, Соединенные Штаты и Европа приветствовали рост демократии на окраинах советской империи и устанавливали тесные связи с этими силами, выступавшими как за экономическую, так и политическую независимость от Москвы. Но с другой стороны, явная и непрекращающаяся поддержка Западом этих оппозиционных движений могла поставить в трудное положение лично Михаила Горбачева, столкнувшегося с растущим противодействием твердых сторонников прежнего курса в Коммунистической партии, органах государственной безопасности и военных структурах.

The combination of the aging of the population in many countries, and improved survival after acute myocardial infarction (AMI) has created a rapid growth in the number of patients currently living with chronic heart failure (CHF), with a concomitant increase in the number of hospitalizations for decompensated heart failure. Coronary heart disease is the aetiology of AHF in 60-70% of patients, particularly in the elderly population. In younger subjects, AHF is frequently caused by dilated cadiomyopathy, arrhythmia, congenital or valvular heart disease, or myocarditis. The causes and complications of AHF are described in Table 1.
The management of heart failure consumes 1-2% of health care expenditure in European countries, with around 75% relating to inpatient care. Advanced heart failure and related acute decompensation have become the single most costly medical syndrome in cardiology.
Patients with AHF have a very poor prognosis. Mortality is particularly high in patients with acute myocardial infarction (AMI) accompanied by severe heart failure, with a 30% 12 month mortality. Likewise, in acute pulmonary oedema a 12% in-hospital and 40% 1 year mortality have been reported.
About 45% of patients hospitalized with AHF will be rehospitalized at least once (and 15% at least twice) within twelve months. Estimates of the risk of death or rehospitalization within 60 days of admission vary from 30 to 60%, depending on the population studied. | Translation - Russian

I - Le principe du secret professionnel
Rappel des textes : A l’occasion de la réforme intervenue en 1994, l’article 378 de l’ancien Code pénal a été remplacé par un article 226-13, dont la formulation est très proche.
Selon cet article, la révélation d’une information à caractère secret par une personne qui en est dépositaire soit par état ou par profession, soit en raison d’une fonction ou d’une mission temporaire est punie d’un an d’emprisonnement et de 15.000 € d'amende.
Le secret professionnel est donc une obligation dont la violation est sanctionnée pénalement.
C’est aussi une obligation déontologique rappelée par le règlement national du notariat approuvé par arrêté du garde des sceaux du 20 avril 1988.
L’article 7 du règlement national indique en effet que le notaire, confident nécessaire de ses clients, est tenu au secret professionnel dans des conditions prévues par le Code pénal, et que ce secret couvre tout ce qui est venu à la connaissance du notaire dans l’exercice de sa profession.
▪ La notion de secret
- Quelles informations sont couvertes par le secret professionnel ? Les premières décisions judiciaires, rendues au milieu du XIX ème siècle, considéraient qu’il ne suffisait pas, pour que le notaire soit tenu au secret professionnel, que le fait soit parvenu à sa connaissance dans l’exercice de ses fonctions : il devait aussi lui avoir été confié sous le sceau du secret.
Cette conception restrictive a été rapidement abandonnée.
Selon la formule souvent adoptée dans la jurisprudence, reprise par le règlement national du notariat, le secret professionnel touche tout ce qui est parvenu à sa connaissance dans l’exercice de sa profession.
Mais il est certain aussi qu’il existe une graduation dans l’intensité du secret professionnel.
Cette intensité varie selon que la révélation demandée porte sur le contenu d’un acte qui sera souvent publié et qui a un certain caractère public, ou sur une correspondance qui se trouve dans le dossier du client et n'a pas à être communiquée, ou sur des informations très confidentielles que le client a pu délivrer au notaire.
- A l’égard de qui joue le secret professionnel ?
Le secret professionnel joue bien sûr à l'égard des tiers à l'acte notarié.
La notion de tiers pose parfois question, par exemple lorsque la demande émane d'un créancier du client ou d'un héritier de celui-ci.
Le secret professionnel joue certainement à l'égard des créanciers.
L'héritier est en revanche le continuateur de la personne du défunt. Il peut avoir connaissance des actes sans passer par une procédure particulière.
