Croatian to German: Allgemeine Vertragsbedingungen zum Chartervertag
Source text - Croatian OPĆI UVJETI CHARTER UGOVORA
1. PLAĆANJE: Korisnik se obavezuje doznačiti na račun wwww d.o.o. pune iznose uplate za smještaj na plovilu, a prema punim upisanim iznosima i terminima na Potvrdi rezervacije / računu. Uplata se može izvršiti gotovinom ili bankovnom transakcijom. Svi bankovni troškovi su obaveza korisnika/pošiljatelja uplate.
wwww zadržava pravo otkaza najma plovila ako prva uplata nije stigla unutar 15 dana od potvrde rezervacije / bookinga, kao i ako druga uplata nije stigla 15 dana prije početka čartera.
Korisnik se obvezuje najkasnije jedan tjedan prije početka najma dostaviti na online link E-crew ili emailom popis posade i putnika, sa imenima i prezimenima, brojevima putovnica, državljanstvom, mjestom i datumom rođenja, kao i fotokopije skiperske i VHF radio dozvole, sa vidljivim brojevima i slikom.
2. NAJAMNINA: Najamnina sadrži samo cijenu za smještaj na plovilu i njegovo korištenje. U najamninu nisu uključeni troškovi hrane, goriva, vode i vezova u ostalim marinama tijekom najma. Plovilo se predaje korisniku u ispravnom stanju, prema inventornoj check-in listi, čisto i s punim tankovima goriva i vode, plinom za kuhanje, sa posteljinom i ručnicima za sve članove posade, te ga je u istom stanju potrebno i vratiti. Za brodove koji nemaju stalni vez u ACI marini Split, plaćen je samo dnevni vez za check-in i za check-out.
3. PRIMOPREDAJA PLOVILA: wwww se obvezuje da će predati ispravno i čisto plovilo u ugovoreno vrijeme. Ukoliko wwww iz bilo kojeg razloga ne stavi na raspolaganje korisniku ugovoreno plovilo u ugovoreno vrijeme, tada mora u roku od 24 sata staviti na raspolaganje zamjensko plovilo sličnih ili boljih karakteristika. U slučaju da se prekorači taj rok, korisnik ima pravo raskinuti ugovor i tražiti povrat punog iznosa najamnine.
U slučaju kada korisnik za vrijeme trajanja najma nije u mogućnosti koristiti plovilo zbog neispravnosti plovila, a popravak nije riješen unutar prvih 24 sata od prijave kvara, korisnik ima pravo na povrat iznosa dnevnog najma samo za svaka slijedeća 24 sata. Bilo koje drugo pravo na odštetu je isključeno. Vrijedi samo za navigaciju u hrvatskim teritorijalnim vodama!
Korisnik je dužan prilikom primopredaje plovila utvrditi da li je plovilo u ispravnom stanju i ima li svu opremu navedenu u check-in listi. Eventualni prigovori podnose se prilikom primopredaje plovila, te se moraju napisati i potpisati na check-in listi. Nedostaci koji nisu utvrđeni prilikom primopredaje ne daju pravo korisniku na sniženje najamnine. Vrijedi samo za navigaciju u hrvatskim vodama!
Korisnik se obvezuje vratiti plovilo u ugovoreno vrijeme. Ukoliko zakasni s vraćanjem plovila, korisnik jamči da će platiti iznos dnevnog najma za kašnjenje do tri sata, a za kašnjenje preko tri sata da će platiti trostruku dnevnu najamninu i to sa svim dodatnim troškovima koji su nastali za wwwww zbog zakašnjenja vraćanja plovila. Zakašnjenje može biti opravdano samo u slučaju više sile, o čemu korisnik mora odmah obavijestiti wwww.
Translation - German ALLGEMEINE VERTRAGSBEDINGUNGEN ZUM CHARTERVERTRAG
1. ZAHLUNGSBEDINGUNGEN - Der Charterer verpflichtet sich eine ordentlich geregelte Zahlung des Charterpreises auf das Konto der Fa. wwww innerhalb der in diesem Vertrag angegebenen Termine zu überweisen. Die Zahlung kann in bar oder per Bankantrag erfolgen. Alle Bankkosten sind von dem Kunden/Einzahler zu begleichen. Die wwww behält sich das Recht vor, den Chartervertrag zu kündigen, wenn der unterschriebene Vertrag mit der ersten Zahlung nicht innerhalb von 15 Tagen eingelangt ist.
Der Charterer verpflichtet sich, spätestens eine Woche vor dem Charterbeginn, eine Crew-Liste zuzusenden. Dabei ist die Angabe von Name, Geburtsdatum/-ort, Passnumer/gültigkeit und Staatsangehörigkeit erforderlich, sowie eine Kopie mit der Bootsführerschein - und Funkzeugnisnummer vom Skipper zuzustellen.
