I recenti anni sono stati caratterizzati da una sempre più evidente crescita dei paesi cosiddetti emergenti (Cina in primis) e da una sostanziale difficoltà dei paesi “maturi” (USA ed Europa in primis) nel mantenere soddisfacenti condizioni di crescita dell’economia.
Tra gli effetti principali, derivanti dalle differenti performance delle economie mature rispetto a quelle emergenti, vale la pena rilevare una sempre maggior difficoltà, e per certi versi aleatorietà, nell’individuare opportunità d’investimento che, a fronte di un adeguato profilo di rischio, permettano di ottenere un soddisfacente livello di rendimento.
Infatti, nelle economie mature le principali opportunità si sono manifestate per lo più a fronte di “bolle speculative” (Internet a cavallo del nuovo millennio, Real Estate che ha caratterizzato l’ultimo quinquennio) con profili di rischio molto elevati e rendimenti aleatori e fluttuanti. Le opportunità d’investimento tradizionali (ad esempio, Private Equity in aziende sane non quotate o investimenti in aziende quotate blue chips) sono state e sono caratterizzate da una generalizzata difficoltà a individuare le aziende target in quanto spesso i corrispondenti settori industriali sono soggetti a profonde ristrutturazioni e cambiamenti tipici delle economie mature (ad esempio, distretti industriali automotive, settore del tessile). In queste economie mature sembra emergere sempre più il modello della specializzazione di nicchia (di servizio e di prodotto) che per definizione non richiede normalmente elevati, in termini assoluti, investimenti per la crescita. A puro titolo esemplificativo e a dimostrazione delle generalizzata difficoltà a individuare investimenti nell’area delle economie mature, si pensi al fondo Management & Capitali, quotato alla Borsa di Milano, che, seppur a fronte di una dotazione superiore ai 500 Milioni di Euro, non ha praticamente perfezionato nessuna operazione di rilievo negli ultimi 18 mesi.
Nelle economie emergenti le opportunità d’investimento sono state e sono superiori in termini quantitativi e qualitativi. Peraltro tali opportunità si scontrano spesso con generalizzate difficoltà nel reperire adeguate informazioni necessarie per valutare l’investimento, con elevata complessità nell’individuare, fra le numerose opportunità presenti, quelle che mostrano un rapporto rischio/rendimento adeguato, con difficoltà nel dotarsi di adeguati strumenti di controllo post-investimento, con complessità nell’individuare e valutare le opportunità di way-out.
2. Le difficoltà dei modelli tradizionali d’investimento
I modelli tradizionali d’investimento (fondo di private equity per aziende non quotate, fondo d’investimento per aziende quotate, hedge fund, ecc.) sembrano cogliere con difficoltà le opportunità d’investimento presenti sul mercato globale (l’intero pianeta) e fortemente differenziate per area geografica. Il concetto d’investimento tende infatti a declinarsi sempre più secondo proposte che possono variare rapidamente in termini territoriali e in termini di tipologia dell’investimento. A titolo esemplificativo e non esaustivo, dal 2000 e fino al 2005 le opportunità d’investimento nel settore Real Estate negli Emirati Arabi Uniti erano numerose, con un profilo di rischio sostanzialmente basso e con rendimenti attesi estremamente elevati. Dal 2006, tali opportunità sono sostanzialmente mutate e oggi si concretizzano in opportunità di realizzo, per coloro che hanno investito nel periodo 2000-2005, più che in nuove opportunità d’investimento. Vice versa, dal 2006 gli investimenti in IPO alla neo-nata Borsa di Dubai (DIFX) rappresentano opportunità emergenti con rapporti rendimento/rischio estremamente interessanti. E’ evidente che un Fondo d’investimenti specializzato in Real Estate in area MENA (che comprende anche gli Emirati Arabi Uniti) si ritroverebbe oggi impossibilitato a effettuare investimenti immobiliari, in quanto meno attrattivi rispetto ai rendimenti attesi, così come in IPO alla Borsa di Dubai essendo specializzato nel settore Real Estate.

1. Economies and investment opportunities
Recent years have been distinguished by an ever so obvious and more than clear growth of the so called “emerging countries” (China in the first place) and of substantial difficulties by the “industrialised mature” countries (USA and Europe at the forefront) in maintaining satisfactory levels of economic growth.
Amongst some of the main effects, generated by the different performances of the mature economies as compared to the emerging ones, it must be noted an increasingly more difficulty, and to some extent risky, identifying investments opportunities which, based on a proportioned risk profile, allow to achieve satisfying levels of returns.
