John Doe appeared in person before me today and, in the presence of the undersigned credible witnesses, stated under oath:
"My name is Jocelio Alves de Almeida. I am _____ years of age and reside at Rua XXX, Minas Gerais, Brazil. I am the father of the following child:
"John Doe, Jr., a male child born on July 26, 1995.
"No person has been appointed or has qualified as guardian of the person or estate of the child.
"I am not presently obligated by court order to make payments for the support of the child.
"A full description, including statement of value, of all property owned or possessed by the child is as follows:

"The mother of the child is Jane Doe, and her address is XXXX.
"I designate XXXXX, Jr., a prospective adoptive parent, XXXXXX, as managing conservator of the child. I have been informed that my parental rights, powers, duties, and privileges are as follows:
1. the right to have physical possession, to direct the moral and religious training, and to designate the residence of the child;
2. the duty of care, control, protection, and reasonable discipline of the child;
3. the duty to support the child, including providing the child with clothing, food, shelter, medical and dental care, and education;
4. the duty, except when a guardian of the estate has been appointed, to manage the estate of the child, including the right as an agent of the child to act in relation to the child's estate if the child's action is required by a state, the United States, or a foreign government;
5. except as provided by section 264.0111 of the Texas Family Code, the right to the services and earnings of the child;
6. the right to consent to the child's marriage, enlistment in the armed forces of the United States, medical and dental care, and psychiatric, psychological, and surgical treatment;
7. the right to represent the child in legal action and to make other decisions of substantial legal significance concerning the child;
8. the right to receive and give receipt for payments for the support of the child and to hold or disburse funds for the benefit of the child;
9. the right to inherit from and through the child;
10. the right to make decisions concerning the child's education; and
11. any other right or duty existing between a parent and child by virtue of law.
"I freely and voluntarily give and relinquish to XXXXXX, Jr. all my parental rights and duties.
"I fully understand that a lawsuit will be promptly filed in a court of competent jurisdiction to terminate forever the parent-child relationship between me and the child named above. I fully understand that the termination suit may or may not be combined with a suit to adopt my child. I understand that either way, once the Court terminates my parental rights, I have no further say concerning my child, whether or not my child is adopted then or at some later time.
"I know that I have the right to appear personally before the Court, with an attorney of my choice, to testify about my desires with respect to my child. However, I do not want to go to court in person and choose not to be represented by a lawyer. I want this Affidavit for Voluntary Relinquishment of Parental Rights presented to the Court.
"Because I do not want to testify in person before the Court, I freely and voluntarily waive and give up my right to the issuance, service, and return of citation, notice, and all other process in any suit to terminate my parental rights or in any suit to terminate my parental rights joined with a suit to adopt. I do not want to be informed further about the lawsuit. I specifically agree that a final hearing in the lawsuit may be held at any time without further notice to me. I waive and give up my right to have the official court reporter make a record of the testimony in the lawsuit. Furthermore, I do not want to be mailed or given a copy of the judgment terminating my parental rights and do not want to be notified of the signing, rendition, or entry of that judgment. I also consent to have any suit affecting the parent-child relationship filed or to be filed with respect to the child named above be decided by an associate judge appointed under section 201.001 of the Texas Family Code.
"If I am in the armed services of the United States at this time, that fact in no way has interfered with my freedom to make my decision to execute this affidavit, and, insofar as this matter is concerned, I waive all rights, privileges, and exemptions existing or that may hereafter exist in my favor under the Servicemembers Civil Relief Act, including the appointment of counsel to represent me in this case.
"I FULLY UNDERSTAND THAT I MAY NOT BE FURTHER INFORMED ABOUT THE TERMINATION SUIT OR ABOUT ANY OTHER HEARINGS OR PROCEEDINGS AFFECTING THE CHILD NAMED IN THIS AFFIDAVIT.
"Termination of the parent-child relationship is in the best interest of the child. I understand that I make this termination possible by executing this affidavit.
"I DECLARE THAT THIS AFFIDAVIT FOR VOLUNTARY RELINQUISHMENT OF PARENTAL RIGHTS IS AND SHALL BE IRREVOCABLE FOR SIXTY DAYS. I FULLY UNDERSTAND THAT, IF I CHANGE MY MIND, I CANNOT FORCE THE MANAGING CONSERVATOR TO DESTROY, REVOKE, OR RETURN THIS AFFIDAVIT AND THAT I CANNOT TAKE BACK OR UNDO THIS AFFIDAVIT IN ANY WAY DURING THIS SIXTY-DAY PERIOD. "I understand that, for any revocation to be valid, I must sign a statement before two credible witnesses and a person authorized to take oaths. A copy of the revocation must be delivered to Little John at 2512 1st Street, XXXXX. If I know that a termination suit based on this affidavit has been filed, I must file a copy of the revocation with the clerk of the court.
"I have carefully considered alternative plans for my child's future and have obtained the advice of whatever family members, friends, or other persons and professionals I feel were necessary to help me make this decision. This decision is very difficult for me to make, and under other circumstances I might have made a different decision. I know that Little John., in accepting my child for adoptive placement and assuming responsibility for my child, is relying on my promise that I will not attempt to reclaim my child. I declare that I fully understand the meaning of this affidavit of relinquishment and the finality of my action in signing it, and I am signing it freely, voluntarily, and with the firm conviction that this decision is the best available alternative for my child.
"I am signing this affidavit today because I want to sign it and not because Little John. or any other person or persons want me to sign it. I am signing this affidavit in the presence of the two undersigned witnesses. I am also signing this affidavit before a notary public, who has asked me under oath whether or not each and every statement in this affidavit is true and correct.

