Élu par les membres du barreau pour un mandat de deux ans, le bâtonnier constitue le porte-parole des avocats inscrits dans son barreau. Mais davantage, il dispose d'une véritable fonction d'arbitrage entre les avocats et d'une fonction de conciliateur lorsqu'un différend oppose un avocat et son client. C'est également lui qui désigne les avocats commis d'office.
Le successeur du bâtonnier est élu avant la fin du mandat de ce dernier. Durant un an, le bâtonnier désigné peut ainsi monter en compétence afin d'être opérationnel sur les différents dossiers qu'il aura à traiter dès son entrée en fonction.
Origine étymologique (France)[modifier | modifier le code]
À l'emplacement de la Sainte-Chapelle sur l'île de la Cité à Paris se trouvait au xe siècle une chapelle dédiée à saint Nicolas, qui est l'un des saints patrons des juristes. S'y déroulait notamment la rentrée annuelle du parlement de Paris. Les membres s'y réunissaient pour former la confrérie de Saint-Nicolas, qui était à la fois une corporation et un ordre religieux. Le chef élu de cette confrérie, tout d'abord appelé prieur, portait la bannière de l'ordre, suspendue à une hampe, ou baston, pendant les processions. Ce baston était parfois orné d'une représentation de saint Nicolas, ou saint Yves (autre saint-patron des juristes). Une ordonnance du 23 octobre 1274 reconnut aux avocats membres du parlement la qualité de corps constitué, soumis au secret professionnel1.
En 1690, le Dictionnaire universel des sciences et des arts2 précisait que le bastonnier (ou la bastonnière) est « celui ou celle qui ont en garde pendant un temps le baston d'une Confrérie, et qui le portent ou le suivent aux processions. En termes du Palais, est un ancien Avocat qu'on choisit tous les ans selon l'ordre du Tableau, pour être le Chef de la Communauté des Avocats et Procureurs, pour être le Maître de leur Chapelle et de leur Confrérie, et présider au siège qu'ils tiennent pour l'entretenement de la discipline du Palais et des règlements. Etymological origin[edit]
The location of the Sainte-Chapelle on the île de la Cité in Paris was in the 10th century a chapel dedicated to Saint Nicholas, who is one of the patron saints of lawyers. It was famously the site for the annual reopening of the parlement of Paris. The members gathered there to form the brotherhood of Saint-Nicolas, which was both a corporation and a religious order. The elected Chief of this brotherhood, at first called the prior, carried the banner of the order suspended from a pole or baston, during processions.
This banner was sometimes decorated with a representation of St. Nicholas or St. Yves (another patron saint of lawyers). An order of 23 October 1274 recognized lawyers as members of a constituent body in Parliament, bound by professional secrecy.[6]
In 1690, the Dictionnaire universel des sciences et des arts [7] stated that the bastonnier (or the bastonniere) is "he or she who carries for a while the baston of a brotherhood, and who carries it or follows it in processions. In terms of the Palace of Justice, it is a former lawyer chosen annually according to the order of the Tableau, to be the head of the community of lawyers and prosecutors, to be the master of their Chapel and their brotherhood, and preside over the tribunal that they hold for maintaining the discipline of the Palace and its regulations. He also manages the commission of inquiry of lower judges during their ban. "
I have spent my life studying languages. My University degree is for Classical Languages, but I have spent many years learning French and Spanish. I have travelled to Europe twice and read numerous books in those languages. My background in Latin not only gives me a broad vocabulary, it also gives me a deep understanding of grammar.