In fact, throughout the mature economies the main opportunities have been for the most part based on “speculative bubbles” (Internet straddling the new millennium and Real Estate, which has characterised the last five years) featuring very high risk profiles and risky and fluctuating returns. Traditional investment opportunities (i.e.: Private Equity in healthy unlisted companies or investments in listed blue chips companies) have been and are characterised by a general difficulty in identifying target companies because more often than not the corresponding industrial sectors are undergoing deep restructurings and changes typical of mature economies (i.e.: industrial automotive districts and textile sector) .
In these mature economies, specialised niches’ type of investment (services and products) seem to stand out more, which by definition normally do not require, in absolute terms, high investments for growth. As a mere example and as proof of the general difficulty in identifying investments throughout the areas of mature economies, think of the Management & Capitali fund listed at the Borsa of Milano which, although provided with an endowment exceeding 500 Million Euro, has not basically finalised any important operation in the last 18 months.
Throughout the emerging economies, investment opportunities have been and are higher in terms of quantities and quality. However, such opportunities often clash with the general difficulties in gathering information suitable at assessing the investment along with rather high complexities in identifying, among the numerous opportunities present, those which bear a suitable risk/return ratio, and thus the difficulty in being provided with appropriate instruments for post-investment monitoring and the complexity in identifying and assessing the way-out (divestment) opportunities.
2. Difficulties posed by traditional forms of investments
Traditional investment funds (unlisted companies private equity funds, listed companies investment funds, hedge funds, etc…) seem to meet some difficulties in recognising and seizing investment opportunities present on the global market (the entire world) and strongly differentiated per geographical areas. In fact, investment concepts tend to be applied more and more based on offers that can change in terms of territory and type of investment. As a mere example but not limited to, from 2000 up to 2005 investment opportunities in the Real Estate sector in the United Arab Emirates were numerous, with a risk profile basically low and with extremely high expected returns. Beginning 2006 such opportunities have substantially changed and today they embody sell-off opportunities for those who have invested during the period 2000-2005, rather than being now new investment opportunities. Viceversa, from 2006 investments in IPOs at the newly established Dubai Stock Exchange (DIFX) represent emerging opportunities bearing extremely interesting risk/ return ratios. Thus it becomes evident that an Investment Fund targeting Real Estate in the MENA area (comprising also the United Arab Emirates) would find itself unable to carry out real estate investments, because less attractive as compared to the expected returns as well as in IPOs at the Dubai Exchange being specialised in the Real Estate sector.
Thus we can reasonably conclude that investments, with an acceptable return against an acceptable risk profile, must be based more on the capacity of identifying, in terms of type and geographical area, the emerging opportunities, and being also able to assess the expected life cycle of such opportunities and consequently the best way-out (divestment)

1. Il Decreto Legislativo n. 231/2001
1.1 La responsabilità “amministrativa” da reato delle persone giuridiche, delle società e delle associazioni anche prive di personalità giuridica
Il D.Lgs n. 231 dell’8 giugno 2001 (di seguito indicato anche come “Decreto” o “Provvedimento”), recante disposizioni sulla “Disciplina della responsabilità amministrativa delle persone giuridiche, delle società e delle associazioni anche prive di personalità giuridica”, ha dato attuazione alla delega contenuta nell’art. 11 della legge n. 300 del 29 settembre 2000.
Detta legge di delegazione autorizzava la ratifica e dava esecuzione a diverse Convenzioni internazionali, quali la “Convenzione di Bruxelles del 26 luglio 1995 sulla tutela degli interessi finanziari delle Comunità Europee ”; la “Convenzione di Bruxelles del 26 maggio 1997 sulla lotta alla corruzione nella quale sono coinvolti funzionari della Comunità Europea o degli Stati membri ”; la “Convenzione OCSE del 17 dicembre 1997 sulla lotta alla corruzione di pubblici uficiali stranieri nelle operazioni economiche e internazionali ”.