1.3 Autorizar a retirada do guindaste MADAL de 25 t do convés da Unidade.
1.4 Adequar as especificações técnicas da Unidade conforme alterações constante
na Cláusula Segunda deste Aditivo.
cLÁUSULA SEGUNDA -DAS ALTERAÇÕES
2.1. BOP + LMRP: (BOP CAMERON, TIPO "U" 183/4" x 10.000psi).
2.1.1. Instalar o quarto acesso para as linhas de kill/choke no BOP.
2.1.2. Substituir todos os elastômeros possíveis do BOP e LMRP para adequação
a trabalhos em altas temperaturas.
2.1.3. Instalar mais um preventor anular.

We would confirm we are surveyors acting on behalf of cargo insurers regarding reported damage to cargo on the above vessel which occurred during discharge due to a fire which commenced at approximately 1930hrs on the 25th August 2006 and which was finally extinguished at approximately 2000hrs on the 26th idem. We attended on site at Niteroi, Brazil on the 10th September 2006 at which time, apart from one reel discharged prior to the fire and one reel discharged during the fire by floating crane, the cargo remained on the vessel pending repair of the shore crane damaged by firefighting water. The cargo was discharged between approximately 1330hrs on the 12th September 2006 and 2100hrs on the 15th idem during which time we inspected cargo in stow and during discharge.
The cargo comprises 15 reels of Flexible Flowline and 2 Reels of Flexible Riser 6” diameter pipe together with 10 cases of Flexible Riser and Flowline Bend Stiffeners and 11 cases of Trunion Rollers and 2 Motors.
The product is a high pressure flexible pipe with a 6” internal diameter and 13” outside diameter with the Flowline pipe (15 reels) designed to carry crude oil from an under sea well head along the sea bed at depths of 4900ft to a floating oil storage platform while the Riser pipe (2 reels) of similar size connects the flowline to the platform. The two types of pipe are of similar construction and are built up in composite layers to provide the necessary flexibility and strength. Firstly, there is a stainless tube roll formed from a continuous strip 8.4mm thick which is enclosed in two co-polymer layers to provide fluid integrity. Then a carbon steel profile is wrapped around same to give rigidity but maintain flexibility. Following a layer of polypropylene to prevent friction there is a further layer of a carbon steel flat strip in a diagonal orientation around the pipe and then further layers of polypropylene and a glass filament. After this is another layer of carbon steel flat strip in a diagonal orientation across the first layer. These carbon steel strips provide tensile strength for the pipe. There are then further layers of polypropylene then a layer of high density polyethylene (HDPE) and two layers of syntactic foam insulation separated by a layer of polypropylene and then a fabric strip before the final outer sheath of HDPE which is yellow. One of the reels of flowline contains a different material for the fluid integrity as does the riser which also has a slightly different arrangement of outer layers with nylon (black) replacing the HDPE.
Based on our inspection we would confirm the following visible damages to the reels of Flexible Flowlines and Risers viz:
Reel No WS 129 Discharged prior to fire and not affected by fire.
Reel No WNC 85 Top of plastic tarpaulin covering pipe softened by heat and dirty/soot covered.
Reel No WS 50 Top of plastic tarpaulin covering pipe softened by heat and dirty/soot covered.