2. CHARTERPREIS - Der Charterpreis umfasst den Aufenthalt an Bord und die Nutzung des Bootes. Treibstoff, Gas, Wasser und Marina- und Anlegegebühren während der Charterdauer sind nicht enthalten im Preis. Der Charterer bestätigt das Boot in gutem, seetüchtigem Zustand, gereinigt und vollgetankt (Treibstoff, Wasser, Kochgas), vorschriftsmäßig ausgerüstet mit Bettwäschen und Handtüchern für die ganze Crew übernommen zu haben. Die Yacht und ihre Ausrüstung wird in gutem Zustand, gereinigt, komplett und vollgetankt zurückgegeben.
3. ÜBERGABE UND ÜBERNAHME DES BOOTES – Die wwww verpflichtet sich, das Boot in ordnungsgemäßem und seetüchtigem Zustand am vereinbarten Ort und zu vereinbarter Zeit zu übergeben. Wird das Boot, ungeachtet ihrer Ursachen, nicht rechtzeitig vom Vercharterer zur Verfügung gestellt, muss wwww, ggf. der Vercharterer innerhalb von 24 Stunden am vereinbarten Ort ein Ersatzboot der gleichen oder besseren Qualität sicher zu stellen. Kann die wwww innerhalb von 24 Stunden einen Ersatz nicht zu Verfügung stellen, hat der Charterer das Recht den Vertrag zu kündigen und er enthält von der wwww die geleisteten Zahlungen zurückerstattet. Kann der Charterer das Boot zum vereinbarten Chartertermin wegen seiner Mangelhaftigkeit nicht nutzen, hat der Charterer das Recht auf eine Rückerstattung des Tagescharterpreises für je 24 Stunden. Weitergehende Ansprüche des Charterers bestehen nicht.
Der Charterer verpflichtet sich, bei der Übergabe des Bootes die Ordnungsmäßigkeit, sowie die Vollständigkeit des Inventars anhand einer Checkliste des Vercharterers zu überprüfen und zu bestätigen. Eventuelle Einsprüche werden bei der Übergabe des Bootes eingelegt und diese sind anhand der Checkliste zu melden. Eventuelle versteckte Mängel am Boot, die dem Charterer bei der Übergabe des Bootes nicht bekannt sein könnten, berechtigen den Charterer nicht, den Leistungspreis zu vermindern. Der Charterer ist verpflichtet, das Boot an die wwww am vereinbarten Ort und zu vereinbarter Zeit zurückzugeben. Wird das Boot mit Verspätung oder an einem anderen Ort zurückgegeben, hat der Charterer für eine Verspätung innerhalb von 3 Stunden eine Entschädigung in Höhe von einem Tagescharterpreis zu leisten. Bei verspäteter Rückgabe über 3 Stunden hat der Charterer den dreifachen Tagescharterpreis zu zahlen, zuzüglich der dem Vercharterer wegen der verspäteten Rückgabe des Bootes entstandenen Kosten. Nur im Fall höherer Gewalt gilt die Verspätung als gerechtfertigt, worüber aber, der Charterer die wwww, ggf. den Vercharterer sofort informieren muss.
Croatian to English: INTRODUCTION FOR THE 'PERFORATIONS' BY S. TOMIĆ
Source text - Croatian Animirane sekvence simuliraju trodimenzionalni prostor ispunjen antropomorfnim likovima koje okružuju prijeteće strukture u crno-bijelo-sivim tonovima. One se izmjenjuju, prolaze jedna kroz drugu i sudaraju se stvarajući ozračje hladnog high-tech prostora te kod promatrača pobuđuju asocijacije na katastrofične vizije teoretičara postmodernizma kao što su primjerice Lyotard, Baudrillard i Virilio koji su virtualizaciju svijeta putem elektroničkih medija prepoznali kao opasnost koja ugrožava samu čovjekovu bit pa čak i njegov opstanak pretvarajući ga u kiborga, tijelo nerazlučivo od njegove elektronske proteze. No, promatrač brzo prestaje razmišljati o sižeu jer ga počinje intrigirati način reprezentacije. Tomić ovdje primjenjuje strategiju hipermedijacije i usmjerava promatrača kako na digitalni medij tako i na grafički medij koji mu je imanentan. Umjetnik kreira osebujan i visoko estetizirani virtualni svijet koristeći liniju, crno-bijeli kontrast i tonske varijacije crne, bijele i sive boje, elementarna izražajna sredstva klasične grafike prevedena u binarni jezik digitalnog sustava.