In ottemperanza agli obblighi internazionali e comunitari, il Decreto in esame ha quindi introdotto nel nostro Ordinamento una forma di responsabilità diretta degli enti collettivi, collegata ad alcuni tipi di reato: responsabilità definita “amministrativa”, ma in tutto assimilabile a una vera e propria forma di responsabilità penale e, pertanto, generalmente considerata tale. In realtà, al di là della denominazione usata dal Legislatore, la responsabilità in questione, definita un “tertium genus” dalla Relazione di accompagnamento al Decreto, sembra doversi considerare nella sostanza una forma di responsabilità penale, in quanto:
- sorge in connessione con il compimento di alcuni reati (e non di illeciti amministrativi);
- rientra nella cognizione del giudice penale ed è regolata da principi fondamentali del sistema penale;
è autonoma e persiste anche quando “l’autore del reato non è stato identificato o non è imputabile”, ovvero anche quando “il reato si estingue per una causa diversa dall’amnistia”, ai sensi dell’art. 8 del Decreto

1.1 “Administrative” responsibility for crimes by physical entities, companies and associations, even void of juridical status
The Legislative Decree n. 231 of June 8 2001 (hereinafter called also for short “Decree” or “Provision”), bearing provisions pertaining to the “Discipline of the administrative responsibility of corporations, companies and associations even void of juridical status” has implemented the authorisation contained in art. 11 of Law nr. 300 of September 29 2000.
Said delegated law authorised ratification and gave execution to various international Conventions such as “Convention of Brussels dated July 26 1995 about the safeguard of financial interests of the European Communities”; the “Convention of Brussels dated May 26 1997 about fighting corruption in which officers of the European Community or Member States have been involved” , the “ OCSE (Organisation for the European Cooperation and Development) Convention dated December 17 1997 about fighting corruption of public foreign officers in international financial operations”..
In compliance with the international and European Community obligations, the Decree has, therefore, introduced in our Legal System a form of direct responsibility by the collective institutions connected to some type of crimes: responsibility defined “administrative”, but altogether similar to a true and bonafide form of criminal responsibility and , thus, generally considered as such. Actually, beyond the name used by the Legislator, the responsibility in question, defined “tertium genus”(third element) from the Report accompanying the Decree, substantially seems that it has to be considered a form of criminal responsibility because:
- it emerges in connection with the perpetration of some crimes (regulatory crimes);
- it is included in the jurisdiction of a criminal judge and is regulated by the basic principles of the criminal system;
it is autonomous and is effective even when the “perpetrator of the crime has not been identified or chargeable”, or rather even when the “crime is extinguished due to a cause different than amnesty”, according to art. 8 of the Decree.

1. Le disposizioni di cui alla legge 21 febbraio 1991, n. 52, sono estese ai crediti verso le stazioni appaltanti derivanti da contratti di servizi, forniture e lavori di cui al presente codice, ivi compresi i concorsi di progettazione e gli incarichi di progettazione. Le cessioni di crediti possono essere effettuate a banche o intermediari finanziari disciplinati dalle leggi in materia bancaria e creditizia, il cui oggetto sociale preveda l'esercizio dell'attività' di acquisto di crediti di impresa.
2. Ai fini dell'opponibilita' alle stazioni appaltanti che sono amministrazioni pubbliche, le cessioni di crediti devono essere stipulate mediante atto pubblico o scrittura privata autenticata e devono essere notificate alle amministrazioni debitrici.
3. Le cessioni di crediti da corrispettivo di appalto, concessione, concorso di progettazione, sono efficaci e opponibili alle stazioni appaltanti che sono amministrazioni pubbliche qualora queste non le rifiutino con comunicazione da notificarsi al cedente e al cessionario entro quindici giorni dalla notifica della cessione.
4. Le amministrazioni pubbliche, nel contratto stipulato o in atto separato contestuale, possono preventivamente accettare la cessione da parte dell'esecutore di tutti o di parte dei crediti che devono venire a maturazione.
5. In ogni caso l'amministrazione cui e' stata notificata la cessione può' opporre al cessionario tutte le eccezioni opponibili al cedente in base al contratto relativo a lavori, servizi, forniture, progettazione, con questo stipulato

Art. 117.
Assigning credits generated by contracts

6. The provisions in Law nr. 52 of February 21 1991 are extended to credits of contracting clients generated by service, supply and works contracts, as described in the preceding code, therein included the tenders planning competitions and planning mandates.
Credits assignments may be carried out to banks or financial brokers governed by laws on credits and banking matters and whose company objectives provides for the practice of purchasing corporate credits.
7. For the purposes of enforceability to contracting clients, which are public administrations, credits transfers must be stipulated through a public deed or agreement and must be notified to the debtors administrations..