The 21 cases have not been subjected to fire/heat but have been partly submerged in seawater in the hold used to extinguish the fire.
We are currently awaiting customs authorization to open the cases to inspect the contents and also to remove the tarpaulins to check for visible evidence of heat damage on reel Nos WNC 85, WS 50 and WNC 58.
With regard to the reels we would allocate same into 5 categories according to visible damage, albeit that subject to customs authorization to remove tarpaulins some reels may need to be re categorized;
Category A: Discharged prior to fire and hence unaffected.
Category B: Top of PVC covers softened and dirty.
Category C: Top of PVC covers melted and adhering to outer sheath/coating (HDPE/Nylon) of pipe.
Category D: Outer sheath/coating showing signs of melting/charring.
Category E: Outer coatings either extensively melted/burnt or completely burnt away.
The reels can be allocated to these categories as follows:-
Category A: Reel No WS 129
Category B: Reel Nos WNC 85, WS 50 and WNC 58
Category C: Reel Nos WNC 04, WS 96, WS 169, WNC 38 & WS 103
Category D: Reel Nos WS 35, WNC 72, WS 87, WNC 73 & WS 141

We outline further required actions in respect to each category as follows.
Category A
Supply to customer as intended
Category B
Remove tarpaulin, if there is no visible heat damage take sample of outer coating and send to UK for test. If test confirms no heat damage to coating discuss with customer supply of material. If there is visible damage to the coating downgrade to Category C or if tests reveal heat damage to coating downgrade to Category D
Category C
Take sample of outer coating from affected area and send to UK for test. If test confirms no heat damage to coating discuss with customer supply after cleaning/removal of burnt/melted PVC. If the test reveals heat damage to outer coating downgrade to Category D.
Category D
Take 1 metre full profile sample and send samples of layers of coatings to UK for test. If tests reveal heat damage is limited to outer coatings return reel to UK for stripping and reapplication of affected coatings. If tests reveal inner coatings are affected and stripping/recoating is not viable/economic down grade to Category E.
Category E
Return reels to UK for disposal as scrap
It may be found during partial unspooling to take samples that damages are more significant expected. Should this be the case it may be necessary to change category.
It will be seen from the foregoing that at least 13 reels (categories C, D & E) are visibly affected by fire/ heat and are not suitable for supply to the intended customer in their present condition, if at all. Subject to inspection and or test a further 3 reels may also be affected (category B).

Confirmamos ser os vistoriadores, agindo em nome dos seguradores da carga informada como tendo sofrido danos a bordo do navio acima, danos esses provocados por um incêndio iniciado durante a descarga, por volta das 19:30 h do dia 25 de agosto de 2006, o qual foi finalmente debelado, aproximadamente às 20:00 h do dia 26 do mesmo mês. Comparecemos ao local em Niterói, Brasil, no dia 10 de setembro de 2006, em cuja data, à parte de um carretel descarregado antes do incêndio e de um outro carretel descarregado durante aquele sinistro pela cábrea flutuante, a carga permaneceu a bordo do navio, já que dependia do reparo do guindaste em terra, danificado pela água do equipamento de combate ao fogo. A carga foi descarregada entre aproximadamente 13:30 h do dia 12 de setembro de 2006 e as 21:00 hs do dia 15 do mesmo mês, em cujo período inspecionamos a carga na estiva e durante a descarga.
A carga é constituída de 15 carretéis de Tubulação de Fluxo Flexível e 2 Carretéis de Colunas de Ascensão Flexíveis de 6 polegadas de diâmetro, em conjunto com 10 caixas de Esticadores de Curvatura para as Colunas de Ascensão e Tubulações de Fluxo Flexíveis, mais 11 caixas com Rolamentos de Pinhão e 2 Motores.
O produto é um tubo flexível de alta pressão com um diâmetro interno de 6 polegadas e um diâmetro externo de 13 polegadas com a Tubulação de Fluxo (15 carretéis), destinado ao transporte de petróleo de uma cabeça de poço submarina ao longo do leito marinho, a profundidades de 4900 pés, para uma plataforma de armazenamento de petróleo flutuante, enquanto a Coluna de Ascensão (2 carretéis) de tamanho similar faz a conexão da tubulação de fluxo com a plataforma. Os dois tipos de tubos são de construção similar e em camadas de materiais compostos, para proporcionar a flexibilidade e resistência necessárias. Em primeiro lugar, existe um cilindro de aço inoxidável formado de uma tira contínua com 8,4 mm de espessura, encerrada em duas camadas de copolímeros para conferir a integridade do fluido. Em seguida, um perfil de aço carbono é envolto ao seu redor, para conferir rigidez, ao mesmo tempo em que mantém a flexibilidade. Após uma camada de polipropileno para impedir a fricção, há uma outra camada de uma tira plana de aço carbono posicionada diagonalmente ao redor do tubo, seguindo-se outras camadas de polipropileno e um filamento de vidro. Em seguida, há uma outra camada constituída de uma tira plana de aço carbono, posicionada diagonalmente através da primeira camada. Essas tiras de aço carbono conferem a resistência tênsil ao tubo. Há, ainda, outras camadas de polipropileno, seguindo-se uma camada de polietileno de alta densidade (HDPE) e duas camadas de isolamento de espuma sintética, separada por uma camada de polipropileno, mais uma tira de tecido, antes da bainha externa final de HDPE, que é amarela. Um dos carretéis da tubulação de fluxo contém um material diferente para assegurar a integridade do fluido, como o faz a coluna de ascensão, que também dispõe de uma configuração ligeiramente diferente das camadas externas com nylon (preto), em substituição do HDPE.
Com base em nossa inspeção, confirmamos a existência dos seguintes danos visíveis aos carretéis contendo as Tubulações de Fluxo e as Colunas de Ascensão Flexíveis, a saber:

