Source text - English Strong Euro Could Weaken Profitability The latest economic indicators out of the Euro zone have been stronger than expected despite the recent appreciation of the Euro. After last week's sharp deterioration in government bond prices we now seem to be entering a consolidation phase. In fact, the EUR government curve (EGB) has even managed to steepen slightly over the past two weeks as the short and medium part of the curve tightened roughly 10 bps. Turning to the performance of the European corporate bond market, we observed IG credit outperforming EGB on a total return basis. Uncertainties about the rating of a major US car manufacturer have been resolved by S&P's announcement last week. The result was a strong rally in the auto sector and consequently the outperformance of the consumer cyclicals in general. As far as the credit cycle is concerned we remain on track. Moody's default rate forecasting model predicts a year end '03 speculative grade default rate of 5.3%, falling to 4% by this time next year. This should bode well for credit spreads going into the medium term. However, a strong Euro could cause the export profitability of European companies to weaken and result in lower profit margins. This could prevent corporate spreads moving tighter going forward. Most likely we will see corporate spreads to stay in narrow bands or soften modestly as we approach year end 2003. Nach dem starken Nachgeben der Staatsanleihen in der vergangenen Woche ist jetzt anscheinend eine Phase der Konsolidierung eingetreten. Die Kurve der EUR Staatsanleihen ist in den letzten beiden Wochen sogar etwas steiler geworden, da der kurz- und mittelfristige Teil der Kurve um rund 10 Basispunkte angezogen hat. Die Rendite der europäischen Industrieanleihen fiel insgesamt besser aus als die der EUR Staatsanleihen. Ungewissheiten über die Bonität maßgeblicher US-Automobilhersteller wurden letzte Woche durch die Bekanntgabe der S&P-Ratings aus dem Wege geräumt. Das Ergebnis war eine starke Erholung des Automobilsektors und folglich eine Outperformance zyklischer Verbraucherwerte im Allgemeinen. Der Kreditzyklus entspricht weiterhin den Prognosen. Laut Moodys Modell für die Prognose der Verzugsrate ist zum Jahresende 2003 bei den als spekulativ eingestuften Anleihen mit einer Verzugsrate von 5,3% zu rechnen, die bis nächstes Jahr um die gleichen Zeit auf 4% fallen wird. Die Vertretung der Gesellschaft, die Firmenzeichnung sowie die Abgabe von Willenserklärungen erfolgt - solange nur ein Geschäftsführer bestellt ist - durch diesen selbständig. (2) Sind mehrere Geschäftsführer bestellt, so wird deren Vertretungsrecht mit dem jeweiligen Bestellungsbeschluss geregelt. (3) Umfang der Geschäftsführung. Die Geschäftsführung erstreckt sich auf alle Handlungen, die der gewöhnliche Geschäftsbetrieb der Gesellschaft mit sich bringt. (4) Nicht betriebsgewöhnliche Geschäfte.