8. Credit assignments for considerations from contract, concession, tenders planning competitions are effective and enforceable to contracting clients which are public administrations when these do not refuse them, through communication notified to the transferor and transferee within fifteen days from the transfer notification.
9. Public administrations through stipulated contract or contextual separate document may in advance accept assignments by the executor of all or part of the credits which will become due.
10. However, the administration to which the assignment of credits has been notified can object to the transferee all the objections opposable to the transferor based on the contract of works, services, supply and planning stipulated with the same

2.3 I crimini di identità e le interdipendenze con la falsificazione documentale e il crimine organizzato. Il caso del riciclaggio di denaro sporco e del finanziamento illecito al terrorismo
Tra le peculiarità del fenomeno dei crimini di identità vi sono due elementi che li caratterizzano in modo particolare: da un lato, si tratta di crimini che, per la loro relativa semplicità e per la mancanza di adeguate contromisure di prevenzione e contrasto, sono sempre più appannaggio di singoli individui e piccoli gruppi, spesso strutturati; dall’altro, sono strettamente correlati con altri fenomeni criminali transnazionali, gestiti dal crimine organizzato, di frequente in collaborazione con cellule di matrice etnica.
Inseriti, quindi, nelle dinamiche generali della criminalità, i crimini di identità rappresentano un tassello fondamentale di un fenomeno estremamente complesso, in particolare se si considera la criminalità internazionale e le interdipendenze con la falsificazione documentale, l’immigrazione clandestina e il traffico di essere umani, il riciclaggio di denaro sporco e il finanziamento illecito al terrorismo.
La falsificazione documentale è il presupposto inevitabile e necessario dei crimini di identità sia che si tratti di un furto o di una frode di identità . Dalla falsificazione “artigianale” a quella organizzata, fino agli acquisti dei falsi via Internet, viene riprodotto e venduto qualunque tipo di documento nazionale ed estero, dalle carte di identità e i passaporti, ai visti e ai permessi di soggiorno, alle patenti, ai titoli di studio, alla documentazione di reddito… Nella maggior parte dei casi, non si tratta di documenti di alta qualità, difficili da identificare come falsi. Al contrario, contengono spesso anomalie o errori grossolani che potrebbero essere facilmente identificati.
Il ricorso alla falsificazione documentale è molto frequente nel traffico di essere umani, così come nel favoreggiamento dell’immigrazione clandestina e del lavoro nero .
Non si tratta certo di un fenomeno nuovo, come dimostrano i dati inerenti gli Stati Uniti e relativi a circa un decennio fa . Tra l’Ottobre 1996 e il Maggio 1998, ad esempio, sono stati individuati oltre 50mila immigrati illegali in possesso di circa 78mila documenti falsi, utilizzati soprattutto per ottenere un lavoro. In circa il 60% dei casi, si trattava di documenti emessi dalle autorità che si occupano di immigrazione, il 36% erano Social Security numbers, mentre il 4% erano documenti di altra natura, in particolare patenti di guida. Era evidente, già allora, la presenza di un vero e proprio mercato dei documenti falsi.
Anche l’Unione Europea si trova a fronteggiare la falsificazione massiva dei passaporti, dei visti di accesso, dei permessi di soggiorno e la contraffazione dei documenti di viaggio necessari per viaggiare nell’area Schengen. L’utilizzo di documenti falsi o rubati continua ad essere la tecnica più utilizzata per entrare illegalmente negli Stati Membri e il legame con i crimini di identità è sempre più evidente . EUROPOL definisce la contraffazione dei documenti come un’attività illegale capace, più di ogni altra, di facilitare il crimine .
Contrariamente alla percezione generale, quindi, la maggior parte degli immigrati non sono sprovvisti di documenti, le violazioni delle norme in materia di lavoro non sono definibili come “minori” e, soprattutto, i crimini di identità nel settore dell’immigrazione illegale non sono “senza vittime” .
Agli immigrati vengono “assegnate” identità false, ma in molti casi anche identità appartenenti a persone ancora in vita o decedute; vengono sfruttati, in particolare, quei dati personali che sono necessari per poter concludere un contratto di lavoro, spesso all’insaputa anche dello stesso datore.
Ad esempio, negli Stati Uniti sono frequenti i casi scoperti dalle autorità di polizia ; alcuni esperti stimano in circa il 75% il numero di immigrati, in età lavorativa, che utilizzano le Social Security Cards in modo fraudolento, per ottenere un lavoro . Nel 98% dei casi, poi, l’immigrato usa il suo nome, affiancandolo però ad un SSN falso o, più frequentemente, altrui; si tratta spesso dell’unico dato “rubato” alla vittima. Infatti, in questi casi, riuscire a realizzare un furto di identità totale è complesso e troppo costoso. Per questo motivo, viene utilizzato solo il SSN (SSN-only identity theft).