Carretel Nº WNC 85 Topo da lona plástica de cobertura do tubo amolecida pelo calor e coberta de sujeira/fuligem.

Estamos, no momento, aguardando a autorização da alfândega para abrir as caixas e inspecionar o conteúdo e também remover as lonas, para verificar a evidência visível de danos causados pelo calor aos carretéis Nº WNC 85, WS 50 e WNC 58.
Com referência aos carretéis, gostaríamos de classificá-los em 5 categorias, de acordo com os danos visíveis. Embora sujeito à autorização da alfândega para remover as lonas, alguns carretéis poderão precisar ser reclassificados:
Categoria A: Descarregados antes do incêndio, e daí não estarem afetados.
Categoria B: Topo das coberturas de PVC amolecido e sujo.
Categoria C: Topo das coberturas de PVC derretido e aderente à bainha/revestimento externo (HDPE/Nylon) do tubo.
Categoria D: Bainha/revestimento externo mostrando sinais de derretimento/chamuscamento.
Categoria E: Revestimentos externos ou extensamente derretidos/queimados ou completamente queimados.

Colher amostra do revestimento externo da área afetada e enviá-la para o Reino Unido para testes. Se o teste confirmar que não houve danos causados pelo calor ao revestimento, discutir com o cliente sobre o fornecimento, após a limpeza/remoção do PVC queimado/derretido. Se o teste revelar danos provocados pelo calor ao revestimento externo, rebaixar para a Categoria D.
Categoria D
Colher 1 metro de amostra de todo o perfil e enviar as amostras das camadas dos revestimentos para o Reino Unido para testes. Se os testes revelarem que os danos provocados pelo calor estão limitados aos revestimentos externos, devolver o carretel ao Reino Unido para desencapamento e reaplicação dos revestimentos afetados. Se os testes revelarem que os revestimentos internos estão afetados e o desemcapamento/novo revestimento não é viável/econômico, rebaixar para a Categoria E.
Categoria E
Devolver os carretéis para o Reino Unido para descarte como sucata.
Pode-se descobrir durante o desembobinamento parcial para a coleta de amostras que os danos são mais significativos do que o esperado. Caso isto ocorra, poderá ser necessário alterar a categoria.
Será visto do precedente que pelo menos 13 carretéis (categorias C, D e E) estão visivelmente afetados pelo fogo / calor e não são adequados para fornecimento ao cliente ao qual se destinavam em sua atual condição, se tanto. Dependendo da inspeção e ou do teste outros 3 carretéis também poderão ser afetados (Categoria B).

Summary of financial results
Company X’s net profit for 2003 clocked in at EUR 2,197 million, increasing fourfold compared with 2002 and bringing return on equity for the year to 19% (4% in 2002). Net operating profit increased fivefold in the same period, to EUR 2,247 million. Excluding value adjustments to the equity portfolio, net operating profit increased by 19% to EUR 2,558 million.
Company X delivered this good performance in a year that started poorly with a weak economy and low stock markets, but that gradually improved. Operating performance continued to improve thanks to better interest margins, excellent results at Non-life insurance and further cost reductions.
On the back of improving stock markets and Company X’s operating performance, Company X’s solvency strengthened further in 2003. As at 31 December, net core capital was EUR 18.5 billion, which was 83% above the legally required minimum and 15% above Company X’s own floor.
Banking activities
Net operating profit increased by 25% to EUR 1,446 million in 2003. Excluding value adjustments to the equity portfolio, net operating profit increased by 6% to EUR 1,438 million.
Operating costs fell by 1%. These savings were on top of the 9% cost reduction already realized in 2002. The cost/income ratio decreased from 63.0% to 62.7%. Staff costs decreased by 1% compared with 2002. FTEs decreased by 2,217 to 37,444 on 31 December 2003; this was on top of the 2,448 reduction in 2002, bringing the total reduction over the last two years to 11%.