En dehors des actes, les renseignements que le notaire peut délivrer à l'héritier dépend des intentions du défunt et de la nature de ce qui est demandé.
Même continuant la personne du défunt, l'héritier n’a pas un droit absolu de tout connaître de ses affaires.
Il faut distinguer les informations de nature patrimoniales, où la communication est la règle, et les informations de nature extra-patrimoniales, où le secret peut continuer à s’appliquer.
C'est la volonté expresse du défunt, et le respect de sa mémoire, qui doit guider l’attitude du notaire.
- Le consentement du client supprime t-il le secret ? Le notaire peut-il être délié du secret par le client lui-même ? Selon la position la plus radicale, le consentement du client ne délie pas le professionnel de son obligation au secret.
Cette solution, qui vient d'être rappelée par la Cour de cassation, est difficile à appliquer en pratique.
On peut aussi considérer que le consentement du client fait disparaître la nature confidentielle de l'information.
Lorsque plusieurs personnes sont concernées par une information, comme c'est le cas lors de discussions menées avant une opération, elle ne pourra en tout état de cause être révélée qu’avec l’accord de tous les intéressés.
- Secret professionnel et devoir de conseil.
Le devoir de conseil est une obligation caractéristique de la fonction notariale.
Selon l’article 5 du règlement national, le notaire doit apporter à sa clientèle l’information la plus complète.
Un conflit entre le devoir de conseil et le secret professionnel peut intervenir : le notaire unique d’une opération peut-il révéler à une partie une information concernant l’autre partie, comme par exemple son insolvabilité ? Le secret professionnel ne s’efface pas devant le devoir de conseil, il doit se concilier avec lui.
Il n’y a pas de hiérarchie entre les obligations, c’est un problème d’équilibre assez délicat.
Le notaire doit veiller à la loyauté du contrat, et refuser d’instrumenter en cas de fraude.
▪ Communication des actes
Le notaire est un dépositaire d’actes publics.
Il est souvent sollicité pour communiquer un acte de l’étude.
En la matière il existe un texte spécifique, l’article 23 de la loi du 25 ventôse an XI dont la rédaction actuelle date d’une loi du 25 juin 1973.
Selon cet article, les notaires ne peuvent délivrer expédition ou donner connaissance des actes à d’autres qu’aux personnes intéressées en nom direct, héritiers ou ayants droit sans une ordonnance du président du tribunal de grande instance.
Le même article prévoit aussi des sanctions en cas d’infraction pouvant aller jusqu’à la suspension des fonctions.
La délivrance de copie d’acte à des tiers est donc strictement réglementée. Elle n’est possible que sous le contrôle du président du tribunal de grande instance, qui vérifiera l’intérêt légitime du tiers à prendre connaissance de l’acte.
Les actes deviennent librement communicables à l'issue d'un délai de 100 ans. Ils doivent alors être déposés dans des centres d'archives.

I. Принцип профессиональной тайны
Напомним нормативные акты.
В связи с реформой, начатой в 1994 г., статья 378 старого Уголовного кодекса была заменена статьей 226-13, с очень близкой формулировкой.
Согласно этой статье, раскрытие информации секретного характера лицом, владеющим ею в силу своей должности или профессии, либо в связи с выполнением временных обязанностей или функций, наказывается лишением свободы на один год и штрафом в размере 15 000 евро.
Таким образом, профессиональная тайна является обязательством, чье нарушение наказывается в уголовном порядке.
Это также и деонтологическое обязательство, о котором говорится в национальном своде правил о нотариате, утвержденном постановлением министра юстиции от 20 апреля 1988 г.
Действительно, статья 7 этого свода правил гласит, что нотариус, являющийся по необходимости доверенным лицом своих клиентов, сохраняет профессиональную тайну на условиях, предусмотренных Уголовным кодексом, и что эта тайна распространяется на все, что становится нотариусу известным в связи с выполнением им своей профессиональной деятельности.
▪ Понятие тайны
- На какую информацию распространяется профессиональная тайна?
Первые судебные постановления, вынесенные в середине XIX века, полагали недостаточным, чтобы нотариус хранил профессиональную тайну, и чтобы сохраняемые в тайне факты стали известны ему в ходе осуществления его профессиональных функций: эти факты должны были также быть сообщены ему по секрету.