Negli Stati in cui è stato registrato un alto tasso di immigrazione illegale è stato riscontrato anche un alto livello di furti di identità nel settore del lavoro nero o comunque irregolare. In Arizona, il 33% di tutti i furti di identità è commesso proprio per ottenere un impiego e non per altre esigenze di profitto. In Texas la percentuale è del 27%, in New Mexico del 23%, in Colorado del 22%, in California del 20% e, in Nevada, del 16%. È interessante rilevare come 8 Stati – su 10 – con il più alto tasso di immigrati irregolari nella loro popolazione siano anche tra i primi 10 Stati con la maggiore incidenza del furto di identità (Arizona, California, Florida, Texas, Nevada, New York, Georgia, and Colorado).
Un aspetto di estrema attualità riguarda il fatto che gli immigrati irregolari che, anche tramite i crimini di identità, trovano lavoro negli Stati Uniti, trasferiscono annualmente somme ingenti di denaro nei loro Paesi di origine. Nel solo Ottobre 2008, sono stati trasferiti verso il Messico oltre $2,4 miliardi. Come già citato, la Banca Mondiale stessa ha stimato che, nel solo 2005, 175 milioni di migranti hanno trasferito oltre $230 miliardi.
Questi dati richiamano, inevitabilmente, il rischio di riciclaggio di denaro sporco, ma anche di finanziamento al terrorismo internazionale, in particolare di matrice islamica. In questo senso, il ruolo strumentale dei crimini di identità è ormai riconosciuto e condiviso sia dalla maggior parte degli Stati sia dagli organismi internazionali più rappresentativi, che sottolineano anche la centralità del crimine organizzato e le correlazioni con le sue attività di traffico .
I gruppi xxxxstani, ad esempio, sono particolarmente abili nei furti di identità e nelle frodi in danno delle carte di pagamento. In altri casi, gli affiliati alle cellule terroriste, vengono “istruiti” su come approcciare le persone nelle chat rooms oppure su come effettuare accessi abusivi a siti istituzionali e commerciali . Nell’Unione Europea, secondo EUROPOL, la maggior parte delle persone arrestate per sospetti casi di terrorismo, risulta coinvolta anche in casi di contraffazione o frode che sempre più spesso riguardano anche soggetti “insospettabili”, quali ad esempio gli enti caritatevoli o assistenziali.
In questo ambito, il ruolo delle nuove tecnologie e di Internet deve essere considerato centrale, proprio per l’influenza che riesce ad avere nell’offerta e nella diversificazione dei servizi finanziari e bancari, ma anche per la disponibilità di informazioni personali che possono essere riutilizzate nell’ambito di schemi di frode più ampi. In particolare, nuovi rischi sono stati analizzati per quanto concerne le carte di credito prepagate, le carte contactless o strumenti simili .
Anche il settore della telefonia mobile necessita sia di una analisi approfondita dei rischi di riutilizzo criminale dei servizi di ultima generazione, attuato proprio attraverso il furto o la frode di identità.
Attualmente, poi, come sottolineato dallo stesso xxxxxxx, nonostante nel tempo siano state ricostruite le modalità di organizzazione e sostegno ai gruppi di terroristi, non si è ancora giunti invece allo sviluppo di indicatori specifici per supportare le istituzioni finanziarie nell’identificare in via preventiva i possibili casi sospetti.
Di contro ad un fenomeno che avanza ed evolve, la conoscenza fatica ancora a tradursi in strumenti conoscitivi di tipo operativo, che supportino concretamente tutti gli attori nella prevenzione attiva dei casi e nell’individuazione tempestiva delle evoluzioni del fenomeno.

2.3 Identity related crimes and their interdependence with document falsification and organised crime. The cases of money laundering and illegal financing of terrorism.
Among the peculiarities of the phenomena of identity related crimes there are two elements characterising them in a special way: on one hand, they are crimes which, for their relative simplicity and lack of appropriate countermeasures of prevention and contrast have become more and more the prerogative of single individuals and small groups, often organised; on the other, they are closely related to other transnational criminal phenomena handled by organised crimes, often in cooperation with cells of ethnic matrix..
