1. PREAMBLE, SCHEDULES and CAPTIONS
1.1 The Preamble and Annexes to this Agreement constitute an integral part hereof.
1.2 The Agreement captions are provided for the sake of convenience only and shall not be used to construe the provisions hereof.
2. DEFINITIONS
2.1 In this Agreement:
"Agreement" shall mean the current standard maintenance and support agreement, including its Annexes and Appendices.
“Annex” shall mean an annex to this Agreement;
"Business Day" shall mean each day from Monday until Friday, except for national bank holidays. For the avoidance of doubt, “Day” means any calendar day.
"Current Release" shall mean the most recent release of the IDIT Software generally released to IDIT customers and which may be available to the Customer under this Agreement.
"Documentation" shall mean the generally available operating manuals and user instructions in human-readable form supplied by IDIT to the Customer for aiding the use of the IDIT Software in accordance with the License Agreement.
"Effective Date" shall mean the signature date of the last Party of the two Parties to sign this Agreement.
"Error" shall mean a design flaw or malfunctioning of the IDIT Software to operate in accordance with its specifications.
“First Level Support” shall mean a group of Customer's staff responsible to providing Customer with required information, screening requests or resolve problems.

1. PRÉAMBULE, ANNEXES et LÉGENDES
1.1 Le Préambule et les Annexes au présent Contrat constituent une partie intégrante de celui-ci.
1.2 Les légendes du Contrat sont fournies uniquement pour en faciliter la lecture et ne sauraient être utilisées pour interpréter les dispositions contenues dans les présentes.
2. DÉFINITIONS
2.1 Dans le présent Contrat :
« Contrat » désigne le contrat standard de maintenance et d’assistance, incluant ses Annexes et Pièces jointes.
« Annexe » désigne une annexe au présent Contrat ;
« Jour ouvrable » désigne chaque jour du Lundi au Vendredi, sauf les jours fériés. Pour éviter tout doute, « Jour » désigne un jour civil.
« Version actuelle » désigne la version la plus récente du Logiciel IDIT généralement diffusée aux clients IDIT et qui peut être mise à la disposition du Client en vertu du présent Contrat.
« Documentation » désigne les guides d’utilisation et guides utilisateurs généralement disponibles et interprétables par l’utilisateur fournis au Client par IDIT destinés à faciliter l’utilisation du Logiciel IDIT suivant le Contrat de Licence.
« Date effective » désigne la date à laquelle la dernière Partie des deux Parties à signer le présent Contrat.
« Erreur » désigne un défaut de conception ou un mauvais fonctionnement du Logiciel IDIT lié à son utilisation conformément à ses spécifications.
« Assistance de Niveau Un » désigne un groupe de personnel du Client chargé de fournir au Client les informations requises, les demandes de contrôle ou de résoudre les problèmes.