Скоро от такого ограничительного подхода отказались.
Согласно формулировке, часто использовавшейся в судебной практике и затем повторенной в национальном своде правил о нотариате, профессиональная тайна распространяется на все, что становится нотариусу известным при осуществлении им профессиональной деятельности.
Тем не менее, очевидно и то, что существует градация степени профессиональной тайны. Эта степень варьирует в зависимости от того, касается ли требование о разглашении содержания документа, который скоро будет обнародован и носит определенный публичный характер, или же переписки, которая находится в деле клиента и не подлежит разглашению, либо весьма конфиденциальной информации, которую клиент смог передать нотариусу.
- В отношении кого действует профессиональная тайна?
Профессиональная тайна применима, конечно, к третьим лицам в отношении данного юридического акта.
Понятие третьих лиц иногда вызывает вопросы. Например, когда требование о предоставлении информации исходит от кредитора или наследника клиента.
Несомненно, профессиональная тайна в отношении кредиторов действительна.
Наследник же является универсальным правопреемником наследодателя. Он может быть ознакомлен с актами без особых формальностей.
Помимо актов, сведения, которые нотариус может сообщить наследнику, зависят от намерений наследодателя и характера запрашиваемой информации.
Даже будучи правопреемником наследодателя, наследник не обладает абсолютным правом знать все о делах последнего.
Следует различать информацию имущественного характера, обязательную к передаче, и информацию неимущественного характера, в отношении которой тайна может продолжать действовать.
Позиция нотариуса должна определяться явно выраженной волей покойного и уважением к его памяти.
- Отменяет ли тайну согласие клиента?
Может ли нотариус быть освобожден от обязанности хранить тайну самим клиентом?
Согласно наиболее радикальным взглядам, согласие клиента не освобождает носителя профессиональной тайны от обязанности ее соблюдения.
Это положение, только что подтвержденное Кассационным судом, на практике трудно применимо.
Можно также полагать, что согласие клиента устраняет конфиденциальность информации.
Когда информация касается множества лиц, как, например, в случае обсуждений перед заключением сделки, при любом положении дела она не может быть раскрыта без согласия всех заинтересованных сторон.
- Профессиональная тайна и обязанность оказывать консультативную помощь.
Обязанность оказывать консультативную помощь – характерная особенность функций нотариуса.
Согласно статье 5 национального свода правил, нотариус должен предоставлять своим клиентам наиболее полную информацию.
Возможно возникновение противоречия между обязанностью оказывать консультативную помощь и обязанностью соблюдать профессиональную тайну: может ли единственный нотариус, участвовавший в сделке, раскрыть одной стороне информацию, касающуюся другой стороны, например, о ее неплатежеспособности?
Обязанность соблюдать профессиональную тайну не устраняется обязанностью оказывать консультативную помощь, они должны совмещаться друг с другом.
Между обязанностями нет какой-либо иерархии, это достаточно деликатный вопрос соблюдения равновесия.
Нотариус должен следить за честностью сделки, и в случае обмана отказываться составлять официальные документы.
▪ Ознакомление с документами
Нотариус является хранителем удостоверенных актов.
К нему часто обращаются с просьбой или требованием ознакомить с каким-либо актом, хранящимся в его конторе.
В отношении этого вопроса существует специальная норма, изложенная в статье 23 закона от 25 вантоза XI года, а в современной редакции – закона от 25 июня 1973 г.
Согласно этой статье, нотариусы могут выдавать удостоверенную копию или разрешать знакомиться с нотариальными актами лицам, не входящим в число непосредственно заинтересованных лиц, наследников или правопреемников, только по постановлению председателя суда большой инстанции.
Той же статьей предусматриваются санкции в случае нарушения ее требований, вплоть до лишения права заниматься нотариальной деятельностью.
Таким образом, выдача копий нотариальных актов третьим лицам строго регламентирована. Она возможна только под контролем председателя суда большой инстанции, проверяющего законность требований третьих лиц на ознакомление с актом.
Нотариальные акты поступают в свободный доступ по прошествии 100 лет. По достижении этого срока они должны быть переданы в архивные центры.