Thus, being part of the general dynamics of criminality, identity related crimes represent a fundamental element of an extremely complex phenomenon, especially if we consider international criminality and its interdependence with document falsification, clandestine immigration and traffic of human beings, money laundering and illegal financing of terrorism.
Document falsification is the inevitable and necessary prerequisite for identity related crimes, whether it is about a theft of identity or identity related crimes . From “home-made” to organised type of falsification, up to purchases via Internet, any national or foreign type of document is produced and sold, from ID cards to passports, to visas and stay permits, to drivers licenses, schools diplomas, to income documentations…In most cases they are not documents of high quality and difficult to identify as fake. On the contrary, they often contain abnormalities and gross errors which can be easily detected. .
Use of false documents is very frequent in the traffic of human beings, as well as in abetting clandestine immigration and unregistered labour .
As proven by the data from the United States pertaining to about a decade ago , it is certainly not about new phenomena. For example, between October 1996 and May 1998, over 50 thousands illegal immigrants were found in posses of about 78 thousands false documents utilised especially to secure a job. In about 60% of the cases they were documents issued by the immigration authorities, 36% were Social Security numbers, while 4% were other types of documents, in particular drivers licenses. It was very evident then of the presence of a true and actual market of false documents.
The European Union too is facing massive falsification of passports, entry visas, stay permits and counterfeiting of travelling documents necessary for moving-about the Schengen area. The use of false or stolen documents continues to be the most utilised method for entering illegally the Member States and ties with identity related
crimes become more and more evident. . EUROPOL defines documents counterfeiting as an illegal activity capable, more than anything else, of facilitating crime .
Therefore, contrarily to the general perception, most of the immigrants are not undocumented, violations of labour laws are not definable as “minors” and, above all, identity related crimes in the sector of illegal immigration are not “victimless” .
Immigrants are “assigned” with false identities, but in many cases even with identities belonging to people still alive or deceased; in particular, those personal data necessary for finalising a work contract are often exploited unbeknownst even to the same employer.
Example, in the United States cases discovered by the police authorities are very frequent; some experts estimate that to be about 75% of the immigrants in working ages who utilise Social Security Cards, to obtain a job fraudulently . In 98% of the cases then, the immigrant uses his name associating it though with a false or more frequently with someone else’s’ SSN; often it is the only data “stolen” from the victim. In fact, for these cases, managing to accomplish a total theft of identity can be too complex or too costly, for this reasons only the SSN (SSN-only identity theft) is utilised.
In those States where a high rate of illegal immigration has been recorded, a high rate of thefts of identities has also been detected in the undocumented or anyway irregular labour sector. In Arizona, 33% of all thefts of identity have been perpetrated exactly for securing a job and not for other gains. In Texas the percentage is 27%, in New Mexico 23%, in Colorado 22%, in California 20% and, in Nevada, 16%. It is interesting to note how 8 out of 10 States with the highest rate of illegal immigrants among their population are also among the first 10 States with the higher rate of thefts of identities (Arizona, California, Florida, Texas, Nevada, New York, Georgia, and Colorado).
An extremely current aspect pertains to the fact that illegal immigrants who find jobs in the United Sates even through identity related crimes, succeed in transferring annually large sums of monies in their Countries of origin. Just in the month of October 2008, over $2.4 billions were transferred to Mexico. As already mentioned, the World Bank itself has estimated that, just in 2005 alone, 175 million of migrants transferred over $230 billion.
These data inevitably bring to mind not only of the risk of money laundering, but also of financing international terrorism, especially of Islamic matrix. For this reason the instrumental role of identity related crimes is already recognised and shared either by most States as well as by the most representative international bodies, which point out also the central role of organised crime and its relations with trafficking activities .
XXXstani groups for example, are especially skilful in the thefts of identity and frauds to the detriment of non-cash means of payment. In other cases, terrorist cells adepts are literally “trained” on how to approach people in chat rooms or how to gain illegal accesses to institutional and commercial sites . According to EUROPOL, most of the people arrested for suspected cases of terrorism in the European Union, show to be involved also in cases of counterfeiting or frauds , which ever more often involve also “unsuspected” subjects “, such for example charitable or aid institutions.
In this field the role of new technologies and Internet must be considered pivoting, exactly because of the influence it bears in the offer and diversification of the financial and banking services, but also for the availability of personal data, which can be reutilised as part of broader schemes of frauds. In particular, new risks have been examined pertaining prepaid credit cards, contactless cards and similar instruments .
