Che il rifiuto della sig.ra ---- di riportare in Italia la figlia, al termine del periodo di vacanza concordato con il padre, integri gli estremi della sottrazione di minore - sia ai sensi e per gli effetti di cui all’art. 574 bis c.p., sia in relazione alla fattispecie della sottrazione internazionale di minori di cui alla Convenzione dell’Aja - è di tutta evidenza considerato che, pur avendo condotto la figlia in Australia con il consenso del padre, la madre HA ALFINE RIFIUTATO DI RICONDURLA PRESSO LA SUA RESIDENZA ABITUALE IN ITALIA, ALLA SCADENZA STABILITA, manifestando, anzi, L’ESPRESSA INTENZIONE DI NON PIÙ RICONDURVELA E DI TRATTENERLA STABILMENTE IN AUSTRALIA.
In particolare, ai sensi dell’art. 574 bis c.p., si rende colpevole del reato di sottrazione e trattenimento di minore all’estero “chiunque sottrae un minore al genitore esercente la potestà dei genitori o al tutore, conducendolo o trattenendolo all’estero contro la volontà del medesimo genitore o tutore, impedendo in tutto o in parte allo stesso l’esercizio della potestà genitoriale”.

That Mrs. __________s refusal to take her daughter back to Italy, at the end of summer vacation as agreed with the father, is tantamount to an abduction of minors – which in terms of art. 574 bis of the Italian Criminal Code., amounts to an international abduction of minors in terms of the Hague Convention – it is evident that, although the mother took her daughter to Italy with the father’s consent, the mother REFUSED TO BRING THE CHILD BACK TO HER HABITUAL RESIDENCE IN ITALY AT THE DATE AGREED, on the other hand, stating that she EXPRESSLY INTENDED TO NEVER BRING HER BACK AND TO RESIDE PERMANENTLY IN AUSTRALIA.