Market Commentary
Japanese large-cap stock markets ended February at an eight-month high, following positive news that Japanese industry is growing faster-than-expected, boosting hopes that the country’s retreat back into recession is over.
In sharp contrast to recent data, economic news was, in general, positive. Officially, the Japanese economy did, however, enter a recession for the fourth time in a decade. However, the consumer could be on the turn. January consumer confidence gained more than expected as households became more optimistic about employment.
Fund Strategy
We remain optimistic for the current business cycle. Although earnings momentum in Japanese corporations overall may be slowing compared to the remarkable improvement we experienced in financial year 2004, we believe there are numerous investment opportunities where valuations still look attractive and fundamentals remain positive.
The portfolio is largely underweight in defensive areas such as utilities, foods, and health care. The fund remains focused on companies with pricing power in niche areas of growth. In addition, we maintain positions in large-cap names that are well positioned to benefit from the growth in global and/or domestic demand.
During February, we sold out of KDDI, the mobile telephone company, and Softbank Investment. We used the proceeds to start new positions in machinery companies Toshiba Machine and Tsubakimoto Chain. Both these companies’ core products should see strong growth as demand increases, particularly from the automobile sector.

Comentário sobre o Mercado
Os mercados japoneses, que negociam ações de empresas altamente capitalizadas, terminaram fevereiro, registrando a maior alta em oito meses, após o recebimento de notícias positivas de que a indústria japonesa está experimentando um crescimento maior do que o esperado, reforçando as expectativas de que o país não voltará a entrar em recessão.
Em forte contraste com os dados recentes, o noticiário econômico foi positivo em linhas gerais. Oficialmente, contudo, a economia japonesa entrou em recessão pela quarta vez numa década. Todavia, esta poderá ser a vez do consumidor. O nível de confiança do consumidor em janeiro aumentou acima do esperado, na medida em que um levantamento nos domicílios demonstrou a existência de maior otimismo com relação ao mercado de trabalho.
Estratégia do Fundo
Continuamos otimistas no que respeita o atual ciclo de negócios. Embora o ímpeto dos ganhos obtidos com investimentos nas empresas japonesas como um todo possa estar declinando, em comparação com a notável melhora que experimentamos no exercício financeiro de 2004, acreditamos existirem inúmeras oportunidades de investimento, quando os valores inerentes, ainda parecem despertar interesse, e a saúde econômica das empresas permanece positiva.
A carteira de títulos e valores mobiliários apresenta um desempenho bastante abaixo da média em áreas defensivas, tais como serviços públicos, alimentos e assistência médica. O fundo continua concentrado nas companhias detentoras da capacidade de ditar os preços nas áreas que representam nichos de crescimento. Ademais, mantemos posições em ações de companhias com alto nível de capitalização, que se encontram em boas condições para usufruir os benefícios gerados pelo aumento da demanda global e/ou doméstica.
Durante o mês de fevereiro, liquidamos inteiramente as posições da KDDI, a companhia de telefonia móvel, e do Softbank Investment. Usamos os recursos para iniciar novas posições nas companhias fabricantes de maquinário, Toshiba Machine e Tsubakimoto Chain. Espera-se que os principais produtos dessas duas companhias experimentem forte crescimento, na medida em que ocorre um aumento na demanda, em particular do setor automobilístico.