Even the mobile telephony sector needs an in-depth analysis as well about the risk of criminally connected reutilisations of the latest generation services implemented exactly through thefts of identities or identity related frauds...
Currently then, as pointed out by the same XXXXX in spite of the fact that in time methods of organisation and support to terrorists groups have been reconstructed, specific indicators for supporting financial institutions in preventively identify possible suspect cases, have not yet been developed..
In the face of a phenomenon which advances and evolves, learning it still struggles in translating the phenomena in operational type of fact-finding instruments, which could support all stakeholders in active prevention of cases and quickly identify the evolutions of the phenomena.

10. PENALITA’ IN CASO DI RECESSO

12. CLAUSOLA PENALE
Nel caso in cui avremo dichiarato di avvalerci della clausola risolutiva di cui al punto che precede, tratterremo, a titolo di penale, l’importo da Voi versato alla sottoscrizione del presente contratto, fermo ed impregiudicato il nostro diritto al risarcimento del maggior danno.
13. UTILIZZO DIRETTO
Il Cliente si impegna a non destinare i locali oggetto del presente contratto a scopi differenti da quelli concordati e a non cederli a terzi, impegnandosi altresì a utilizzati esclusivamente per il periodo concordato e specificato nel presente contratto.
14. ALLESTIMENTI E RIMOZIONE DEGLI STESSI
14.1 Per l’utilizzo di materiali e cartelloni promozionali o pubblicitari e comunque per ogni forma di allestimento, il cliente è tenuto a concordare le modalità con il sig. Marco XXXX, Direttore di XXXXXXX.
14.2 Tutte le costruzioni e produzioni realizzate da e per conto del cliente dovranno essere fatte in modo accurato e professionale. Tutti gli allestimenti dovranno essere progettati in rispetto della regolamentazione di sicurezza di legge.
14.3 Ogni fornitore esterno che abbia necessità di installare attrezzature o realizzare costruzioni, ed entrare quindi nella struttura, dovrà ricevere nostra preventiva approvazione scritta.
14.4 Tutti i materiali noleggiati direttamente dal cliente, così come quelli di proprietà dello stesso, dovranno essere rimossi dai nostri locali entro e non oltre ........ giorni dalla chiusura della manifestazione.
14.5 Nel caso in cui detto termine non venga rispettato sarà addebitato il corrispettivo d’uso degli spazi, pari a € ……………… al giorno sino al dì dell’effettiva rimozione.
15. RISARCIMENTO DANNI
15.1 Nei muri, pavimenti, mobili, vetri, etc. è espressamente vietato fare fori, piantare chiodi, stendere vernici, adesivi in nastro o in pasta e comunque effettuare azioni che possano danneggiare i locali, se non dietro autorizzazione preventiva del Direttore di XXXXXXX.
15.2 I locali e tutte le attrezzature utilizzate dovranno esserci riconsegnate nello stato in cui sono state messe a disposizione.
15.3 Qualora durante l’utilizzo dei locali e delle attrezzature dovessero verificarsi danni di qualsiasi tipo, il Cliente sarà tenuto al risarcimento degli stessi, dietro semplice presentazione di preventivo scritto.
16. DANNI A PERSONE E/O COSE
Il Cliente, per tutta la durata della locazione e sino all’effettivo rilascio dei locali, solleva XXXXXXX, il suo Direttore e i suoi addetti da ogni e qualsivoglia responsabilità per danni cagionati a persone e/o cose e, pertanto, da qualsiasi relativa pretesa risarcitoria, che resterà a carico esclusivo del cliente.
17. FURTI
XXXXXXXX, il suo Direttore e i suoi addetti, non sono responsabili di eventuali furti o danneggiamenti di allestimenti, attrezzature, macchinari o qualsiasi altro oggetto installato, esposto o depositato negli spazi di utilizzo, nonché ogni altro oggetto anche personale portato, depositato o indossato all’interno dei locali.
18. NORME GENERALI
18.1 Il Cliente si impegna a rispettare i regolamenti e le norme in materia di pubblicità temporanea, spettacoli ed intrattenimenti musicali, mostre ed eventi in genere con particolare riguardo alle norme di P.S. in materia e al Regolamento Comunale di Polizia Urbana (tutela della quiete, riposo) e provvederà ad assolvere le formalità previste dalla legge sostenendone integralmente i relativi costi, compresi i diritti SIAE, sollevando sin da ora XXXXXXX e i suoi addetti da ogni responsabilità in merito.