Translation - English Animated sequences simulate a three-dimensional space filled with anthropomorphic characters that surround menacing structures in black-white-grey tones. They alternate, passing through each other and collide, creating an atmosphere of cold high-tech space. At the viewer, they arouse associations to catastrophic visions of postmodern theoreticians such as Lyotard, Baudrillard, and Virilio, who recognized the virtualization of the world via electronic media as a danger that threatens the man's very essence and even its survival, turning him into a cyborg with a body indistinguishable from its electronic prosthesis. Hence, the observer soon stops thinking about the topic because the manner of representation begins to intrigue him. At this point, the artist applies the strategy of hypermediacy to guide the viewer both to the digital and the graphic medium, which is immanent to him. The author creates a distinctive and highly aestheticized virtual world using the line, black and white contrast and tonal variations of black, white and grey, elementary means of expression of the classical graphics translated into a binary language of the digital system.
Croatian to English: SVJETLOSNA INSTALACIJA NA ZLATNIM VRATIMA U SPLITU / LIGHT INSTALLATION AT THE GOLDEN GATE IN SPLIT General field: Art/Literary
Source text - Croatian Osnovna teza ovog umjetničkog istraživanja polazi od svjetlosti kao medija kojim se povijesni prostor Zlatnih vrata u Splitu „osvjetljava“ u doslovnom i simboličkom smislu. Postavljajući naglasak na odnos pojmova suvremenog i povijesnog s mogućnošću njihove izmjene i preplitanja u ovom je umjetničkom istraživanju pokazno kako se posredstvom svjetlosne instalacije suvremenost nadovezuje na povijesnu matricu, odnosno kako suvremenost izvire iz rakursa povijesne imaginacije.
Prostor Zlatnih vrata istražen je i u kontekstu teorije mjesta i nemjesta. Zlatna vrata mogu se naime tumačiti kao identitetsko povijesno mjesto gdje je veza između ljudi i kulturne baštine duboko ukorijenjena. Mjesto Zlatnih vrata kao uporište kolektivnih identiteta kroz generacije stoji u suprotnosti sa dominirajućim vakantnim prostorima bez identitetā - nemjestima istoga grada.
Svjetlost je središnji element ovog istraživanja. Zbog svoga simboličkog i metafizičkog značenja ono oduvijek predstavlja bitan čimbenik u arhitektonskom oblikovanju i urbanističkom planiranju. Polazeći od ove opće odrednice moguće je zaključiti kako je i unutar kasnoantičke arhitekture Dioklecijanove palače svjetlost bila bitan čimbenik u njezinom planiranju i oblikovanju.
Svjetlost se koristi i kao medij u suvremenom umjetničkom stvaralaštvu, pa ona predstavlja i ključan element koji se koristi i u umjetničkoj intervenciji u javnom prostoru. Kroz vlastito umjetničko istraživanje naznačena je različitost pristupa elementu svjetlosti u suvremenoj umjetnosti.
Moguće je zaključiti kako kružni snop svjetla usmjeren na Zlatna vrata, koja su arhitektonski okvir za kasnoantički, panteistički, religijski ali i carski propagandni program, ističe, te objedinjuje istražena tumačenja šireći i preklapajući ih. U susretu arhitekture i svjetla nastala je nova struktura koja ističe, ali i nadilazi parametre kako arhitekture, tako i umjetničkog rada. Taj novi međuodnos arhitekture i umjetničke instalacije potiče na osvještavanje simboličke snage mjesta Zlatnih vrata i povijesti grada Splita u cjelini.
Translation - English The basic thesis of this artistic research rests on the light as a medium that ''illuminates'' the historical space of the Golden Gate in Split both literally and symbolically. By eliciting the relationship between terms of contemporary and historical concepts with the possibility of their alteration and interweaving, this art study shows that a historical matrix by virtue of light installation complements modernity. Strictly speaking, it indicates how modernity emerges from the realm of historical imagination.
One explores the space of the Golden Gate in the context of the theory of place and non-place. However, one may interpret the Golden Gate as a historical place of identity with a deeply rooted tie between people and cultural heritage. The location of the Golden Gate as a mainstay of collective identities through generations stands in contrast with the dominant vacant spaces without identity, i.e. with non-places of the same city.
Light is the dominant element of this research. Through the medium of its symbolic and metaphysical significance, it has always been a fundamental factor in architectural design and urban planning. Having these general guidelines on the mind, one may conclude that light was a crucial factor in its planning and design during the late antique architecture of Diocletian's Palace.
One also uses light as a medium of contemporary artistic creation.
Therefore, it also represents a crucial element in the artistic intervention within the public space. Through own artistic research, it indicates the diversity of approaches to the element of light in the contemporary art.
This may suggest that the circular beam of light pointed at the Golden Gate, representing an architectural framework for late antiquity, pantheistic, religious and an imperial propaganda programme as well, highlights and integrates the researched interpretations by spreading and folding them. A new structure emerged in the encounter of architecture and light. It simultaneously stands out and goes beyond the parameters of architecture and artwork. The new interrelation between architecture and art installation encourages the awareness of the symbolic strength of the Golden Gate and the history of the city of Split as an entirety.