ATTORNEY-CLIENT COMMUNICATIONS
1. Matter. Wherein by this agreement, Jane Doe; (the “Client”) retains John & John, L.L.P. ("the Firm") to act on his behalf to investigate and pursue all claims for damages which she may have against any and all responsible parties arising from death of John Doe which occurred on or about September 30, 2006 at or near the Amazon in Brazil ("the Litigation").
2. Scope of Employment. The Firm agrees to represent you in connection with the Litigation, including the trial of your case, and any appeals. Our engagement may from time to time involve: (a) providing counsel and advice; (b) factual investigation; (c) developing strategy to protect and advance your legal rights; (d) legal research and writing; (e) discovery matters; (f) communicating with you, other attorneys, the courts, experts, consultants, witnesses, and others in connection with the Litigation; (g) appearing and representing you in court, as well as negotiating settlements and other matters of compromise in connection with the Litigation; (h) representing you in mediation or arbitration proceedings related to the Litigation and (i) other activities reasonably necessary or beneficial to our legal representation of you in connection with the Litigation.
3. Cooperation. We will consult with you on all major decisions and will keep you fully informed of the status of the matters on which we are working, as well as our recommended strategies in handling such matters. You agree to take all reasonable actions to assist and cooperate in advancing your interests in this matter and to furnish us promptly with all information that we deem necessary to represent you in the Litigation. The Firm will make no settlement of your claims without your express approval, which you agree will not be unreasonably withheld. The Client agrees to cease all communications with third parties concerning this matter and agrees not to enter into settlement negotiations or settlement agreements regarding this matter without the prior express consent of the Firm.
4. No Warranties. There can be no assurances, and we make no warranties, representations, or guarantees, about the outcome of the Litigation, particular results from our services or services provided by others at our request, as well as the response and timeliness of action by any governmental official or department, court of law, mediator or arbitrator. You acknowledge the risks that you may win or lose at trial, and that any decision could be upheld, reversed or modified on appeal.
5. Attorneys Fees. In consideration of the services rendered and to be rendered by the Firm, you hereby assign and convey to the Firm an undivided Thirty Percent (30%) of all sums paid to you by settlement, judgment or collection, or to anyone on your behalf, relating directly or indirectly to the Litigation.
6. Computation of Fees. The attorneys’ fees shall be computed on the amount of the recovery.
7. Expenses. All Litigation expenses, which are out-of-pocket expenses incurred by the Firm to investigate, prepare and prosecute your claim, will be absorbed by the Firm out of its fees. Restated, there will be no charge for Litigation expenses incurred by the Firm in the handling of this matter.
8. Contingency. This is a contingent fee contract. In the event there is no recovery by you or on your behalf in this matter, you will not owe the Firm any attorneys’ fees, nor will you be required to reimburse the Firm for any Litigation expenses.
9. Withdrawal. The Firm reserves the right to immediately withdraw from representing you in the Litigation, regardless of its status, in the event that:
1. We discover any material misrepresentation of information provided by you or nondisclosure of material information requested from you in connection with the Litigation;
2. We discover that there is no liability on the part of potential parties to the Litigation, or that there is inadequate insurance or collectible assets to justify pursuit of the Litigation;
3. You unreasonably withhold approval of a settlement offer or refuse to cooperate with our representation of you;
4. You engage in any conduct or activities contrary to our advice that, in our opinion, would constitute a violation of the Texas Disciplinary Rules of Professional Conduct or any other law.
The Firm shall give you written notice of our intention to withdraw and any withdrawal from employment exercised by the Firm under this Agreement will comply with the provisions of Rule 1.15 of the Texas Disciplinary Rules of Professional Conduct.
If the Firm withdraws without good cause, the Firm shall not be entitled to a fee or reimbursement of litigation expenses under this contract. You understand that if the Firm is discharged by you without good cause, the Firm may be entitled to all or a portion of the fees and/or expenses provided under this Agreement.
10. Association of Counsel. You understand that it may be necessary for the Firm to associate additional counsel in connection with the handling of this case. The decision to associate additional counsel shall be at the sole discretion of the Firm, and all fees paid to such additional counsel shall be paid from fees earned under this Agreement.
11. Texas Lawyer’s Creed. The Firm advises you that we adhere to the letter and spirit of the Texas Lawyer’s Creed — A Mandate for Professionalism.
12. Place of Agreement. This Agreement between the Client and the Firm is entered into in Travis County, Texas.
13. Effective Date. The Agreement shall be effective as of the date of signing by the Client.
This Agreement shall be governed by and construed and enforced in accordance with the laws of the State of Texas, without regard to choice of law provisions, statutes, regulations or principals of this or any other jurisdiction.
This Agreement embodies the entire agreement between us and supersedes any and all prior agreements and understandings between us regarding the subject matter hereof. This Agreement may be changed only by a written instrument signed by both of us.