18.2 Eventuali eventi o serate di inaugurazione dovranno essere preventivamente comunicati ed approvati dal sig. Marco XXXXXXX. Tutta la musica dovrà necessariamente ed inderogabilmente cessare entro e non oltre le ore 22,00.
19.GIURISDIZIONE E FORO COMPETENTE
Il presente contratto è sottoposto alla legge ed alla giurisdizione italiana. Per ogni controversia inerente o conseguente il presente contratto sarà esclusivamente competente il Foro di XXXXXX. 11. EXPRESS CANCELLATION CLAUSE
Failure of complying with anyone of the fulfilments provided and agreed upon by the Client on point 7 of the present contract for any reason, shall represent serious breach of the present contract, and shall give us the right to exercise rightful cancellation thereof, with consequent refusal of fulfilling the performances charged to us by the present contract, or, whereby already started, estopping them immediately.
12. PENALTY CLAUSE
In case we exercise the right to enforce the cancellation clause pursuant the preceding paragraph, we shall withhold, as penalty, the amount paid by you upon the signing of the present contract, notwithstanding and unprejudiced our right to demand compensation of higher damages.
13. DIRECT USE
The Client hereby undertakes the commitment not to allocate the leased facilities subject matter of the present contract to uses different that those agreed upon and not to sub-lease/transfer the same to third parties, thus undertaking also the commitment to utilise the facilities exclusively for the period agreed upon and specified in the present contract.
14. SET-UPS AND THEIR REMOVAL
14.1 For the use of materials and promotional or advertising posters and, anyway, for any type of set-up, the client shall be obligated to agree on their procedures with Mr. Marco XXXXXX, Director of XXXXXXXXXX.
14.2 All constructions and productions executed by and/or on behalf of the client shall be carried out in an accurate and professional manner. All set-ups must be planned in compliance with the safety rules required by the law.
14.3 Every outsourced supplier needing to install equipments or carry-out constructions and thus obtain entry to the facilities, must secure XXXXXX written approval in advance.
14.4 All materials directly leased or owned by the client, must be removed from our facilities within and not later than ........ days from the closing of the event.
14.5 In case of failure to comply with the above term, the amount for the use of the spaces of € ……………… per day up to the effective removal thereof, shall be charged to the client.
15. DAMAGES COMPENSATION
15.1 It is specifically forbidden to drill holes, drive nails, spread paints, ribbon or paste adhesives on walls, floors, furniture, windows/glasses, etc., and anyway carry-out actions that may damage the facilities, unless authorised in advance by the Director of XXXXXXXXXX.
15.2 The facilities and equipments utilised for the event/s must be handed-back in the same state in which they were placed at disposal.
15.3 If the facilities and equipments sustain any type of damages during their use, the Client shall be compelled to compensate them against simple submission of written estimate .
16. DAMAGES TO THINGS AND/OR PERSONS
For the entire duration of the lease and up to the effective vacation of the facilities, the Client shall release XXXXXXXXXX, its Director and its staff from any and all liabilities for damages caused to persons and/or things and, thus, from any related compensation claim, which shall remain the sole responsibility of the client..
17. THEFTS
XXXXXXXXXX, its Director and its staff shall not be liable for any thefts or damages to set-ups, equipments, machineries or to any other object installed, displayed or stored within the leased spaces, as well as to any other objects, even personal, stored or worn inside the facilities.
18. GENERAL RULES
18.1 The Client shall undertake the commitment of complying with rules and regulations pertaining to temporary advertisement, musical shows and entertainments, exhibits and events in general, with special reference to the rules of Public Security pertaining to City Police Town Regulations (safeguarding quite and rest) and shall provide in absolving all the formalities required by the law and thus wholly bearing the relative costs, including SIAE rights, releasing henceforth XXXXXXXXXXXXXXX and its staff from any related liabilities thereof.
18.2 Any events or opening nights shall be notified in advance to and approved by Mr. Marco XXXXXXX. All music must necessarily and without fail cease by and not later than 22:00 hours.
19.PLACE OF JURISDICTION
The present contract shall be subjected to the Italian law and jurisdiction. For any dispute arising from or generated by the present contract shall be submitted to the exclusive jurisdiction of the Court of XXXXX. The jurisdiction and authority thereof shall not be derogated, not even for reasons of stay and consolidation of actions..