CONTRATO DE HONORÁRIOS PERCENTUAIS
COMUNICAÇÃO PRIVILEGIADA E CONFIDENCIAL
ENTRE CLIENTE E ADVOGADO
1. Assunto. Pelo presente contrato, Jane Doe; (a “Cliente”) constitui John & John, L.L.P. ("a Firma") para agir em seu nome, com o fim de investigar e dar consecução a todos os pleitos de indenização por danos aos quais a cliente possa ter direito, contra todas e quaisquer partes responsáveis, em decorrência da morte de John Doe, ocorrida em 30 de setembro de 2006, ou data próxima, na região amazônica, ou circunjacências, no Brasil (“O Litígio”).
2. Escopo da Contratação. A Firma concorda em representá-la, no que diz respeito ao Litígio, inclusive no julgamento da sua causa em juízo e em eventuais recursos. Nossos serviços poderão eventualmente incluir: (a) o oferecimento de assessoria e orientação; (b) investigação dos fatos; (c) desenvolvimento de estratégias para preservar e defender seus direitos legais; (d) pesquisa jurídica e redação; (e) questões relativas à instrução do processo; (f) comunicação com a senhora, com outros advogados ou com os tribunais, peritos, consultores, testemunhas e outras pessoas no tocante ao Litígio; (g) comparecimento em juízo e sua representação nele, bem como a negociação de acordos e outras concessões mútuas em relação ao Litígio; (h) sua representação em processos de mediação ou arbitragem relacionados ao Litígio, e (i) outras atividades justificadamente necessárias ou úteis para representá-la no que concerne a este Litígio.
3. Colaboração. Nós a consultaremos sobre todas as decisões de maior importância, mantendo-a plenamente informada sobre o andamento das questões em que estamos trabalhando, bem como acerca das estratégias por nós recomendadas para dirimir essas questões. A senhora concorda em tomar todas as medidas necessárias para assistir e colaborar na defesa dos seus interesses neste âmbito, e em nos fornecer, sem demora, todas as informações que considerarmos necessárias para representá-la neste Litígio. A Firma não fará nenhum acordo referente às suas reivindicações, sem a sua anuência claramente manifestada, anuência esta que a senhora concorda não será injustificadamente negada . A cliente concorda em cessar toda a comunicação com terceiros no que diz respeito a este assunto, e concorda, ainda, em não entrar em negociações ou acordos que digam respeito a este assunto, sem a anuência prévia manifestada pela Firma.
4. Sem Garantias. Não há garantias de êxito, assim como não damos garantias nem fazemos afirmações ou promessas de sucesso por escrito acerca dos resultados do Litígio, ou sobre resultados específicos dos nossos trabalhos ou dos serviços prestados por outros a nosso pedido, tampouco quanto à resposta ou à tempestividade da medida tomada por funcionário ou órgão do governo, tribunal de justiça, mediador ou árbitro. A senhora reconhece os riscos de que poderá ter ganho ou perda da causa em juízo, e de que qualquer sentença poderá ser mantida, anulada ou modificada através de recurso.
5. Honorários Advocatícios. Como contraprestação pelos serviços prestados e a serem prestados pela Firma, a senhora, pelo presente, cede e transfere à Firma trinta por cento (30%) integrais de todos os valores à senhora pagos , ou a outra pessoa pela senhora nomeada, por meio de acordo, sentença ou cobrança, relacionados indiretamente ao Litígio.
6. Cálculo dos Honorários. Os honorários advocatícios serão calculados sobre o valor da indenização obtida.
7. Despesas. Todas as despesas incorridas com o Litígio, que representem quantias desembolsadas pela Firma para investigar, preparar e dar seguimento à sua causa, serão pagas pela firma e deduzidas dos seus honorários. Em outras palavras, nada será cobrado a título de despesas incorridas pela Firma no Litígio desta causa.
8. Honorários Percentuais. Este é um contrato de honorários percentuais. Caso não haja indenização a seu favor nesta lide, a senhora não terá que pagar honorários advocatícios à Firma, como tampouco terá que reembolsá-la por quaisquer despesas incorridas com o Litígio.
9. Desligamento. A Firma reserva-se o direito de imediatamente se desligar da sua representação no Litígio, independente do seu andamento, nas seguintes hipóteses:
A. Caso descubramos qualquer falsidade nas informações prestadas pela senhora, ou a sua não revelação de informações importantes solicitadas em relação ao Litígio;.
B. Caso descubramos que não há responsabilidade das eventuais partes do Litígio, ou que não há seguro suficiente ou bens confiscáveis que justifiquem a consecução do Litígio;
C. Caso a senhora negue, sem fundamento, a aprovação de uma oferta de acordo, ou se recuse a colaborar com a nossa representação da sua causa;
D. Caso a senhora pratique algum ato ou atividade contrária à nossa recomendação que, em nossa opinião, constituir-se-ia numa violação nas Normas Disciplinares de Conduta Profissional do Estado do Texas, ou de qualquer outra lei.
A Firma a notificará, por escrito sobre a nossa intenção de nos desligarmos, e qualquer direito de desligamento da contratação exercido pela Firma, nos termos deste contrato, dar-se-á em cumprimento com o que dispõe a Regra 1.15 das Normas Disciplinares de Conduta Profissional do Estado do Texas.
Se a Firma se desligar sem justa causa, a mesma não fará jus a honorários ou ao reembolso das despesas incorridas com o Litígio, previstas neste contrato. A senhora entende que se a dispensa da Firma ocorrer por sua decisão, sem justa causa, a Firma poderá ter assegurado o direito à totalidade ou à parte dos honorários e/ou despesas previstos neste Contrato.
1. Associação de Advogados. A senhora entende que poderá haver a necessidade, por parte da firma, de associar advogados adicionais para cuidar do Litígio desta causa. A decisão de associar outros advogados caberá exclusivamente à Firma, e quaisquer honorários pagos a estes advogados adicionais serão pagos dos honorários auferidos, nos termos deste contrato.
2. Sistema de Princípios dos Advogados do Texas. A Firma lhe dá ciência de que aderimos à letra e ao espírito do Sistema de Princípios dos Advogados do Texas -- Um Mandamento em Prol do Profissionalismo.
3. Local de Celebração. Este Contrato entre a Cliente e a Firma é celebrado na Comarca de Travis, no Estado do Texas.
4. Data de Vigência. O contrato entrará em vigor a partir da data da sua assinatura pela Cliente.
Este contrato será regido, interpretado e cumprido de acordo com as leis do Estado do Texas, independente da escolha dos dispositivos legais, estatutos ou regulamentos que digam respeito à escolha do foro competente, independente, inclusive, de as partes serem desta ou de qualquer outra jurisdição.
Este contrato é a expressão integral do entendimento havido entre as partes, sobrepondo-se a todo e qualquer acordo ou entendimento anterior entre elas, acerca do assunto aqui tratado. Este Contrato somente poderá ser alterado, mediante termo aditivo escrito e assinado por ambas as partes.

Los medicamentos herbarios no deben incluir en su formulación sustancias estupefacientes o psicotrópicas de origen sintético o natural, ni mezclas con medicamentos alopáticos, hormonas animales o humanas u otras sustancias que contengan actividad hormonal o antihormonal o cualquier otra que represente un riesgo para la salud.
Los medicamentos herbarios pueden utilizar para su comercialización nombre comercial, nombre común o nombre científico de la planta medicinal empleada en su fórmula. El nombre del medicamento herbario no debe inducir o sugerir el uso indebido del mismo.
Cuando Autoridad Nacional de Productos Farmacéuticos, Dispositivos Médicos y Productos Sanitarios (ANM), tenga conocimiento que una planta medicinal o mezcla de ellas muestre indicios de efectos tóxicos o acumulativos, o cualquier otro riesgo para la salud, puede prohibir la importación, elaboración, almacenamiento, distribución o venta del medicamento herbario que las contenga.
Artículo 82°.- De las plantas o recursos que no requieren registro sanitario
Las plantas medicinales de uso tradicional y otros recursos de origen natural de uso medicinal que se ofrezcan sin referencia a propiedades terapéuticas, diagnósticas o preventivas pueden comercializarse sin registro sanitario.
Los preparados de fórmulas magistrales y los preparados oficinales a base de plantas medicinales no requieren registro sanitario.
Artículo 83°.- Clasificación de los medicamentos herbarios
Los medicamentos herbarios se clasifican en:
1. Medicamentos Herbarios de Uso Medicinal.
2. Productos Herbarios de Uso Tradicional.
3. Recursos Herbarios de Uso Tradicional.
1. MEDICAMENTOS HERBARIOS DE USO MEDICINAL
Artículo 84°.- Registro sanitario de medicamentos herbarios de uso medicinal
El registro sanitario de medicamentos herbarios de uso medicinal se otorga por nombre, forma farmacéutica, cantidad de sustancia activa, fabricante y país.
Artículo 85°.- Requisitos para la inscripción y reinscripción de medicamentos herbarios de uso medicinal
Para la inscripción y reinscripción en el registro sanitario de los medicamentos herbarios de uso medicinal, el interesado debe presentar los siguientes requisitos:

Herbal medications are not to contain synthetic or natural narcotic or psychotropic substances in their formulations, nor are they to be mixed with allopathic medications, animal or human hormones, or other substances with hormonal or antihormonal activity, or any other substance that poses a risk to health.
Herbal medications can use a brand name, common name or the scientific name of the medicinal plant employed in their formulation for commercialization purposes. The herbal medication name should not induce or suggest its inappropriate use.

No sanitary registration is required for both compounded and lab formulation preparations based on medicinal plants.
